SHIPPING CONDITIONS. 1. The transport of the Device to the Client’s site stated in Article III hereof shall be provided by the Contractor under the terms of DAP Praha (Incoterms® 2020) and shall be by road haulage truck and the Contractor shall notify the Client in writing about the date of dispatch of the Device from the Contractor’s manufacturing plant. At the same time, the Contractor shall give the Client the licence plate number of the give vehicle as well as the names and surnames of the crew, at the latest 3 working days before delivery of the Device to the Client. The Contractor acknowledges that he has the obligation to obtain the necessary permits to enter the city center, if necessary.
2. The shipment of the Device must be complete and must comply with deadline requirements specified Time schedule which is the Annex No. 3 hereof. Partial deliveries are not permitted.
3. The Device must be shipped in a packaging unit sufficiently protecting the Device from damages, destruction or theft during the shipping. The parts, whose size does not exceed the size of the transport lift with an official load capacity of 2800 kg (could be increased) and dimensions: width 1300 mm, height 2100 mm and length/depth 2850 mm, shall be preserved and packed on pallets and covered with foil. The pallets will be prepared for unloading with a forklift and their centre of gravity will always be marked. The packaging of the Device or the Device alone must also allow to move the Device in other position (e.g. laying on side or back) in necessary cases. The Contractor is obliged to prepare a separate delivery note for each pallet dispatched with specification of its dimensions and weight.
4. The Contracting Parties have agreed that the Contractor's technician will supervise the unloading of the Device from road haulage truck and the transport of the Device to the installation site, which will be carried out by the Client.
SHIPPING CONDITIONS. Subject to the terms and conditions of this Agreement, Codexis shall accept such Firm Orders from Customer for each Codexis Enzyme; provided, that Codexis shall not be obligated to accept a Firm Order for Codexis Enzyme for any particular Quarter to the extent that the quantity of Codexis Enzyme ordered for delivery in such Quarter exceeds [***] of the quantity of Codexis Enzyme forecasted for such month in accordance with Section 3.4 (Forecasts); provided, however, that Codexis shall use commercially reasonable efforts to fulfill orders for such excess quantities from available supplies, taking into account Codexis’ own use, distribution and other obligations. Codexis shall communicate to Customer any potential manufacturing or supply challenges of which it is aware at the time of receipt of the Firm Order, which are reasonably expected to impact Codexis’ ability to fulfill such Firm Order.
SHIPPING CONDITIONS. The Reseller will place orders for the Products in master carton quantities. If the Reseller ships to its Customers EVI and/or FCB Products in other than master carton quantities, then the Reseller is responsible to fully and appropriately package each individual Product to protect it from shipping and handling damage.

SHIPPING CONDITIONS. 10.1 The vessel shall be a single deck bulk carrier with a maximum age of 20 years nominated by the Seller and confirmed by the Buyer. Seller shall advise Buyer by telex or fax before expected time of shipment of the name and nationality of the vessel, plus vessel's deadweight, draft, overall length, number of hatches, expected laydays at the port of loading, the expected quantity to be loaded and demurrage/despatch as specified in the Charter Party.
10.2 Buyer shall advise Seller of his acceptance or rejection of the vessel within 24 hours after receipt of Sellees vessel nomination unless the nomination is received by buyer after close of business Bangkok time on Friday or on the day before a Holiday, in which case Buyer will inform Seller of his acceptance or rejection upon opening of business in Thailand, by 12 Noon, Bangkok time, on Monday or on the first working day after the Holiday.
10.3 At discharge port, Buyer guarantees: One safe berth for vessels at Sriracha Port with following restrictions: - Maximum deadweight 50,000 metric tons - Maximum length overall 186 metres - Maximum beam 30.40 metres - Maximum draft 12 metres salt water - AND/OR - One safe anchorage at Kaosichang Anchorage with the following restrictions: - Maximum deadweight 70,000 metric tons - Maximum draft 20 metres salt water - AND/OR - One safe berth for vessels at Laem Chabang Port with following restrictions: - Maximum deadweight 50,000 metric tons - Maximum length overall 186 metres - Maximum beam 30.40 metres - Maximum draft 12 metres salt water
10.4 Within 24 hours after vessel's departure from loadport, Seller shall give Buyer the approximate estimated time of arrival at discharge port followed by a 2 day and 24 hour notice of expected arrival time at discharge port. These notices shall be given as soon as practically possible for Seller, taking into account Sellers office hours.
10.5 Vessel's cranes and grabs will be used for discharging. Buyer guarantees a takeaway rate of 6,000 metric tonnes per day of 24 consecutive hours, weather permitting, holidays excluded, unless used, by either truck, and/or barge and/or conveyor regardless of discharge port. Buyer has the option to choose a takeaway rate of 10,000 metric tonnes per day of 24 consecutive hours, weather permitting, holidays excluded, unless used. Buyer shall have the right to declare which takeaway rate will be guaranteed for each vessel upon Buyers acceptance of each nominated vessel. For a period of two (2) years...

At the same time, the Seller will give the Buyer the licence plate number of the give vehicle as well as the names and surnames of the crew, at the latest 3 working days before delivery of the Device to the Buyer.

3. The Device must be shipped in a packaging unit sufficiently protecting the equipment from damages, destruction or theft during the shipping. The parts, whose size does not exceed the size of the transport lift with a load capacity of 3500 kg and dimensions: width 1780 mm, height 1980 mm and length 2780 mm, shall be preserved and packed on pallets and covered with foil. The pallets will be prepared for unloading with a forklift and their centre of gravity will always be marked. The forklift shall be provided by the buyer on its own expenses. Other removal tools shall be provided by the seller on its own expenses. The Seller is obliged to prepare a separate delivery note for each pallet dispatched with specification of its dimensions and weight.
SHIPPING CONDITIONS a. Buyer guarantees that it has access to storage capacity at the discharge port for at least 20,900 metric tons of anhydrous ammonia and that its discharging facilities can accommodate vessels of following description: Length Over All (LOA): Maximum 750 feet. Beam Maximum 106 feet Draft: Maximum 38 feet brackish water Height of manifold above water level: 50 feet Maximum Bridge air draft restrictions None
b. Unless inconsistent herewith, the provisions of the ASBATANKVOY Charter Party form shall govern vessel deliveries including, without limitation, the calculations of laydays and laytime at the discharge port, giving notice of readiness, computation of demurrage, provision of safe berth and shifting, pumping, provision of hoses, and payment of dues, taxes and wharfage, etc. The provisions of ASBATANKVOY are incorporated in this Contract by reference, with the term “Owner” in ASBATANKVOY being deemed to refer to Seller and the term “Charterer” being deemed to refer to Buyer.
c. Buyer shall designate and procure for each vessel’s or barge tow’s discharge a safe port and a safe berth reachable on arrival, always accessible and of sufficient depth to permit the carrying vessel to proceed to, lie at and depart from always safely afloat. Any shifting of the vessel or barge shall be at Buyers’ risk and expense, and time consumed on account of such shifting shall count as used laytime or time on demurrage. Vessels and barges shall be free of wharfage or dockage charges.
d. The performing vessel or barge shall be entitled to tender NOR upon its arrival at the discharge port and time shall count as laytime or demurrage regardless of any delay in connection with security regulations or measures, including regulations or measures imposed under the ISPS Code or SOLAS Chapter XI. Any delay, damages, costs or expenses whatsoever arising out of or related to such regulations or measures, including, but not limited to, security guards, launch services, tug escorts, port security fees or taxes and inspections, shall be for Buyer’s account.
e. If a berth is not available on the vessel’s or barge’s arrival due to night restrictions, then Seller may instruct the vessel or barge to remain outside the port until the vessel or barge is able to proceed to a berth, in which case the vessel or barge may tender its notice of readiness from outside the port and all time waiting there shall count fully as used laytime or time on demurrage.

At the same time, the Contractor shall give the Client the licence plate number of the give vehicle as well as the names and surnames of the crew, at the latest 3 working days before delivery of the Device to the Client.

SHIPPING CONDITIONS. Substitutions will not be accepted. The Goods must be shipped completely by the date requested but must not be shipped more than one week in advance of the time or times specified herein, without Buyer’s prior approval. When more than one shipment is made against any Order, indicate “Final Shipping” on shipping papers and invoice accompanying the last shipment in the Order. Seller shall not ship excess quantities without Buyer’s prior approval. Except as otherwise provided herein, Buyer shall not be obligated to accept untimely, excess or under shipments and such shipments in whole or in part may, at Buyer’s option, be returned to Seller, or held for disposition at Seller’s expense and risk. Seller’s invoice shall describe the items, state the purchase Order number and be attached to the original bill of lading or other shipping receipt.
