Xxxx Leave Donation Program. If a bargaining unit member, his/her spouse, or minor child(xxx) has a catastrophic illness or injury or if there is a death of a spouse or minor child, and the member has exhausted his/her sick leave, he/she may apply to the Association Executive Board to receive donations of sick leave from other bargaining unit members. If approved, the Executive Board will solicit donations from the bargaining unit members. Each member may donate up to 3 days, with the total donation not to exceed 60 days. The Association Executive Board shall notify the Treasurer’s office in writing of the teachers who donated days and to whom the donations should be credited. No additional advancement under this Section shall be made if a member is permanently disabled. A member who has applied for and been recommended for disability by an STRS physician may not apply for days to extend the date of eligibility for disability.

Xxxx Leave Donation Program. 1. The District will not limit the number of medical emergencies in any given year. This leave is available to employees for care of their immediate families as defined in Article 18. 2. The District and the Association agree that there are times when an employee may need additional leave days should a serious health care condition or bonding with a new child causes an employee to exhaust his/her accumulated sick leave days, personal leave days and vacation days. A serious health condition is defined by state and Federal FMLA which has caused or is likely to cause the employee to take leave without pay or terminate his/her employment. This would also include a serious health condition of an immediate family member as defined by FMLA or Oregon FMLA. 3. The District and the Association further agree that employees may apply for the use of up to forty (40) additional leave days during a school year under the following conditions: a. The employee must have used all his/her accumulated sick leave. b. The employee must have used all his/her personal leave. c. The employee must not be eligible for the lost time compensation under Workers’ Compensation. d. The employee has been absent for five (5) consecutive days or demonstrates a continuing pattern of absence because of a serious health condition. e. The employee must complete an application form and submit it to the HR Director. f. The employee must present a physician's statement of illness and other documentation as required.
Xxxx Leave Donation Program. 1. In the event of a catastrophic illness or injury to an employee or a member of the employee’s family, a sick leave bank may be established. 2. Catastrophic illness or injury is defined to mean an illness or injury that is expected to incapacitate an employee or member of an employee’s family for an extended period of time. 3. Family member is defined to mean the employee’s spouse, parents, parents- in-law, sibling, children and stepchildren, or a family member for whom the unit member is the primary caretaker. 4. Under this sick leave donation program, employees may donate up to ten (10) accumulated sick leave days per year. The employee who chooses to donate: a. Must provide written notice to the District of the intent to transfer the accumulated sick leave days; b. Must acknowledge in writing to the District that the employee understands that he/she cannot revoke the donation of the accumulated sick leave days because all such donations are irrevocable and binding. The donating employee must sign and date this acknowledgment. 5. Under this program, unit members may receive donated days as follows: a. Catastrophic illness or injury to an employee: i. He/she may receive hours up to a maximum of the number of hours necessary to receive full pay until the income protection program begins (maximum 90 days). ii. He/she must have exhausted all other employment benefits (sick leave, vacation). iii. He/she must request in writing to the Associate Superintendent of Human Resources (or designee) that accumulated sick leave days be donated and the method of notification. iv. He/she must provide verification of the catastrophic illness or injury to the District. b. Catastrophic illness or injury to a member of the employee’s family: i. He/she can only receive donated accumulated sick leave hours once per fiscal year and for a maximum of thirty (30) days. ii. He/she must have exhausted all other employment benefits (sick leave, vacation). The cap on personal necessity leave established in other sections of this Article does not apply when an employee qualifies for catastrophic leave for illness to a member of the employee’s family. iii. Xxxx Leave Donation Program. A Labor Management Committee will be established for the purpose of proposing rules and procedures for a new, program. The LMC will be to develop consistent, transparent and equitable proposals for processes across all departments within the City. The LMC shall also explore proposals to lower the minimum leave bank required to donate sick leave and permit donation of sick leave upon separation from the City. The LMC must consult with the Office of Civil Rights to ensure compliance with the City’s Race and Social Justice Initiative. Once the LMC has developed its list of proposals, the City and Coalition of City Unions agrees to reopen each contract on this subject.
Xxxx Leave Donation Program. 1. With the approval of the Superintendent, if a bargaining unit member exhausts his/her sick leave accumulation because of a current or past catastrophic or long-term illness or injury of either the employee or an immediate family member (as defined in Art. 4.01(D)), another bargaining unit member may donate up to five (5) days of his/her accumulated sick leave to the donee bargaining unit member requesting the donation of sick days. 2. No bargaining unit member may receive more than an aggregate of thirty (30) donated sick leave days in any one (1) school year, unless granted approval by the Superintendent. If additional days are granted by the Superintendent, this waiver decision shall not set a precedent for future requests for donated days beyond thirty (30) days. Donation of sick days shall be initiated by a bargaining unit member on a form furnished by the Treasurer. Donated sick days shall be added to the sick leave accumulation of the donee if/when needed in the order donated (i.e., first donated, first deposited), plus five (5) additional donated days to the accumulated sick leave of the donee bargaining unit member requesting the donation and deducted from the donor bargaining unit member’s accumulated sick leave. 3. To qualify for the absence of the donated sick days provision, the bargaining unit member must submit a doctor’s statement to the Treasurer certifying the current medical need. 4. Donated sick leave days must be submitted to the Treasurer three (3) work days prior to the need of the bargaining unit member receiving the days. This requirement may be waived at the discretion of the Superintendent. However, any waiver decision by the Superintendent shall not set a precedent for future requests for a waiver. 5. The Treasurer shall provide a copy of all donation forms to the Association President. 6. All accumulated sick days, personal days, and vacation days must be used by the bargaining unit member before donated sick leave days may be used. 7. Donated sick leave may not be used for severance pay, nor may it be used to pay the bargaining unit member who goes on disability retirement. 8. Any donated but unused sick leave days that are not transferred to the donee will be returned to the bargaining unit member who donated the days.

  • Leave Donation Program Employees may donate paid leave to a fellow employee who is otherwise eligible to accrue and use sick leave and is employed by the same Agency. The intent of the leave donation program is to allow employees to voluntarily provide assistance to their co-workers who are in critical need of leave due to the serious illness or injury of the employee or a member of the employee's immediate family. The definition of immediate family as provided in rule 123:1-47-01 of the Administrative Code shall apply for the leave donation program. A. An employee may receive donated leave, up to the number of hours the employee is scheduled to work each pay period, if the employee who is to receive donated leave: 1. Or a member of the employee's immediate family has a serious illness or injury; 2. Has no accrued leave or has not been approved to receive other state-paid benefits; and 3. Has applied for any paid leave, workers' compensation, or benefits program for which the employee is eligible. Employees who have applied for these programs may use donated leave to satisfy the waiting period for such benefits where applicable, and donated leave may be used following a waiting period, if one exists, in an amount equal to the benefit provided by the program, i.e. fifty six hours (56) pay period may be utilized by an employee who has satisfied the disability waiting period and is pending approval, this is equal to the seventy percent (70%) benefit provided by disability. B. Employees may donate leave if the donating employee: 1. Voluntarily elects to donate leave and does so with the understanding that donated leave will not be returned; 2. Donates a minimum of eight hours; and 3. Retains a combined leave balance of at least eighty hours. Leave shall be donated in the same manner in which it would otherwise be used except that compensatory time is not eligible for donation. C. The leave donation program shall be administered on a pay period by pay period basis. Employees using donated leave shall be considered in active pay status and shall accrue leave and be entitled to any benefits to which they would otherwise be entitled. Leave accrued by an employee while using donated leave shall be used, if necessary, in the following pay period before additional donated leave may be received. Donated leave shall not count toward the probationary period of an employee who receives donated leave during his or her probationary period. Donated leave shall be considered sick leave, but shall never be converted into a cash benefit. D. Employees who wish to donate leave shall certify: 1. The name of the employee for whom the donated leave is intended; 2. The type of leave and number of hours to be donated; 3. That the employee will have a minimum combined leave balance of at least eighty hours; and 4. That the leave is donated voluntarily and the employee understands that the donated leave will not be returned. E. Appointing authorities shall ensure that no employees are forced to donate leave. Appointing authorities shall respect an employee's right to privacy, however appointing authorities may, with the permission of the employee who is in need of leave or a member of the employee's immediate family, inform employees of their co-worker's critical need for leave. Appointing authorities shall not directly solicit leave donations from employees. The donation of leave shall occur on a strictly voluntary basis.

  • Orientation Program The Company will allow a designated representative of the Local or Bargaining Unit up to one (1) hour per calendar month for the purpose of conducting the Communications, Energy and Paperworkers Union New Members’ Orientation Program. Such meetings will be conducted during the probationary period of employees, and will be held on Company premises. Employees participating in Orientation Program meetings during their normally scheduled working hours will not suffer loss of pay at their regular rate. Orientation Program meetings will be scheduled by Management and a Management representative may attend as an observer.

  • Leave Donation An employee may donate vacation leave, sick leave, or personal holiday to another employee for purposes of the leave sharing program under the following conditions: A. The College approves the employee’s request to donate a specified amount of vacation leave to an employee authorized to receive shared leave; and 1. The full-time employee’s request to donate leave will not cause their vacation leave balance to fall below eighty (80) hours. For part-time employees, requirements for vacation leave balances will be prorated; and 2. Employees may not donate excess vacation leave that they would not be able to take due to an approaching anniversary date; except when the request for vacation leave was denied and the vacation leave was deferred. B. The College approves the employee’s request to donate a specified amount of sick leave to an employee authorized to receive shared leave. The employee’s request to donate leave will not cause their sick leave balance to fall below one hundred seventy-six (176) hours after the transfer. C. The College approves the employee’s request to donate all or part of their personal holiday to an employee authorized to receive shared leave. 1. That portion of a personal holiday that is accrued, donated as shared leave, and then returned during the same calendar year to the donating employee, may be taken by the donating employee in full day increments. 2. An employee will be allowed to split the personal holiday only when donating a portion of the personal holiday to the shared leave program. D. No employee may be intimidated, threatened, coerced, or financially induced into donating leave for purposes of this program.

  • Family Medical Leave or Critical Illness Leave a) Family Medical Leave or Critical Illness leaves granted to a permanent teacher, long-term occasional teacher or teacher hired into a term position under this Article shall be in accordance with the provisions of the Employment Standards Act, as amended. b) The teacher will provide to the employer such evidence as necessary to prove entitlement under the Employment Standards Act. c) A teacher contemplating taking such leave(s) shall notify the employer of the intended date the leave is to begin and the anticipated date of return to active employment. d) Seniority and experience continue to accrue during such leave(s). e) Where a teacher is on such leave(s), the Employer shall continue to pay its share of the benefit premiums, where applicable. To maintain participation and coverage under the Collective Agreement, the teacher must agree to provide for payment for the teacher’s share of the benefit premiums, where applicable. f) In order to receive pay for such leaves, a teacher must access Employment Insurance and the Supplemental Employment Benefit (SEB) in accordance with g) to j), if allowable by legislation. An employee who is eligible for E.I. is not entitled to benefits under a school board’s sick leave and short term disability plan. g) The Employer shall provide for permanent teachers, long-term occasional teachers and teachers hired into a term position who access such Leaves, a SEB plan to top up their E.I.

  • Sick Leave Donation 10.3.1 A worker may donate days of sick leave to individual District workers who, due to a serious health condition, have exhausted all accumulated sick leave. Donating workers must retain a sixty (60) day balance of sick leave after their donation. No worker may receive more than 40 days of donated leave per year. 10.3.1.1 A “serious health condition” is defined as an illness, injury, impairment or physical or mental condition which involves inpatient care in a hospital, hospice, or residential health care facility, or continuing treatment or continuing supervision by a health care provider as defined in 29 USC 825.114(a) and as certified by a worker’s physician or other qualified medical practitioner. 10.3.1.2 The Vice Chancellor of Human Resources and the Chief Stewards by mutual agreement will verify the certification for eligibility. If the certification from the worker’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District expense. The District may require additional medical opinions. 10.3.2 Donated leave must be in one-day increments (no less than 8 hours). Recipients of donated sick leave shall be solely responsible for any state and federal taxes on the donated time. Such taxes shall be withheld at the normal rate for the recipient worker. In the event that the state or federal governments rule that tax liability is due other than as taxed, the recipient shall be solely liable for such liabilities. 10.3.2.1 The donated sick leave may be used only when the worker has exhausted accumulated sick leave and either is not eligible for long- term disability or is eligible but has not begun to receive the long-term coverage. 10.3.2.2 The Vice Chancellor of Human Resources shall be notified of solicitation of donations. Solicitations of donations may be made by the individual or his/her representative(s). 10.3.2.3 Donation of sick leave shall be authorized by a signed pledge form prepared by and filed with the District Office of Human Resources. In the event several workers donate sick leave, the sick leave shall be used in the order in which the signed pledge forms are filed with Human Resources. 10.3.2.4 If the worker does not use all donated sick leave, the sick leave shall be returned to the donating worker(s).

  • Employee Assistance Program (EAP) Section 1. The Employer agrees to provide to the Union the statistical and program evaluation information provided to management concerning Employee Assistance Program(s). Section 2. No information gathered by an Employee Assistance Program may be used to discipline an employee. Section 3. Employees shall be entitled to use accrued sick leave for participation in an Employee Assistance Program. Section 4. Each university will offer training to local Union Stewards on the Employee Assistance Program available in their university, on university time, where an Employee Assistance Program is available.

  • Dependent Care Assistance Program The County offers the option of enrolling in a Dependent Care Assistance Program (DCAP) designed to qualify for tax savings under Section 129 of the Internal Revenue Code, but such savings are not guaranteed. The program allows employees to set aside up to five thousand dollars ($5,000) of annual salary (before taxes) per calendar year to pay for eligible dependent care (child and elder care) expenses. Any unused balance is forfeited and cannot be recovered by the employee.
