Acting Captain. All qualified personnel shall be considered to work out of class (Acting Captain) when the need arises. Members shall meet the below criteria to be considered to act out of class and the department shall follow the rules below when filling out of class assignments. Qualified personnel are defined as:
Acting Captain. All full-time unit employees designated as Acting Captain will receive an additional five percent (5%) of base pay for each hour worked while acting in this capacity. The Parties agree that to the extent permitted by law, acting pay is special compensation for Classic members only and shall be reported as such pursuant to Title 2 CCR, Section 571(a)(3).
Acting Captain. Detectives and Sergeants on the Captain Promotion Eligibility List shall be given an opportunity to serve as an Acting Captain, at the per diem base pay of a Captain, to fill temporary vacancies in the following manner: Each vacancy in the Department known to be temporary at the time it occurs will be filled by the individual highest on the Captain’s Eligibility List for that station and shift, or unit and shift. If there is no one available in the station and shift, or unit and shift, who is on the Captain’s Eligibility List, then the Department Seniority List from that station and shift, or unit and shift, will be used. If no one on the Department Seniority List from that station and shift, or unit and shift, volunteers, then the Senior Sergeant or Detective from that station and shift, or unit and shift shall be used to fill the vacancy. For the Bureau of Operations the acting Assistant Division Commander will come from Shift 1 and the acting Division Executive Officer will come from Shift 3. Per Diem Pay shall commence on the first day of such service following the Captain’s regular days off.
Acting Captain. The Fire Chief will establish a list of eligible employees that may serve as the acting Captain. The Acting Captain list will be comprised of those employees who are on the Captain promotional hire eligibility list or completed an Acting Captain’s Taskbook. All acting Captains will receive Department-designated training and education that is designed to assure the employee is capable of leading the City’s fire forces in both emergency and non-emergency settings. Acting Captains will be used at the discretion of the Fire Chief or his designee. Acting Captains will be assigned only after all regular Captains have been provided the opportunity to work the shift in which Captain Xxxxxxxx is needed, as determined by the Fire Chief. Acting Captain will not be assigned involuntarily to work during periods they are not otherwise scheduled to work.
Acting Captain. Effective July 1, 2006, 2.8 hours of regular firefighter's wages will be given for each full work shift worked out of grade. Payments will be prorated if a shift is split between employees. Effective October 1, 2017, firefighters assigned to work out of grade as a Captain will be paid an additional 18% of the firefighter’s base rate as shown on the salary schedule for actual hours assigned and worked out of grade. Fire Apparatus Operators assigned to work out of grade as a Captain will be paid an additional 14% of the Fire Apparatus Operator’s base rate as shown on the salary schedule for actual hours assigned and worked out of grade. Assignments shall be made first from the current captain's eligibility list from personnel on duty, then as assigned by the Fire Chief or his/her designee.

1. A member ranked on a certified promotional exam list for fire Captain; or
2. A member who has achieved all of the following: ● A minimum of two years of time in grade with CWFD. Certified as a Blue Card incident commander. Members must stay current on all Blue Card CE once certified. ● Successful completion of the AC task book, for acting captain Members who Act out of Class prior to the signing of this document will be afforded the opportunity by the department to obtain Blue Card Incident Command Certification. Those members already qualified to act out of class at the signing of this MOU will be given one year to meet the new standard. Testing: ● Administrative Battalion Chief or Training Captain along with that member’s shift Battalion Chief will be responsible for proctoring the tactical simulation. ● If the member does not pass the tactical simulation, the member will be allowed to retest no sooner than 2 months from their last attempt. ● The member will complete the tactical simulation annually by the anniversary date of their last assessment. Making out of class assignments for Acting Captain (AC): Assignments will be made using a rotational system in the following order: • Qualified member assigned to the shift and station where the vacancy occurred who is on a certified promotional list will fill the vacancy. If multiple members qualify as above, then the position will be filled using the rotational system. • Qualified AC member assigned to the shift and station where the vacancy occurred. If multiple members qualify as above, then the position will be filled using the rotational system: • If no members qualify at the station where the vacancy occurs, the rotation will apply to the entire shift, thus causing a station move. This rotation will occur in this order:
A. Members on Captain promotional list
B. Members on AC list on a rotational basis If no members who qualify are on the entire shift, then the vacancy will be filled with OT callback, by calling back in this order:
A. Ranked Captains on a rotational basis.
B. Members on the Captain promotional list on a rotational basis

Acting Captain. Candidates for the Acting Captain’s position shall have a minimum of 3-1/2 years in fire suppression and be qualified as an Acting Engineer. The purpose of the Acting Captain’s position is to assume the role of Captain and provide the leadership that is required to carry out the goals and objectives of the organization and to provide for professional development. Qualification as Acting Captain may be approved upon completing the Acting Captain’s check-off list, recommendation of Battalion Chief and by successfully completing a review board consisting of the Chief Training Officer, Shift Battalion Chief and Shift Training Captain. All check-off items shall be signed by a Company Officer or Battalion Chief.
Acting Captain. Whenever any Firefighter/Paramedic or Engineer who is on an established eligibility list for the position of Fire Captain works as an Acting Captain, they shall receive five percent (5%) in addition to their regular pay at the time such work is performed. Whenever any Firefighter/Paramedic or Engineer who is not on such eligibility list works any one shift as an Acting Captain, they shall receive three percent (3%) in addition to their regular pay at the time such work is performed.

The purpose of the Acting Captain's position is to assume the role of Captain and provide the leadership that is required to carry out the goals and objectives of the organization and to provide for professional development. Qualification as Acting Captain may be approved upon completing the Acting Captain's check-off list, recommendation of Battalion Chief and by successfully completing a review board consisting of the Chief Training Officer, Shift Battalion Chief and Shift Training Captain. All check-off items shall be signed by a Company Officer or Battalion Chief. Qualifying as Acting Captain: Candidate shall obtain a copy of the Acting Captain's check-off list and reference guide from their Company Officer. Candidate shall forward the completed list to their Shift Battalion Chief. The Battalion Chief shall then make a recommendation to the Chief Training Officer to convene the review board. If a candidate is not recommended, the Battalion Chief will advise them of such in writing within five days. Notification will include reasons why candidate was not recommended. Upon successful completion of the review board, the Chief Training Officer will recommend to the Fire Chief that the candidate's name be added to the list of Acting Captains. A copy of the completed check-off list and evaluation notes will be placed in the candidate's personnel file. Upon approval of the Fire Chief, the candidate's name may be placed on the qualified Acting Captains list. A Captain shall be present on the apparatus when candidates are responding to emergency calls as part of their qualification process. Items on the check-off list shall be signed off by a Company Officer or Battalion Chief only.
