Sick Leave Donation Program. A Labor Management Committee will be established for the purpose of proposing rules and procedures for a new, program. The LMC will be to develop consistent, transparent and equitable proposals for processes across all departments within the City. The LMC shall also explore proposals to lower the minimum leave bank required to donate sick leave and permit donation of sick leave upon separation from the City. The LMC must consult with the Office of Civil Rights to ensure compliance with the City’s Race and Social Justice Initiative. Once the LMC has developed its list of proposals, the City and Coalition of City Unions agrees to reopen each contract on this subject.
Sick Leave Donation Program. This program has been established to help those operators who are in need because their own serious health condition or the serious health condition of their immediate family member as defined under the Family Medical Leave Act, and who have exhausted all other paid leave including sick leave, personal leave, and vacation time, and compensatory time. This program does not supersede or replace any other retirement or disability program. When the Personnel Office is made aware of the need for sick leave donations, a notice will be sent to all eligible participating operators requesting their help. Any eligible operator may then voluntarily elect to contribute, permanently, sick leave credits for a Sick Leave Catastrophic Incident. For donations the following criteria will apply:
A. Only regular, full-time, non-probationary, eligible operators are able to donate sick leave credits or to be a recipient of a donation. The operator must have at least forty (40) sick leave credits three hundred and twenty (320) hours accumulated at the time of donation.
B. A sick leave credit will be defined as eight (8) hours and will not have an hourly rate attached
C. An operator may contribute only five (5) sick leave credits forty (40) hours per year.
D. A sick leave credit donation is permanent and therefore cannot be returned to the donor or converted to cash by the donee’s estate.
E. The sick leave credits will be used in place of the operator's regularly scheduled workdays to the extent they are necessary.
F. A donated sick leave credit will not count as a separate absence for the donating operator.
G. Donated sick leave credits can be used to cover retroactive unpaid regularly scheduled workdays.
H. An operator will not accrue vacation or sick leave while receiving donated sick leave.
I. An operator may receive up to 480 hours of donated sick leave during a rolling twelve month period measured backward until donations are not available.
J. An operator's illness or disability must be certified by a physician.
K. When an operator is about to exhaust their accumulated sick leave, a request for donated sick leave may be made in writing to the Human Resources Director. The physician's certification must be attached to the request. The City will determine eligibility for donations and that determination will be final. Sick Leave Donation Program. Subject to mutual agreement between OAPSE Subject to mutual agreement between OAPSE Local 549 and the St. Xxxxxxxxxxx Education Association as to Local 549 representation on the Sick Leave Donation Committee, members of the Bargaining Unit may participate in the Sick Leave Donation Program established for employees of the district through the Master Agreement between the Board of Education and the St. Xxxxxxxxxxx Education Association, as follows:
A. The St. Xxxxxxxxxxx-Richland School District Board of Education and the St. Xxxxxxxxxxx Education Association shall establish a Sick Leave Donation Program. The Sick Leave Donation Program shall remain in effect for the duration of this Agreement and shall be governed by the following procedures.
(1.) To qualify for the Sick Leave Donation Program, an employee must be absent due to the employee or a member of the employee's immediate family having experienced a personal catastrophic or chronic illness or injury. The employee must have depleted his/her accumulated leave(s) and used possible advances of sick leave days under this Agreement, and additional days are still needed. The term "catastrophic illness or injury" shall include only those illnesses or injuries that are calamitous in nature constituting a great misfortune or are chronic or long term.
(2.) Requests for use of the Sick Leave Donation Program will be considered on a case by case basis by the Sick Leave Donation Committee, which will consist of five (5) St. Xxxxxxxxxxx Education Association members; two (2) OAPSE Local 549 members; and two (2) Administrative members. The Sick Leave Donation Committee shall develop a FAQ sheet to explain the Sick Leave Donation Program and will make a determination on the following criteria:
(a.) The employee must have experienced a personal catastrophic or chronic illness or injury or a member of the employee's immediate family must have experienced a catastrophic or chronic illness or injury as defined in this section that has exhausted or will exhaust the employee's sick leave. If so the Committee will send out a notice to all employees notifying them of the need for donated days. Immediate family for this policy will be defined as: spouse, domestic partner, mother, father, children, brother, sister, mother-in-law, father-in-law, grandchildren, and other persons who stand in the place of the above enumerated individuals.

Sick Leave Donation Program. SECTION 1. The intent of the Sick Leave Donation Program is to allow bargaining unit Employees to voluntarily provide assistance to co-workers in the bargaining unit who are in critical need of medical leave due to an extended injury or illness.
SECTION 2. A bargaining unit Employee may receive donated sick leave, provided that the donee Employee has:
a) a serious medical condition as defined under the Family Medical Leave Act (FMLA) that would require the Employee to be away from work for more than ten (10) consecutive working days. Employees with intermittent absences (less than ten (10) consecutive days) do not qualify for leave donation;
b) exhausted all accrued leave, including sick time, vacation time, compensatory time, and workers compensation benefits;
c) submitted documentation from a physician verifying the medical condition and duration;
d) submitted a fully-executed FMLA Dept. of Labor Form WH-380;
e) given permission to inform the Employee’s fellow bargaining unit members of the need for donated leave. The maximum amount of donated leave that a donee Employee may receive is two hundred forty (240) hours.
SECTION 3. A bargaining unit member may donate sick leave, provided that the donor Employee:
a) voluntarily elects to donate the leave and does so with the understanding that the donated leave time will not be returned;
b) donates a minimum of one (1) hour and does not exceed thirty- two (32) hours per calendar year. Donations must be in full hour increments;
c) retains a minimum of forty (40) hours of accrued sick leave at the time of donation;
d) completes a leave donation form identifying the recipient Employee, the number of hours being donated and certifying that the leave donated is voluntary. The Employer will not solicit leave donations from Employees; the Union and/or bargaining unit members will be responsible for solicitation of donations and completion of the necessary documentation. The donation of sick leave time will occur strictly on a voluntary basis. No Employee can be forced or coerced to donate. Any Employee who feels they are being pressured to donate should contact the Department of Human Resources.
Sick Leave Donation Program a. Purpose This program provides an opportunity for teachers to donate days to other teachers in certain situations where a teacher has experienced a catastrophic illness or catastrophic injury with special, extenuating circumstances that results in not being eligible for or exhausting all other benefits. It is the responsibility of the District, in consultation with the Human Resources Department, to ensure that the requirements of the program are followed.
Sick Leave Donation Program. The Sick Leave Donation Program is created 38 pursuant to Education Code, Section 44043.5. The purpose of the Sick Leave Donation 39 Program is to provide assistance to bargaining unit members suffering from a catastrophic 40 physical illness or injury. This Sick Leave Donation Program provides employees with an 41 opportunity to be restored to health so they may return to work. Additional information, 42 including the forms, may be found in Appendix C of this Agreement. 43
Sick Leave Donation Program. 12.1 Faculty may donate sick leave to faculty members or to members of the Leadership Team who, due to a serious health condition, have exhausted all accumulated sick leave.
12.2 Donors may not donate more than three days of sick leave in any academic year. A donor shall retain a minimum of forty (40) days of accumulated sick leave after his/her donation. No employee may receive more than thirty (30) days of donated sick leave during a twelve-month period.
12.3 A “serious health condition” is defined as an illness, injury, impairment, or other physical or mental condition involved in patient care in a hospital, hospice, or residential health care facility, or continued treatment or continuing supervision by a healthcare provider as defined in 29 USC 825.114(a) and a certified by the employee’s physician or other qualified practitioner.
12.4 The Vice-Chancellor of Human Resources will verify the certification of eligibility. If the certification from the employee’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District’s expense. The District may require additional medical opinions.

Sick Leave Donation Program. When an employee has experienced a “catastrophic event” that causes him/her to take leave from work for extended periods of time that exceed his/her accumulated sick leave balance, s/he may be considered for the Sick Leave Donation Program. A “catastrophic event” is defined as a severe illness or incapacitating injury that is expected to incapacitate the employee for an extended period of time (in excess of at least five (5) days) and would require the employee to take extended, undetermined time off from work which creates a financial hardship for the employee in that s/he has exhausted all full salary sick leave and other paid time off.
Sick Leave Donation Program. 5 The District and the Teachers Association of Long Beach agree to the implementation of the 6 following Sick Leave Donation Program. This program shall be available to all members of the 7 bargaining unit. The District and the Association further agree to review and evaluate the 8 effectiveness of this plan after a full year has elapsed following the ratification of this contract by 9 both the Association and the Board of Education. The purpose of the Sick Leave Donation Program 10 is to provide assistance to bargaining unit members suffering from a catastrophic physical illness or 11 injury.
