Jury or Court Witness Duty Leave. The Employer shall grant leave of absence without loss of seniority to an employee who serves as a juror or Crown witness in any court. The Employer shall pay such an employee the difference between his/her normal earnings and the payment he/she receives for jury service or court witness, excluding payment for travelling, meals or other expenses. The employee shall present proof of service and the amount of pay received to the Employer.

Jury or Court Witness Duty Leave. Employees who are called to serve as jurors or are subpoenaed as witnesses in criminal or civil courts, shall be granted leave of absence for such purpose without loss of any privileges. Normal pay will continue to be issued on the usual pay dates. At the conclusion of duty, the employee shall obtain a certificate from the Court showing the period of jury or witness service and the amount of the compensation received, and shall deposit this certificate together with the full amount of the compensation but not including traveling allowances, with the City. Employees shall make every reasonable effort to request leave prior to such leave occurring.

The Employee will notify the employer as soon as the employee becomes aware of the need for such time off.

(b) In the event that the provisions of this section indicate abuses, the matter shall be dealt with as per Article 7, Section 7.05, Clause (a) of this Agreement. (c) See Section 6.07 for benefits applicable to Casual Employees and Section 6.08 for benefits applicable to Temporary Full-Time Employees.
