FILLING POSITION. Subd. 1. A vacant position shall first be filled from among bidders working in the same or a higher classification as the vacancy. The position shall be offered to the qualified bidder with the greatest total seniority in the same or higher classification.

FILLING POSITION. 7.1 In the event of a job vacancy within the bargaining unit the company shall post the vacancy for a period of seven (7) calendar days. For positions posted that do not require testing, the Company will endeavour to award such positions within two (2) weeks from the date of removal of the job posting. The appropriate supervisory officer shall fill the positions on the basis of qualifications and seniority of applicants in the posted classification. The Company will be the judge of qualifications and the employee may appeal selections in accordance with the grievance procedure. Full time employees who have established seniority in the posted classification will have seniority over part time employees except when a part time employee has worked in the posted position for (3) three years or more. If two or more applicants have the same seniority, then a full time employee shall be considered more senior over a part time employee. If two or more full-time applicants have the same seniority date, then the date and time of application for employment shall govern.
FILLING POSITION. 7.1 The appropriate supervisory officer shall fill the positions on the basis of qualifications and seniority of applicants. The Company will be the judge of qualifications and the employee may appeal selections in accordance with the grievance procedure. If two or more applicants have the same seniority, then a full time employee shall be considered more senior over a part time employee. If two or more full-time applicants have the same seniority, management shall conduct a draw.
FILLING POSITION. Any vacant position posted in accordance with Section 5.291 shall be offered to a qualified employee applicant before it may be offered to a qualified non- employee applicant and, except supplemental pay positions, shall be filled by the qualified applicant with the greatest seniority.
FILLING POSITION. Out Of Classification (FPOC) As the result of departmental need and while so assigned, Xxxxxx regular employee temporarily assigned to and working in a classification with a salary range above that of the employee’s regularly assigned position as the result of special departmental need shall be paid FPOC pay while so assigned at a step within higher classification’sthe range for the higher classification, after serving eighty (80) hours in any calendar year in the higher classification. When an employee meets these requirements, the employee shall receive the higher of (a) 5% above the pay rate of his/hertheir regular classification or (b) the first step of the salary schedule for the higher classification. Under no circumstances will a rate higher than the fifth step of the higher salary schedule be paid. No position may be filled out of classification unless established departmental procedures are followed and authorization from the Department Head is obtained. Probationary employees are not eligible to fill a position out of classification. To be eligible for compensation for filling a position out of classification, the employee has to possess the minimum qualifications for the higher classification and be capable of performing those specific tasks which he/shethey will be performing during this acting time and which differentiates it from the lower classification. Before FPOC status is attained, the necessary forms shall be approved by the Department Head or designee and Human Resources DirectorDirector of Human Resources. Employees assigned to fill positions out of classification shall not acquire status or credit for service in the higher classification and may be returned to their regularly assigned position at any time. Employees receiving FPOC pay shall not receive the pay when on vacation or sick leave for two weeks or longer. The parties agree that to the extent permitted by law, the compensation for FPOC is special compensation for “classic member” employees and shall be reported as such pursuant to Title 2 CCR, Section 571(a)(3) Temporary Upgrade Pay.

  • Filling Positions ‌ The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing agency.

  • Filling Vacant Positions During the time the procedures outlined herein are in effect, position vacancies to be filled shall first be offered to regular employees who have a contractual right to be recalled to a position in the involved job classification or who may have a right to “bump” or transfer to the position, as the case may be. In such circumstances, the seniority provisions of the Agreement shall be observed. If no regular employee has a contractual right to the position, the following shall be given consideration in the order (priority) indicated below: 1st Priority: Qualified Job Bank employees 2nd Priority: Employees on a recall list 3rd Priority: Employee applicants from a list of eligibles 4th Priority: Displaced certified temporary employees 5th Priority: Non-employee applicants from a list of eligibles The qualifications of an employee in the Job Bank or on a recall list shall be reviewed to determine whether he/she meets the qualifications for a vacant position. Whether the employee can be trained for a position within a reasonable time (not to exceed three months) shall be considered when determining the qualifications of an employee. If it is determined that the employee does not meet the qualifications for a vacant position, the employee may appeal to the Director of Human Resources. If it is determined that an employee in the Job Bank is qualified for a vacant position, the employee shall be selected. The appointing authority may appeal the issue of whether the employee is qualified. The dispute shall be presented to and resolved by the Job Bank Steering Committee. If it is determined that an employee on a recall list is qualified for a vacant position, the employee will be given priority consideration and may be selected. Appeals regarding employees on a recall list and their qualifications for a position will be handled by the Civil Service Commission. The grievance procedure under the Labor Agreement shall not apply to determinations as to qualifications of the employee for a vacant position.
