JOB GUARANTEE. (a) Each employee whose name appears on the list of employees to be known as the Job Guarantee Roster, which list is attached hereto and marked “Appendix A”, will be entitled to the benefits set forth in sub-paragraph (b). (b) The Employer agrees that all of its employees whose names appear on the Job Guarantee Roster will be guaranteed regular full-time employment with the Employer in the production department in accordance with the provisions of this contract for the remainder of their working lives until they vacate same through retirement, resignation, death or discharge for cause; provided, however, in the event the Employer permanently ceases publication such guarantee will thereupon cease. The Employer also guarantees that, in the main, the production department will remain the newspaper’s production facility. The Employer will retain the right to lay off employees for lack of work, other than that which may arise from automation. (c) This job guarantee will not be subject to amendment or revision in future collective bargaining negotiations with respect only to those persons listed on “Appendix A”. In the event an employee accepts promotion to a supervisory position, the job guarantee will not apply to that individual. If an employee steps down from a supervisory position, the individual’s name will be added to the Job Guarantee Roster. (d) Nothing else in this agreement shall be interpreted as limiting the Employer in any way in the exercise of the customary functions of management and direction of the working forces, including the right to assign jobs, the right to hire, the right to suspend or discharge employees for just cause. (e) Seniority will apply in any retraining required for a new process and in filling positions created by the process. Recognizing that exceptions will occur, both parties agree to allow on a non-seniority basis retraining for a new process or in filling positions created by the process. However, both parties agree that the thrust and meaning of this clause shall be that seniority will prevail as the rule and not the exception. Employees will be retrained on as extensive a scale, including multiple skills, as is feasible and fair. (f) When positions become available, they will be posted to permit applications; day and night shift personnel shall both be eligible in filling vacancies as deemed appropriate by management. Seniority will prevail.

JOB GUARANTEE. (a) Each regular full time custodian and maintenance employee shall be guaranteed employment by the Board for one (1) year of at least two thousand eighty-eight (2,088) hours, it being understood that this does not apply to employees dismissed under this Agreement and is not a guarantee of job position. (b) Each regular full time clerical employee shall be guaranteed employment by the Board for one (1) year of at least one thousand eight hundred and twenty-seven (1,827) hours, it being understood that this does not apply to employees dismissed under this Agreement and is not a guarantee of job position.

JOB GUARANTEE. The number of regular full-time material handlers to be maintained at 180 positions within 30 days of the ratification of this agreement. The new positions which are established as a result of this letter shall be posted and filled in accordance with article 14.04 and 14.05. It is agreed that 150 such regular full-time material handler positions shall be maintained during the term of this collective agreement and that the employees occupying said positions shall not be subject to permanent lay-off for the duration of this agreement. The guarantee of 150 set forth in this letter does not apply in the case where the employer is prevented from maintaining its normal distribution operations by an act of God or in the case where the employer permanently closes its Metro Toronto and Brampton Distribution operations. The Company agrees it will maintain at least three (3) Material Handlers in the Shipping Department per shift.
JOB GUARANTEE. All custodians and maintenance personnel who are working at the signing of this contract will have their positions guaranteed to exist during the length of the contract with the exception of removal for disciplinary or unsatisfactory work, as outlined in the contract in previous sections.

JOB GUARANTEE. The TOWN OR XXXXXXXX, COLUMBIA COUNTY, hereby agrees to authorize inclusion and be bound by this repayment provision in the Project Agreement that will be executed between the applicant and the Wisconsin Department of Transportation as part of the Department’s approval of the applicant’s request for assistance under the Transportation Facilities Economic Assistance and Development (TEA) program. The VILLAGE OF CAMBRIA agrees, in this repayment provision, to reimburse the Department up to the full grant amount if employment within the economic development project (XXXXXXXX (TOWN)/UNITED WISCONSIN GRAIN PRODUCERS. LLC MINI RAIL YARD CONSTRUTION) fails to meet the following goals: (1) expansion of employment by 32 jobs in three years after A Rail Project Agreement is executed; and, (2) retention of these 32 jobs for another 4 years (verifications to be made at 3 and 7 years after Rail Project Agreement is executed). For purposes of this provision, a job is defined to be consistent with Trans. 510 of the Wisconsin Administrative Code. It will include all new non-retail jobs and exclude jobs obtained through geographic job transfers within Wisconsin except those that would be lost to the state. Eligible jobs may include full time equivalents (FTE’s). If the job guarantee is not satisfied, the Department will evaluate the job benefits that have been obtained in order to determine if reimbursement of either the full grant amount or reimbursement of a reduced amount based on a prorated share related to the number of jobs that have materialized as a result of the economic development project is appropriate.
