The Off Duty Court Time clause defines how an employee is compensated or credited for time spent attending court proceedings outside of their regular working hours. Off Duty Court Time. That in the event members of the Staff Component are required to appear in court as defined in the Police Component, then such members shall be compensated in accordance with the terms of the Police Component applicable thereto.
Off Duty Court Time a) Whenever a member is off duty, on other than his regular weekly leave or annual leave, and is required to appear as a witness in any proceedings arising out of the performance of a Police duty, at: Provincial Court including, without derogating from the generality hereof, proceedings in Youth Court, hearings under the Fatalities Inquiries Act, and matters proceeding in the Provincial Court, Family Division; in Queen’s Bench Court, whether in any Civil, Family or Surrogate Division proceedings, or any criminal proceedings, either before a single judge, or at an assize; an interview with Crown Counsel in preparation of a case; and disciplinary hearing held by the City, the Council thereof, or any statutory delegated committee thereof; the Manitoba Police Commission, including any individual body or bodies which the Government of Manitoba creates by legislation in addition to, or in place of the Manitoba Police Commission; and at any other statutorily authorized or delegated body with fact finding powers; he shall be paid at the rate of time and one-half times (1.5x) the regular hourly rate of pay for the total elapsed time with a minimum payment of four (4) hours.
b) These provisions also apply to any member who is an accused (or as an appellant), providing the penalty imposed does not exceed an admonition. This will also apply in those cases where, on appeal, the appeal is allowed and the penalty imposed does not exceed an admonition.
c) Any member of the Association who is off duty and is scheduled to commence a regular tour of duty, the starting time of which is less than one (1) hour after the time he is required to appear as a witness as set forth above, shall receive one
(1) hour of pay for such attendance, and the foregoing provisions as to the minimum payment of court overtime shall not apply to such attendance.
d) Should such member be required to appear on more than one (1) case at the same sittings of the Court, then he shall receive only one (1) minimum payment.
e) If a case is adjourned from the morning to the afternoon sittings of the Court, or if a member is required to attend a morning and afternoon and/or evening sitting of the Court on the same day for different cases, then only one (1) minimum payment will be paid; however, the total elapsed time of the member shall be paid at the rate of time and one-half times (1.5x) the regular hourly rate of pay, provided that if the total elapsed time of the member exceeds eight (8) hours the membe...
Off Duty Court Time. When an employee is required to spend off-duty time in local court on behalf of the City, the employee shall receive overtime pay for all hours worked with a minimum pay guarantee of two (2) hours’ pay at the overtime for court appearances in LaSalle/ Peru. Such guarantee is three (3) hours for court appearances outside of LaSalle/Peru; and four (4) hours, provided the employee actually is in such court outside of LaSalle/Peru for at least one (1) hour. An Employee scheduled to appear in court shall receive two (2) hours pay if the court appearance is cancelled on the day the employee is to appear.
Off Duty Court Time. Officers required to attend court in connection with their official duty during scheduled off-duty hours shall be compensated for all hours during which he or she attends as required. Pay shall be at the applicable rate of pay (straight time or overtime). The officer will be paid a minimum of three (3) hours pay for an off-duty court appearance except when the off-duty court appearance is contiguous with the beginning or ending of the employee’s scheduled tour of duty. An officer will be paid a minimum of two (2) hours for State Attorney’s investigations. Multiple court appearances in the same calendar day shall be credited separately or as one continuous appearance, whichever is least expensive to the Department. Officers will not be required to be placed on standby time; however, whenever an officer is subpoenaed for court, he or she may arrange with the court to be placed on standby. Standby shall not be compensable by the City. Witness fee and expenses paid by the court shall be retained by the officer.
Off Duty Court Time. A member, who has been instructed to appear in court on off duty hours shall, at City expense, telephone the Sergeant on duty in his Division between the hours of 18:00 and 22:00 on the day immediately preceding the scheduled court appearance, to confirm whether his attendance at court is required. If the member receives notification of cancellation of the scheduled court appearance before 22:00 hours on the day immediately preceding the scheduled appearance the member shall receive no compensation. If the member receives notification of cancellation of the scheduled court appearance after 22:00 hours on the day immediately preceding the scheduled appearance, the member shall be entitled to receive four (4) hours at time and one-half times (1.5x) the regular hourly rate, in pay or time off, for said cancellation.
Off Duty Court Time. 16.1 Off duty court time shall be computed in the following manner: the normal witness fee and expenses shall be retained by the employees and an additional three hours of credit shall be given for the first court appearance in any given calendar day, subject to the provisions set forth herein.
16.1.1 In the event that the court appearance begins less than three (3) hours prior to the assigned tour of duty, time actually worked to the beginning of the shift shall be credited.
16.2 For each court appearance in excess of three (3) hours, an officer shall receive credit for all hours during which his attendance is required.
16.3 Multiple court appearances in the same calendar day shall be credited separately or as one continuous appearance, whichever is least expensive to the Department.
16.3.1 If treated as one continuous appearance, time spent from the beginning of the first appearance to the conclusion of the last appearance will be credited.
16.3.2 If treated as separate appearances, the officer will be guaranteed a three (3) hour minimum credit for the additional appearances providing there is a three (3) hour lapse between the subpoena release and a subsequent subpoenaed appearance.
Off Duty Court Time. Employees required, on a duty related matter during non-working hours (off duty), to attend court or any other City legal matter in response to subpoena will be compensated as provided herein.
14.1.1 For off duty court appearances of two hours or less, the employee shall be guaranteed payment of two hours pay.
14.1.2 For off duty court appearances in excess of two hours, an employee shall receive payment for all hours during his appearance.

Whenever an employee is off duty, on other than his regular weekly leave or annual leave, and is required to appear as a witness in any proceedings arising out of the performance of duty at inquests, Magistrate’s Court, Juvenile and Family Court, County Court, Court of Queen’s Bench, or any court of civil litigation, and/or is required to attend an interview with Crown Council in preparation of a case, and/or is required to attend any disciplinary hearing held by the City, the Council thereof or any statutory delegated Committee thereof, or any other properly authorized body, whether as a witness, or as an accused, or as an appellant, in those cases where, on appeal, the appeal is allowed, or the penalty imposed by the Tribunal does not exceed an admonition, he shall be paid at the rate of time and one half (1.5x) the regular hourly rate of pay for the total elapsed time with a minimum payment of four (4) hours, which includes one (1) hour of travelling time. Provided that, upon request of the employee concerned, compensating time off will be allowed in lieu of overtime pay on the basis of one and one half (1½) hours for each hour to the employee’s credit as above set forth. Provided further that any employee of the Association who is off duty and is scheduled to commence a regular tour of duty, the starting time of which is less than one (1) hour after the time he is required to appear as a witness as set forth above, then he shall receive one (1) hour of overtime pay at time and one half (1.5x) his regular hourly rate of pay for such attendance, and the foregoing provisions as to the minimum payment of overtime shall not apply to such attendance.
