WORK PERIOD AND OVERTIME. Parties have agreed that employees in this bargaining unit shall be paid on a monthly basis. The County may implement a semi-monthly pay period in lieu of the monthly pay period. Lieutenants, who actually work in excess of forty (40) hours in a work week, shall receive overtime at the rate of time and one half their base hourly rate, either in compensation or by way of compensatory time off. Work performed includes time actually worked, compensatory time used, and vacation time used. Compensatory time shall be granted at such time and in such time blocks as are mutually agreed upon between the employee and Sheriff. Compensatory time accrued shall not exceed a maximum of eighty (80) hours. The Chief Deputies shall be expected to work up to whatever number of hours are necessary to complete the work criteria established by the Sheriff. The parties have bargained and agreed that the Chief Deputies are exempt from the overtime provisions of the FLSA.

WORK PERIOD AND OVERTIME. Section 16.1 The normal scheduled workweek for sergeants assigned to the Patrol Division shall be four (4) days on and two (2) days off. The normal workday for this schedule shall consist of eight and one-half (8.5) consecutive hours. Section 16.2 The normal workweek for all sergeants other than patrol sergeants shall consist of five (5) days on (Monday through Friday) and two (2) days off (Saturday and Sunday). The normal workday for this schedule shall consist of eight (8) consecutive hours. Section 16.3 The normal workday shall consist of first, second, and third shifts. The first shift is any shift, which regularly starts on or after 5:30 a.m., but on or before 9:00 a.m. The second shift is any shift, which regularly starts on or after 1:30 p.m., but on or before 4:00 p.m. The third shift is any shift, which regularly starts on or after 9:00 p.m., but on or before 11:30 p.m. All shifts for all employees covered by this Agreement shall be scheduled for starting times within the hours stated above for first, second and third shift. Section 16.4 Changes in the work shifts, described in Section 16.3, shall be made only after seven (7) days’ notice has been given to the affected officers and immediate supervisor, or at any time the Safety/Service Director or Chief of Police declares an emergency. Changes in a sergeant's work shift or starting hours may be made with less than seven (7) days’ notice by mutual agreement between the City and the affected employee. An exception to the requirements for changing a sergeant’s work schedule and hours shall be made for those sergeants who volunteer for, and are selected to participate in the Community Action Team. Due to the nature of these assignments, varying work days and hours will be required to effectively conduct the mission. A. Overtime will be compensated at one of three basic rates: “Straight Time” = the regular hourly rate as determined and defined by ordinance; “Time and one half” = one and one half time the regular hourly rate; or “Double Time” = two times the regular hourly rate. B. Sergeants on a five (5) and two (2) work schedule shall be paid overtime only for the hours actually worked in excess of 40 hours in any workweek. Sergeants on a 4 & 2 schedule shall be paid overtime for the hours actually worked in excess of their regular schedule on a weekly basis. Time off for unexcused sick leave shall not count toward the determination of overtime.

The City will establish the hours of work best suited to meet the needs of the Department to provide superior service to the Community, but agrees that work schedules will not intentionally be changed or altered solely to avoid the payment of overtime. The work schedule shall be posted at least twenty eight (28) days in advance of the start of the new schedule, and may be changed by the Chief or his designated agent if necessary for operational reasons. SECTION 4. Trading times – Trading times shall not be permitted when it results in additional scheduled overtime or leaves a shift without adequate supervision. Nothing herein shall guarantee any employee payment for the 80 hours unless they actually work said hours. For the purposes of this Agreement, paid vacation leave and bereavement shall count as hours worked, whereas sick leave, which occurs within twenty four (24) hours of claimed overtime shall not count as time worked for computation of overtime pay. Overtime pay shall be paid at the premium hourly rate of pay for all hours beyond an employee’s normal daily work schedule except as noted in 8.1 (b) and 8.1 (c) below and shall be for one and one-half (1.5) times the basic hourly rate for every hour worked. An employee’s basic hourly rate shall be computed by dividing the employee’s annual salary by the total hours scheduled in a year (2,080).
