COURT AND JURY DUTY. 1. It shall be the policy of the State to encourage employees to recognize and perform their civic responsibilities.
2. A classified employee summoned for court or jury duty shall be excused from work for the time necessary to perform such duty when he or she furnishes timely notice of subpoena or summons to his or her supervisor. Attendance at court in connection with an employee’s official duties shall not be considered absence from work.
3. The State expects its employees to serve when summoned for jury duty and will not request that an employee be excused from serving except in unusual circumstances which jeopardize service to the public.
4. A classified employee who is unable to perform his or her job because of court or jury duty shall be entitled to receive total wages not to exceed his or her normal base salary prorated for the day, days, or part of a day involved by combining jury duty pay or witness fee and state wage.
5. An employee who requests accrued annual leave or compensatory time off to appear as defendant or party-plaintiff in civil or criminal actions shall be granted such time off, including an employee who has been suspended without pay, except in the instance where the court appearance is related to the matter for which he or she was suspended.
6. An employee may use annual leave, personal leave or compensatory time off for his/her absence due to court or jury duty, in which case he or she shall then be entitled to keep the court or jury duty pay received. Notwithstanding the above, employees are advised that State law prohibits the payment of witness fees or other compensation to State employees when the State is a party to the case (plaintiff or defendant).
7. It is the obligation of the employee to notify his or her supervisor as soon as he or she is called for court or jury duty.
8. An employee shall not be obligated to pay back mileage reimbursement received as part of court or jury duty pay.

If the employee receives his/her State wages, he/she shall decline the per diem compensation from the court, except that employee may retain mileage and meal reimbursement from the court.

7. Notwithstanding the above, employees are advised that State law prohibits the payment of witness fees or other compensation to Department employees when the Department is a party to the case (plaintiff or defendant).

COURT AND JURY DUTY. Leave of Absence shall be provided to an Employee who is required to serve as a juror, or is subpoenaed as a witness in any court proceeding. The Employee shall receive their regular rate of pay and shall remit to the Employer any allowance they may receive for such duty or service. The Employee shall present proof of such duty or service and the amount of remuneration or allowance received.
COURT AND JURY DUTY. Full-time and part-time bargaining unit members of Central Oregon Community College shall not have deductions made from their wage for required appearances in court or hearings resulting from a call to jury duty, subpoena, or a request to appear to testify where the staff member is not personally involved in the action as a plaintiff, the defendant, or the object of the investigation. The employee shall provide their immediate supervisor with a copy of any notice to appear in court upon receipt of such notice. Any remuneration received for such appearances held on a workday, less travel costs, will be endorsed to the College. Any employed full-time and part-time bargaining unit members excused from appearing in court before the end of their regular College workday shall report back to their supervisor to coordinate the remainder of their shift.

COURT AND JURY DUTY. It is the policy of the Judicial Branch to encourage employees to recognize and perform civic responsibilities. An employee summoned as a witness in court or selected for jury duty shall be excused from work to perform that duty when the employee furnishes to the supervisor timely notice of subpoena or summons. It is the obligation of the employee to notify the supervisor as soon as the employee is notified of the appearance date.
(a) Job Related Court Appearances Attendance at court in connection with an employee's official duties or where the state is a party to the case, shall not be considered absent from work. When an employee appears in court as a witness in connection with official duties, the employee shall be entitled to reimbursement of travel expenses in the same manner as the employee is reimbursed during the normal course of employment. The employee shall not be entitled to witness fees or witness travel expense reimbursement.
COURT AND JURY DUTY. 14.6.1 An employee called for jury duty or as a witness in a case in which the employee is not personally involved, shall be paid the regular salary for each of the days the employee was previously scheduled to work, provided that all monies received as jury duty pay or witness fees are turned over to the College. Employees shall return to work immediately when less than a normal work day is required by such duty.

An employee who is summoned to serve as a juror or is required by writ of subpoena to appear in court as a witness will be paid his regular hourly rate of pay for time required to be in court, provided the employee presents the employer with the process which required his presence in court, and pays over to the employer the amount received by serving as such juror or witness. Employees held for the Company's investigation and no responsibility being attached to them in connection with the matter under investigation or Company business, on the order of Management, will, if required to lose time by reason thereof, be paid for the time lost. If no time is lost, they will be paid for actual time held at their basic rate, plus expenses agreed upon by Management and the Local Chairperson. When employees are called on their weekly days off, they will be paid for the actual time held. When mutually agreed between the proper officer of the Company and the Accredited Representative and/or Local Chairperson, an employee who has become unfit to follow his usual occupation may be placed in a position covered by this Agreement which he is qualified to fill, notwithstanding that it may be necessary to displace an able-bodied employee to provide suitable employment for him. An employee placed in another seniority section will accumulate seniority such section only from the date he starts work herein. In dealing with incapacitated employees, seniority (so determined by service under this Agreement) shall govern in respect of preference of shift and employment. An employee placed in a position under the provisions of this Article shall not be displaced by an able-bodied employee, so long as he remains in such position. Should he subsequently recuperate, he shall be subject to rules of this Article prior to an appointment being made. The Company shall furnish in writing the Accredited Representative and/or Local Chairperson with full particulars of each case subject to rules of this Article prior to an appointment being made. employees, within thirty (30) days from the date of their employment, their service cards and letters of An employee dismissed or leaving the service with due notice shall, upon request, be given a Record of Employment and will be paid as soon as possible.
