Union Delegate Rights. 51.1 To the extent that the provisions of clause 36A of the Award may confer a more favourable benefit upon a workplace delegate than the explicit terms of this clause, those provisions will operate as terms of this clause.
51.2 Where an Employee has been elected as a Union Delegate, the Employer will recognise the following rights:
(a) the right to be treated fairly and to perform their role without any discrimination in their employment;
(b) for the Union Delegate to represent an Employee when requested in relation to a grievance, dispute or a discussion with a member of the Union;
(c) the right to place information on a notice board in a prominent location in the workplace except that the material must not breach freedom of association, privacy and other applicable laws;
(d) the right to paid time to attend industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workplace;
(e) the right to paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace;
(f) the right to represent the interests of members in their workplace to the Union, Employer and industrial tribunals/courts; and
(g) the right to paid time to attend Union meetings for the purposes of the Union and Project related matters, typically monthly or as reasonably required.
51.3 Union Delegates will be paid the classification rate applicable to their substantive role taking into consideration their skills and/or tickets.
51.4 The Employer will consult and agree with the Union prior to the Employer making a decision to terminate or transfer a Union Delegate/Employee Representative.The Union Delegate/Employee Representative is entitled to one week’s notice in advance of such termination or transfer. Payment in lieu of notice may be made by agreement.

(e) the right to paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace; and
(f) the right to represent the interests of members in their workplace to the Union, Employer and industrial tribunals/courts;

50.2 Prior to the Employer making a decision to terminate or transfer a Union Delegate/Employee Representative, the Employer shall notify the Union Delegate/Employee Representative one week in advance of such termination or transfer. Payment in lieu of notice may be made by agreement.
Union Delegate Rights. (a) This clause outlines the rights for Union Delegates when assisting Employees.
(b) Such representatives are entitled to the protections of Division 4 of Part 3-1 of the Act in relation to their involvement in lawful industrial activities. Where an Employee has been elected as a Union Delegate, the Employer will recognise the Union Delegate has the right to:
(i) be treated fairly and to perform their role as Union Delegate without any discrimination in their employment;
(ii) represent an Employee where requested in relation to a grievance, dispute or a discussion with a member of the Union;
(iii) paid time to attend job matters affecting Employees (such as disciplinary and other appropriate meetings), industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workforce;
(iv) paid time during normal working hours, to consult and confer with Union Officials;
(v) paid time during normal working hours to participate in the necessary operations of the Union, provided:
A. sufficient notice is given to the Employer; and
B. the Employer agrees. However, agreement will not be unreasonably withheld by the Employer.
(vi) be present at site induction meetings for the purpose of being introduced as the Union Delegate; and
(vii) place information on a Union noticeboard in a prominent location in the workplace.
Union Delegate Rights. Where an Employee has been elected as a Union Delegate, the Company will recognise the following rights:
a) the right to be treated fairly and to perform their role without any discrimination in their employment;
b) For the Union Delegate to represent an Employee where requested in relation to a grievance, dispute or a discussion with a member of the Union;
c) the right to place information related to permitted matters on a notice board in a prominent location in the workplace except that the material must not breach freedom of association, privacy and other applicable laws; and
d) the right to paid time to attend industrial tribunals and/or courts where they have been requested to do so by an Employee (which may include themselves) whom they represent in a particular dispute in their workplace;
e) the right to paid time to assist and represent Employees who have requested them to represent them in respect of a dispute arising in their workplace; and
f) the right to represent the interests of members in their workplace to the Union, the Company and industrial tribunals/courts;
g) the right to formal recognition that the endorsed Union delegates will speak on behalf of the Union members in the workplace;
h) the right to paid time to attend Union endorsed training/forums which are directed to improving the skills and knowledge of the participant in the system of workplace relations.
Union Delegate Rights. 49.2.1 Where an employee has been elected as a Union Delegate, the employer will recognise the following rights;
a) The right to be treated fairly and to perform their role without any discrimination in their employment;
b) For the Union Delegate to represent an employee where requested in relation to a grievance, dispute or a discussion with a member of the union;
c) The right to place information related to permitted matters on a notice board in a prominent location in the workplace except that the material must not breach freedom of association, privacy and other applicable laws;
d) The right to paid time to attend industrial tribunals and/or courts where they have been requested to do so by an employee (which may include themselves) whom they represent in a particular dispute in their workplace;
e) The right to paid time to assist and represent employees who have requested them to represent them in respect of a dispute arising in their workplace; and
f) The right to represent the interests of members in their workplace to the union, the employer and industrial tribunals/courts.
g) This clause does not provide for a non-working Union Delegate.
Union Delegate Rights. This clause outlines the rights for Union Delegates Representatives when assisting Employee(s). Such representatives are entitled to the protections of Division 4 of Part 3-1 of the Act in relation to their involvement in lawful industrial activities. Where an Employee has been elected as a Union Delegate, the Employer will recognise the Union Delegate has the right to:
Union Delegate Rights.
(a) Union delegates or elected workplace representatives, with approval of Discovery Early Learning Centre’s and upon application in writing, shall be granted up to five days leave without pay each calendar year to:
(i) represent the interests of members at Discovery Early Learning Centres and at times industrial tribunals;
(ii) consult with union members and other Employees for whom the delegate is a bargaining representative;
(iii) attend union education; and
(iv) attend courses conducted by an approved training provider, that are designed to provide skills and competencies that will assist the delegate or workplace representative contribute to the prompt resolution of disputes and or grievances in the workplace.
(b) It is recognised that union training leave is unpaid. In addition to union training leave, the Employee may elect to utilise other forms of leave in accordance with other terms of this Agreement.
(c) Any request for leave to attend union training, the Employee must submit their request in writing with 14 days’ notice prior to the commencement of the Union training to Discovery Early Learning Centres. Approval of the leave request shall be on the basis that Discovery Early Learning Centres agrees to release the delegate from their normal roster if the delegate was rostered to work during the time of leave.
(d) The granting of any leave pursuant to this clause shall be subject to Discovery Early Learning Centres being able to make adequate staffing arrangements amongst current Employees during the period of such leave. Discovery Early Learning Centres shall not use this subclause to avoid an obligation under this clause.
(e) Leave of absence granted pursuant to this clause, shall count as service for all purposes of this Agreement.
(f) All expenses (such as, travel, accommodation, and meals) associated with or incurred by the Employee attending a training course as provided in this clause shall be the responsibility of the Employee or the Union.
Union Delegate Rights. 9.3.1 The Union delegate must be allowed the facility and the necessary time during working hours to meet with Employees. The Union delegate must be allowed the necessary time during working hours to meet with a representative of management on matters affecting Employees whom the delegate represents.
9.3.2 A Union delegate must not exercise any of the functions in this clause where to do so would result in unreasonable under-staffing or disruption of, or be detrimental to the workplace.
9.3.3 This clause operates only to the extent that its obligations relate to the relationship between the Employer and the Employees covered by this Agreement.
Union Delegate Rights. Where an Employee has been elected as a Union Delegate, the Employer will recognise the following rights: • the right to represent the interests of members in their workplace to the Union, the Employer and industrial tribunals/courts. • Union Delegates will receive an additional $1.50 for all hours worked and/or attending approved training. • The Employer will release from work a Union Delegate to attend 5 meetings per calendar year conducted by the Union to discuss industry related matters. Union Delegates will be paid their ordinary hourly rate, including all allowances, applicable site allowance paid for the site engaged on at the time of training.
