Seniority Recognition a) Seniority is defined as a total length of continuous service in the bargaining unit for all employees. Seniority shall operate on a bargaining-unit-wide basis. i) In making promotions, demotions, transfers or layoffs, the required knowledge, abilities and skills as outlined in the Class Specification shall be the primary consideration and, where two (2) or more applicants are capable of fulfilling the duties of the position, the length of service with the Board shall be the determining factor. It is agreed and understood that, in the matter of applicants, current service employees shall be given preference. ii) For the purpose of this Article 5, “knowledge, abilities and skills” shall mean that there is an expectation, based upon a reasonable period of orientation (trial period, Article 4.3) and upon the senior employee’s previous training and experience, that the employee will be able to satisfactorily perform the regular duties of the position. c) Seniority during Absence i) Where an employee is absent due to Sick Leave, Workers’ Compensation, or Leave of Absence granted officially, and is receiving remuneration from the Board or the WorkSafeBC, such periods of absence shall be calculated as part of the employee’s service for the determination of eligibility for perquisites and determining length of service of the above employee. ii) Where an employee is officially absent for any reason and is not in receipt of remuneration from the employer or the WorkSafeBC, they shall not be entitled to any of the benefits enumerated in this Agreement, other than seniority rights.
Seniority Recognition. A. Transfers – Transfers within the unit, including transfers from one facility to another and working hours shall normally be covered by classification seniority and job qualifications. The opportunity to transfer shall be offered to employees in seniority order, commencing with the most senior to the least senior employee. In the event that no employee volunteers to transfer, the position or positions may be filled by assigning the lowest person on the classification seniority list with necessary job qualifications. Exceptions to this seniority process may be made in those instances where it is mutually determined to be in the best interest of both the employer and the employee, failure to observe the procedures outlined above, in cases where it is not mutually agreed upon, or any other arbitrary transfers shall be grievable, under the grievance procedures set forth in the agreement. Positions to be filled by transfers will be advertised (internal) for a minimum of ten working days.

It is the intent of both parties to give the senior employee the opportunity for higher paying jobs and choice of shifts, provided the employee has the ability and qualifications to perform the work available, subject to the procedures and in the order outlined herein. b. On plant-wide bids, employees may bid up, but not laterally or downgrade themselves, without a valid reason. During the life of this contract, an employee will be permitted the opportunity to bid laterally or downgrade one time for any reason. c. If, within four weeks after starting on a job to which he/she has bid, an employee performs unsatisfactorily or if, within five days after starting on a job, an employee self-disqualifies himself/herself, he/she shall be returned to the job from which he/she has bid without prejudice. Self-disqualification shall be permitted no more than once per contract year.
Seniority Recognition. ‌ It is agreed by the parties to this agreement that all out-of-scope service for the positions of Coordinator of Assessments and Assistant to the Managing Director of Assessment Services shall be counted for seniority purposes.

Such anniversary date shall be calculated in accordance with the relevant provisions of the relevant collective agreement.

Employees who are relocated/transferred* to another employer by the Hospital will retain her or his seniority and service at her or his original hospital for a 24- month period. Without prejudice to the Union’s or Hospitals’ rights under the collective agreement or the Labour Relations Act, employees relocated/transferred* shall have the right to post for vacancies that arise, prior to or subsequent to the relocation/transfer*, at their originating Hospital for that 24 month period. If they are the successful applicant, they will return to the employ of the Hospital with seniority accrued and service intact but not accrued, for the period that the employee was relocated/transferred* to another employer. *Pursuant to aSale of Business” under Section 69 of the Labour Relations Act, 1995, as it may be amended from time to time.

Seniority Recognition. (a) At the time of their being hired, new employees shall be classified as either Probationary Employees, Casual, or Temporary Employees and the Union shall be notified of such. (b) Probationary employees will be defined as those employees who are hired to become members of the permanent work force. They will achieve seniority after 90 days worked at which point they will become eligible to be enrolled in the Company's Welfare Plan and Pension Plan as defined in this Agreement, and will be paid in accordance with their applicable job rate. (c) The Company agrees to recognize the seniority rights of all employees who are members of the Union. Seniority will be the determining factor in lay-off as provided in Article 6.06 and choice of annual vacation period. (d) Each employee will have seniority standing in the department in which he is employed. Except in the cases of employees whose seniority rights have been established, Probationary Employees seniority will be dated one hundred and twenty-six (126) calendar days prior to the shift day on which he completes his probationary service, provided that such date will not be prior to his starting date. (e) An employee does not have seniority rights until he becomes regular and his seniority date is established. Seniority dates will remain unchanged provided that an employee may, within one month of first posting of his seniority date, submit evidence to the Company and the Union to have such date changed.
