Holiday Calendar. (a) The District shall provide the paid holidays set forth below to employees. To be eligible for holiday pay, the Employee must be in a paid status at least a portion of the workday immediately preceding or succeeding the holiday. The standard District holidays are as follows: New Year’s Day Xxxxxx Xxxxxx Xxxx Day Lincoln’s Day President’s Day Xxxxxx Xxxxxx Day (if approved by the Board of Trustees and added to the College Calendar for any year covered by this Agreement) Memorial Day Independence Day Labor Day Veteran’s Day Thanksgiving Day Day after Thanksgiving Christmas Day The District shall provide two (2) additional holidays each year during or in conjunction with the winter recess. These two (2) holidays shall be designated at the time the District Calendar is initially adopted for each year. If the District’s Winter Recess closure results in the loss of four (4) work days, the District shall also designate an additional one (1) special holiday during the Winter Recess. In any event the District shall provide three (3) additional holidays (originally provided in 1994, in lieu of a 1.2% salary increase) in accordance with Article 5, Section 1 (h) & Article 6, Section 1.

Plumas Bank will not process ACH files (i.e., forward ACH transactions to the Federal Reserve Bank) on the following days, as well as on all Saturdays and Sundays. Company agrees not to use a Service Provider to transmit files to Financial Institution without first entering into Financial Institution’s Third-Party Service Provider Agreement. If Company uses Service Provider to transmit Files to Financial Institution and Company and Service Provider have not entered into a Third Party Service Provider Agreement, Company (a) agrees that Service Provider is acting as Company’s agent in the delivery of Files to Financial Institution; and (b) agrees to assume full responsibility and liability for any failure of Service Provider to comply with the laws of the United States, the Rules and this Agreement. Financial Institution will not be liable for any losses or additional costs incurred by Company as a result of any error by Service Provider or a malfunction of equipment provided by Service Provider. Company is solely responsible for maintaining compliance with the requirements of Service Provider, including obtaining any software updates. Financial Institution’s sole responsibility shall be to transmit Financial Institution approved transactions to the ACH Operator and Financial Institution shall not have any responsibility for any File handled by Service Provider until that point in time when Financial Institution accepts and approves a File from such Service Provider for processing.
