FACULTY RIGHTS. 4.1 Within the limits of availability of space, members of the bargaining unit shall be provided with a private office or other appropriate workspace. 4.2 Taking into account the needs of their departments and the students they serve, work assignments of bargaining unit members will be consistent with their academic status and interests. 4.3 Members of the bargaining unit shall be promptly informed of any official judgments of their performance. 4.4 No decision or action affecting a bargaining unit member’s employment, promotion, tenure or compensation may be made in an arbitrary or capricious manner. Administrative decisions having a significant effect on the terms and conditions of employment of individual bargaining unit members shall be consistently applied to the extent that similarly situated individuals in equivalent circumstances will be treated in a comparable manner. 4.5 The University and the bargaining unit members will make every effort to maintain a professional academic environment that is free of intimidation and harassment of members of the University community. In the case of sexual or other discriminatory harassment, the requirements of federal or New Hampshire state law shall be the only determinants of the proper definition and extent of the term “harassment.” 4.6 Bargaining unit members shall not be subject to dismissal and/or disciplinary action except for just cause. If an appeal against dismissal and/or disciplinary action is taken to final and binding arbitration, the burden of proof of just cause shall be on the University. 4.7 Except as otherwise provided, in the adjudication of any dispute over an alleged violation, misinterpretation or misapplication of the provisions of this Article, the burden of proof will rest with the Grievant. 4.8 Bargaining unit members have access to appropriate University supplies and property for the express purpose of conducting University business.

FACULTY RIGHTS. Individual members have the right of consultation with the immediate supervisor on matters relating to the members' teaching assignment, instructional program changes, analysis and/or evaluation of instructional programs, and the educational direction of their department and institution.
FACULTY RIGHTS. Unit Members shall have the following rights, in addition to any rights as provided in other articles of this Agreement.
FACULTY RIGHTS. A. Duly authorized representatives of the Association shall be permitted to transact official Association business on school property, provided that such business does not interfere with the instructional program of the school. The second Tuesday of each month, outside of regular school hours, will be reserved for Association meetings. The administration will not schedule meetings that require the attendance of bargaining unit members that may be involved in Association meetings on the second Tuesday of the month. B. Upon the approval of the building administrator, bargaining unit members will have the right to use school facilities and equipment on school grounds at times when such equipment is not in use for regular operation, provided the Association has trained operators. The Association shall pay for the cost of all materials, supplies and other costs incidental to such use. C. Upon request, the Board will furnish to the Association, a copy of all available public information related to the financial resources of the District, Board meetings, faculty addresses, and such information as will assist the Association in developing programs on behalf of bargaining unit members, together with reasonable information which may be necessary for the Association to process a grievance. D. Bargaining unit members shall be involved in the initial planning for educational specifications for building and for annual budget requests. The Board also recognizes the contributions to be made by bargaining unit members in the development of plans having a direct bearing upon the educational program of their classes or schools. E. Recognizing good teaching as the hallmark of the professional teacher, the Board looks to the faculty as professionals, trained in the preparation and development of educational programs. The Board and the Association consider excellence as the only acceptable standard in the education of children and place confidence in the ability of the faculty to be innovative, to base its innovations upon research and the development of well-constructed programs before employing them in the classroom. It is the responsibility of the Board to provide resources for such Board-approved activities. The faculty shall subject its instruction to continuing evaluation. FACULTY RIGHTS. The Board of Regents and the Union agree that the Board and the Administration shall accord just and equitable treatment to all Faculty members in the exercise of their professional rights, privileges, and responsibilities. The two parties further agree that the Board and the Administration shall not deprive any Faculty member of their rights and privileges within the University without due process. Faculty members shall exercise these rights, privileges, and responsibilities in a professional manner as members of the University community and with due regard for the attendant rights of all others. The Board of Regents and the Union agree that the following are rights the Board and the Administration shall accord to all Faculty members: 1. Academic freedom rights, which include: a. the right to introduce controversial topics into the classroom as long as these topics are related to the subject under study; b. the right to pursue research and to publish research findings as part of one’s academic duties, and to conduct their research honestly and report their findings accurately; and c. the right to express their views (orally or in writing) on controversial matters within as well as beyond their areas of special expertise without being subject to censorship or disciplinary action by the Administration. 2. Freedom of speech and expression; 3. Freedom to communicate with members of the Board, with any member of the University Administration, with officials of the Government of Guam and the Legislature, with members of accrediting bodies, and with the media without being subject to censorship or disciplinary action by the Administration. It is understood that unless authorized to serve as such, Faculty members are not the official spokespersons for the University, and Faculty members have the duty to make it clear if and when they do not speak for the University; 4. Freedom of association; 5. Freedom from any discrimination that violates the University’s statement of nondiscrimination and affirmative action; 6. The right to privacy, safety, and security of their possessions while on University premises. Faculty members, however, are responsible for securing their personal property with due diligence. This right to security does not abridge the Administration’s right to access all offices for safety and security reasons.
FACULTY RIGHTS. A. Nothing contained herein shall be construed to deny or restrict to any faculty member rights he/she may have under the General School Laws of the State of New Jersey, or other applicable laws and regulations. The rights granted to faculty herein shall be deemed to be in addition to those provided elsewhere. B. Faculty shall be entitled to full rights of citizenship and no religious or political activities of any faculty member or the lack thereof shall be grounds for any discipline or discrimination with respect to employment of such faculty. The private and personal life of any faculty member is not within the appropriate concern or attention of the Board. C. When written charges are placed against a faculty member by the administration or a faculty member, or a faculty member is required to be in attendance at an investigatory interview, then a conference will be arranged by the administration within two (2) working days for a discussion. A faculty member is entitled to representation at such conference. D. A faculty member not scheduled for classes or other duties specified in this Agreement shall not be required to be present at the College. E. A faculty member's work load shall span no more than five (5) consecutive days. Any extension of this time shall be by mutual agreement of the faculty member concerned and the College Administration. Nothing herein precludes some faculty members from being scheduled less than five (5) days. F. Faculty shall be free to exchange teaching assignments, provided that the transferees are qualified to teach the course and subject to the sole approval of the Administration.
FACULTY RIGHTS. 12.1.1 The Board and the Guild agree to work cooperatively to promote and maintain a climate of free, impartial, and responsible inquiry and discussion.

FACULTY RIGHTS. The Employer and the Federation agree to comply with state and federal laws regarding discrimination on the basis of race, color, creed, national origin, sex, sexual orientation, political activities, affiliations, or beliefs, religion, marital status or other protected status in accordance with applicable law.
