Employment Levels. If the year-end monthly average number of employees occupying the positions of employment set forth in Appendix A remains below 80% of the "Base Employment" level set forth in Appendix A, for two consecutive years (the "Employment Measuring Period"), the Contract Demand may be reduced by the Authority subject to Paragraph C of this Article. The maximum amount of reduction will be determined by multiplying the Contract Demand by the quantity one minus the quotient of the average monthly employment during the Employment Measuring Period divided by the Base Employment; provided, however, that a reduction in employment will be deemed not to have taken place if such reduction occurs, as demonstrated to the reasonable satisfaction of the Authority, as a consequence of (a) reduced employment during any strike; (b) increased efficiency or improved technology; or (c) negotiated changes in labor agreements or work rules which increase worker productivity or (d) withdrawals by the Authority of other Authority power sold to the Customer but provided further, that relocation of specific activities away from the facility shall not be considered as productivity improvements. Any such reduction shall be rounded to the nearest one-hundred kilowatts. In the event of a reduction of the Contract Demand to zero, this Agreement shall automatically terminate. Coincident with the filing of the annual report with the Authority pursuant to Paragraph I.B of this Schedule or prior thereto within the same calendar year, the Customer may request that the Authority adjust the Base Employment shown on Appendix A on account of the factors set forth in (b), (c) and (d) of the preceding paragraph. Within sixty (60) days of receiving such a request, together with adequate supporting information, the Authority will advise the Customer in writing as to whether or not the Base Employment will be reduced. If the Authority does not grant or deny any such request in writing within the 60 day period, the request shall be deemed to be granted.

Employment Levels. Unless otherwise mutually agreed between the parties, shift employment levels will remain as follows: Ammonia Operations In the Ammonia operating area there are six (6) technicians per team on a five panel roster to fulfil the following shift operating levels: 1 Co-ordinator (any level) 1 Control Room technician 3 outside operators (with sufficient skills to cover all outside areas) During the life of this agreement the parties agree to work together to progress towards removing one full time shift position in the Ammonia Area by technological improvements.

Employment Levels. The Company has the exclusive right to establish the number of full-time and part-time employees in any department, to the extent that it does not violate any section of this agreement. It is in the interest of the Company to maintain maximum full-time employment levels as long as practicable. To that extent, the Company will not fall below sixty-six (66) twenty-two (22) full-time operators unless as a result of service cuts or contracting certain parts of the operation. Before such cuts occur, the Company will meet with the Union representatives to examine other means of achieving the same savings.

Employment Levels. 5.1.1 The following classification structure will apply to work performed under this Agreement. 5.1.2 Appropriate level of training, for the purposes of this classification structure, means that the Employee has: (a) Has completed an appropriate training program that meets the training and assessment requirements of a qualification or one or more appropriate units of competency forming part of a training package; or (b) Has been assessed by a qualified skills assessor as having skills at least equivalent to those attained in an appropriate training program; or (c) As at 30 June 2010, had been doing the work of a particular classification for a period of at least 3 months.

Employment Levels. The number of Employees on active status, the number of Employees on temporary layoff status, and the number of Employees on permanent layoff status as of the beginning of the preceding month.

Employment Levels. 46.1 Port Authority determines the organisational structure and employment levels based on its business needs from time to time. Where this determination reduces the overall Employee numbers, consultation will occur with the affected Employees. 46.2 For the term of this Agreement, Employee reductions will be through natural attrition, redeployment, poor performance, voluntary redundancy, or retirement. 46.3 Any Employee whose position changes substantially or is not required during the term of this Agreement, may be transferred to other positions within Port Authority, or offered voluntary redundancy in accordance with the provisions of this Agreement. 46.4 This undertaking will not have any effect on the process of performance of disciplinary matters, which are pursued separately.

However, the Superintendent may assign officers to insure that at least 33% of the officers assigned on a shift have at least two years of experience in grade.
