Jury Duty/Court Appearance a) To qualify for approval from the College to be absent with pay when summoned to serve on a jury, when subpoenaed as a witness in a criminal proceeding or as a witness in a civil action if not a party thereto, or when appearing as a defendant in a criminal or traffic case if acquitted therefrom, a regular or term employee shall produce the summons or subpoena or submit such other evidence showing the necessity for the absence.
b) The employee shall provide the College with proof of attendance from an Officer or Clerk of the Court. Any non- expense fee(s) paid to the employee shall be assigned to the College.
Jury Duty/Court Appearance. A teacher called for jury duty or subpoenaed to give testimony before any judicial body shall be compensated for the difference between the teaching pay and the pay received for the performance of such obligations. The Board will not be liable for this provision in any legal matter where the employee is testifying against the School Board, when the employee has been subpoenaed as a witness, or in situations where the teacher is found to be guilty of gross negligence or criminal act. Teachers released from judicial proceedings, during the school day, must report for duty immediately upon being released by the court in order to receive jury duty/court appearance pay, provided at least two (2) hours remain in the normal school day or a meeting has been scheduled which the teacher would normally attend.
Jury Duty/Court Appearance. When an employee is called for jury service or is subpoenaed to appear in any judicial proceeding in which the employee is not a party, the employee shall keep the remuneration received for jury duty and shall receive his/her regular pay.
Jury Duty/Court Appearance. 1. Should a staff member be called for jury duty, she/he shall provide a copy of the subpoena to the immediate supervisor. Staff members who serve during their normal work schedule will not be penalized in any way for doing so. They will receive full pay if they endorse the check received from the court or pay the amount shown on their record slip, less travel allowance, within fifteen (15) days of return from jury duty. While on jury duty, a staff member is required to report daily their schedule for the following day and must report to work when his/her presence is not required at court. The time spent on jury duty will not be charged against personal leave and will count as time on the job. Staff members must submit to their supervisor a record from the courts of the number of days served.
2. A staff member will be excused with pay for the time necessary for appearances in legal (court) proceedings connected with the staff member’s employment or with the school district, provided that the staff member is subpoenaed to appear by the Board, the Administration or someone acting on their behalf.
Jury Duty/Court Appearance. A teacher may be absent when called for jury service or for a court appearance in which the teacher is subpoenaed. The Board agrees to pay the difference between the teacher’s per diem rate and the remuneration received because of such appearance.
Jury Duty/Court Appearance. A) Time will be allowed for Jury Duty or Subpoenaed Witness Service without loss of pay or service credit. As full pay will be issued by the Board, any remuneration received for Jury or Witness Service will be turned over to the Board minus the value, supported by receipts, of any extra expenses caused by such service.
B) A teacher facing court appearances will be given the time to plead the case with no loss of service credit. At the discretion of the Director or designate, the teacher may be required to reimburse the Board for the cost of a replacement teacher.
Jury Duty/Court Appearance. Bargaining unit members shall be granted court or jury duty leave during normal working hours; provided, however, that they are served with a lawfully issued subpoena for such court or jury duty. There shall be no financial penalty attached to such service in any way, except that it be the understanding that whatever amount is earned in such capacity be returned to the Board less necessary and documented expenses incurred, and that such employee be paid his/her regular salary by the Board. All documentation shall be submitted to the Treasurer within twenty (20) work days of completion of duty. However, fees earned for jury duty or court service on an employee's day(s) off or during the months the employee is not normally working do not have to be remitted to the Treasurer of the Board. Such days shall not be deducted from any other leave days. When a bargaining unit member is subpoenaed to serve as a witness in a court action involving the Board or arising out of his/her employment, he/she shall be given a leave of absence with pay for the time required for such appearance(s); provided, however, nothing herein shall require the Board to grant an absence with pay if the member is a party plaintiff or witness in such suit against the Board nor when the Association is a plaintiff in a suit brought against the Board on behalf of the member or any other member of the bargaining unit. This leave is also inapplicable to any legal proceeding to which the bargaining unit member or a member of his immediate family is a named party.
Jury Duty/Court Appearance. 1. The Employer shall grant leave of absence with pay to any teacher summoned to serve on a jury or when subpoenaed as a witness in criminal or civil proceedings. A teacher on such leave shall pay over to the Employer any sums received for jury duty or witness fees, exclusive of traveling costs or meal allowances.
2. Leave of absence to appear in one's own defense or in appearances created by the teacher's private affairs shall be granted without pay.
3. A teacher who attends court ceremonies to become a Canadian Citizen shall be granted one (1) day’s leave with pay for that purpose.
Jury Duty/Court Appearance. A Board of Education is required to pay a full time employee the difference between such employee's regular compensation and the remuneration received for serving as a juror or subpoenaed court appearance. Compensation for jury duty only, shall be forwarded to the Treasurer of the District upon receipt.
Jury Duty/Court Appearance. 33.1 Employees serving on jury duty shall be carried "JD" (Jury Duty) for actual working time lost when called to serve on jury duty. Such employees shall be paid at their regular hourly rate for all working time lost up to forty (40) hours per week. Employees who work a regular shift between the hours of 11:00 p.m. and 7:00 a.m. and who are summoned to jury duty the day preceding their regular shift, shall be carried on leave of absence with pay for their regular shift. All employees released early from jury duty shall report back to work during their regular work schedule or shall forfeit the City compensation for Jury Duty for all hours they are absent.
33.2 In consideration of receiving their regular pay, employees called to serve on Jury Duty shall promptly notify their supervisor of the call to Jury Duty. The supervisor shall make a copy of the summons to Jury Duty and forward said copy with the payroll sheets for the week in which the employee is on Jury Duty.
33.3 Attendance in court in response to legal order or subpoena to appear and testify in private litigation not in connection with an employee's official duty, but rather as an individual, shall be taken as vacation, compensatory leave, or leave of absence without pay.
33.4 When requests for appearances before the Civil Service Board require witnesses, the Civil Service Office shall require that said requests delineate who are character witnesses and who are witnesses testifying as to the incident at hand. Should the number of character witnesses exceed two (2) then a statement from those additional character witnesses shall be submitted to the Civil Service Board stipulating to the character of the employee on appeal before the Civil Service Board.
