ARTICLE II - MANAGEMENT RIGHTS. It is recognized by all parties hereto, the Board, on its own behalf of the electors of the district, hereby retains and reserves unto itself all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and Constitution of the State of Michigan and of the United States. It is further recognized the exercise of said powers, rights, authority, duties and responsibilities by the Board, the adoption of policies, rules, regulations and practices and furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement, and then only to the extent such specific and express terms hereof are in conformance with the Constitution and laws of the State of Michigan and the Constitution and the laws of the United States. ARTICLE II - MANAGEMENT RIGHTS. 24 The Association recognizes the Board of Directors as the elected representative of the citizens 25 of Wenatchee School District and that the Board in acting in behalf of the citizens of the 26 District, retains and reserves all powers, rights, authority, duties and responsibilities conferred 27 upon and vested in it by the regulations of the State Board of Education, the Statutes and 28 Constitution of the State of Washington and/or of the United States, and any other law, rule 29 and/or regulation. 30 Neither this Agreement nor the act of negotiating shall be construed to be a delegation to 31 others of the policy making authority of the Board, which authority the Board specifically 32 reserves unto itself. The management of the District and the direction of the work force is 1 vested exclusively in the Employer subject to the terms of this Agreement. ARTICLE II - MANAGEMENT RIGHTS a. The Town of Xxxxxx and the Union agree that the provisions of this agreement shall be expressly limited to hours, wages, and working conditions of the employees who are covered by this agreement, and no provisions shall be construed to restrict the Town from the management of its Police Department. The Town retains the full right to manage its Police Department services, and may exercise without bargaining with the Union, all the powers, authority and prerogatives of municipal management or government including, but not limited to, the right: to determine the force and composition of the working force; to determine the quantity and type of equipment used; to determine the work complement of such equipment; to demote, suspend, discipline or discharge employees, and in the case of permanent employees, subject to just cause; to hire; to layoff; to assign, change and/or reassign from time to time officers to shifts subject to Articles VI and VII and applicable law; to transfer; to determine the qualifications and requirements required for the promotion of any employee; to schedule the working force; to promulgate, amend and enforce rules, regulations, standards of conduct, operating and administrative procedures from time to time as the Town deems necessary to implement and carry out the Town’s rights under this contract; provided, however, unless there is an emergency, the Chief shall notify the Union of his intention to implement a new rule or change an existing rule, and the Chief will discuss same with the Union prior to issuing the new or changed rule. to evaluate officers, which evaluation right shall include establishment of the evaluation instrument, the frequency of the evaluations, the conducting of verbal and written evaluations of officers. ARTICLE II - MANAGEMENT RIGHTS. It is understood and agreed that the Employer possess the sole and exclusive right to conduct the business of the Borough, and, except as modified by this Agreement, to manage and direct the affairs of the Police Department, and to fulfill its lawful obligation.
ARTICLE II - MANAGEMENT RIGHTS. The Employer retains full and exclusive authority for the management of its operations to the extent it had such authority, whether exercised or not, prior to acquiring a duty to recognize and bargain with the Union, subject only to the extent such authority may be limited by the specific provisions expressed in this Agreement. All decisions on such rights and authority, to the extent not so limited by the specific provisions expressed in this Agreement, are reserved solely and exclusively to the Employer's jurisdiction and discretion. As examples of such authority, but not limited thereto, the Employer shall have the sole right and power to manage its work force; to select and determine the number and qualification of its employees; to direct, schedule and assign its employees; to hire, promote, transfer, layoff, discipline and discharge its employees; to establish, change, discontinue or enforce work rules and policies; and to modify or discontinue services or operations performed by the Employer.
ARTICLE II - MANAGEMENT RIGHTS. The Employer has and shall continue to have full and complete control over matters relating to the management and conduct of its business. The parties hereto recognize and agree that all of the rights of the Employer which are not expressly ceded, abridged or modified by the terms of this Agreement or by law are reserved to and retained exclusively by the Employer.
ARTICLE II - MANAGEMENT RIGHTS. The Management of the Walpole Fire Department and the direction of the working force shall rest solely with the Employer, but shall not be inconsistent in any way with the provisions of this Agreement. The Employer shall be in charge of all administrative phases and functions of the Department and in this connection may determine the methods and processes of work to be performed; the schedule of shifts and hours of work; to select, hire and demote employees; right to make and apply rules and regulations of discipline, efficiency and safety; right and responsibility to discharge or discipline any employee for just cause; to promote; to layoff because of lack of work.
