Court Appearance Pay a. Court appearance time for court or administrative hearings commences with the earliest time that the employee is compelled to report for that day. Court appearance time includes time for court preparation and conferences on the same day as the court appearance(s).
b. Employees appearing on a regularly scheduled day off for court or administrative hearings where the City or Department is a party shall receive a minimum of three (3) hours of court appearance pay at his/her regular rate of pay at the appropriate straight-time or overtime rate for each day involving one or more court appearances. If court appearance time exceeds three (3) hours, employees shall receive one hour of court appearance pay for each hour or fraction thereof of court appearance time.
c. Employees appearing less than one hour prior to the beginning of their scheduled shift for court or administrative hearings where the City or Department is a party shall receive one (1) hour of court appearance pay. Employees appearing for such hearings more than one (1) but less than two (2) hours prior to the beginning of their scheduled shift shall receive two hours of court appearance pay. Employees appearing for such hearings more than two (2) hours but less than three (3) hours prior to the beginning of their scheduled shift shall receive three (3) hours of court appearance pay. Employees appearing for such hearings more than three (3) hours prior to the beginning of their scheduled shift shall receive one hour of court appearance pay for each hour or fraction thereof of court appearance time.
d. No court appearance pay will be allowed for an employee’s meal period.
e. Employees on sick leave with pay or disability leave who appear for court or administrative hearings or are placed on standby are not entitled to additional compensation. Employees are paid as though they were working during these leave periods.
f. Employees on suspension who are subpoenaed and appear for court or administrative hearings or are placed on standby are entitled to compensation at their regular rate of pay.
g. Compensation requests for court appearances in which neither the City nor the Department is a party shall be processed, reviewed, and certified by the Department. These requests must be sent to the Department along with a copy of the subpoena and the record of court appearance approved by the requesting employee’s supervisor. Court Appearance Pay. A member required to appear in court during his or her off-duty hours shall receive a minimum of three (3) hours overtime for the court appearance. If the member is required to appear in court on his or her second consecutive day off, the member shall be paid at a double-time overtime rate.
A. The following provisions shall apply to members scheduled to appear in court other than during regularly scheduled working hours. A member who receives a subpoena or subpoenas requiring a court appearance either in the time period before noon or in the time period after noon on scheduled time off and is canceled shall be paid or credited for two (2) hours at the member's straight-time rate for either of the above time periods. It shall be incumbent upon the member to call for confirmation.
Court Appearance Pay. A member will be paid for any required court appearances which occur during a member’s off duty hours. A member who is required to appear in Court when otherwise off duty or on approved leave shall, if possible, call the Court to determine if the member’s attendance is necessary. If as a result of the call the member is required to attend Court, the member shall be compensated as provided in this Section Provided a member only has one scheduled court appearance or has multiple court appearances more than three (3) hours apart, when any one court appearance is completed, the member shall be released from duty. If the member is not required to attend Court, he/she shall be compensated two (2) hours pay, at the straight time rate, for calls made from Police Headquarters to a Court. Employees should make necessary phone calls in a manner to cause the member the least amount of inconvenience and the City the least amount of cost. For court appearances, members will be paid a minimum of three (3) hours at one-and-one-half (1½) times the member’s regular rate of pay for any court appearances that occur within three (3) hours of each other.
Court Appearance Pay. Any employee entitled to paid overtime, when properly subpoenaed, who makes a court appearance in person or via telephonic or video conferencing during his/her off duty time shall receive overtime compensation for actual time in court, with a minimum three (3) hours’ time.
Court Appearance Pay. A. Employees working in the Police Department who, on a scheduled time off, are required to be present in court in connection with the performance of their duties, shall receive two (2) hours minimum compensation at time and one-half. In the event such person is required to be present during both the morning and afternoon sessions of the court on the same day, such person shall receive, in addition to the above two-hour minimum, three (3) hours minimum compensation at time and one-half.
B. Employees classified as above whose shifts are extended to include a court appearance pay shall be paid for those hours in court at time and one-half.
Court Appearance Pay a) When required to make a court appearance on a scheduled day off, there shall be either a payment equal to three (3) hours pay at the overtime rate or payment for all hours actually worked at the overtime rate, whichever is greater. Morning and afternoon appearances on the same day in the same case shall be considered as a single, continuing appearance. Morning and afternoon appearances on the same day on separate cases shall be considered as separate appearances. Pay for two court appearances is the maximum that can be paid for one day, regardless of the number of required appearances.
b) Any and all court appearance time worked immediately prior to or following a complete scheduled shift shall be paid at the overtime rate for all hours.
c) If an employee is called back for court duty and picks up evidence for court, and the court duty extends beyond three (3) hours, the employee shall be credited, upon authorization, with an additional one-half (1/2) hour pay for travel.
d) If an employee appears in court during a scheduled vacation, he/she will receive overtime pay rather than vacation credit. Such pay will be entered into payroll following the employee's return to work from vacation.
e) When required to make court appearances more than three (3) hours prior to the beginning or following the conclusion of a regularly scheduled work shift there shall be a minimum payment of three (3) hours paid at the overtime rate or payment for all hours of the appearance at the overtime rate, whichever is greater.
f) The term "court appearance" includes appearances at Inmate Disciplinary Hearings.
Court Appearance Pay. A. An officer on a non-standard shift with hours outside of the 8:00 AM to 5:00 PM range shall be compensated for two (2) hours minimum for court required responsibilities for any police work performed in the course of work as an SPO at BCCC, with proper court documentation.
B. SPO’s who are called to report to court on their regular day off shall be guaranteed a minimum of four (4) hours of pay with proper court documentation.
Court Appearance Pay. Employees who are required to appear in court as a representative of the Employer at times when they are not scheduled to work shall be paid a minimum of four (4) hours' straight-time pay or overtime at the rate of one and one-half (1½) times their straight-time hourly rate of pay for the hours actually worked, whichever is greater. Such minimum pay guarantees shall not apply when the required work is immediately adjacent to a scheduled work shift.
Court Appearance Pay. A. Court Time. Association members required to appear in court in connection with the performance or their duties during the member's off-duty time, shall receive a minimum of three (3) hours of pay at time and one-half of his/her base hourly rate or the actual time in court at the time and one- half rate, whichever is greater. If an Association member is required to be in court during the morning and afternoon sessions, the Association member shall receive additional pay at the time and one•half rate for the lunch recess.
B. Court Stand-By Time "On Call." Whenever an Association member is placed "on-call" pursuant to a court subpoena while otherwise off-duty, the member shall receive compensation for being "on-call" at the rate of two (2) hours of straight time pay for each day spent in that status. "On call" pay shall not be provided on any day the member is called to appear in court.
