SICK LEAVE, EMERGENCY LEAVE. 10.1 Each employee shall accumulate one (1) day of sick leave for each calendar month worked. A calendar month has been worked if an employee has completed eleven (11) workdays (time worked or paid leave) in the calendar month. For the purposes of this section, a workday is defined as a complete day of assigned work, either worked time or paid leave time. (For example, a driver who works an am, midday and pm route works a day only if s/he completes his/her am, midday and pm route.) 10.1.1 The District will comply with all the provisions of the Family and Medical Leave Act of 1993. Consistent with state law, an employee may also use his/her sick leave to care for: (a) his/her child with a health condition that requires treatment or supervision; or (b) his/her spouse, parent, parent-in-law, or grandparent who has a serious health condition or an emergency condition. Regular employees shall be allowed to use a maximum of five (5) days of sick leave per year when absence from work is required because of serious illness of a member of the immediate family (sibling, grandchild or a domestic partner who is documented through an Affidavit of Domestic Partnership on file in payroll) where the immediate family member is hospitalized, critically ill, expected terminally ill, or where a medical doctor certifies that the employee's presence is required. A medical note documenting the illness of a family member may be required by the District at any time. Notwithstanding the five-day limitation set forth above, an employee whose leave qualifies under FMLA shall not go into unpaid leave status until all paid leave has been used. 10.1.2 Employees may cash in unused sick leave days above an accumulation of sixty (60) days at a ratio of one full day’s monetary compensation for four (4) accumulated sick leave days. At the employees option, he or she may cash out unused sick leave days in January of the school year following any year in which more than sixty (60) days of sick leave has been accrued and each January thereafter at a rate equal to one (1) days monetary compensation of the employee for each four

SICK LEAVE, EMERGENCY LEAVE. Employees shall accumulate sick leave on the basis of one day per month pro-rated according to the daily hours worked by the employee. Unused sick leave shall accumulate from year to year. This leave is granted in cases of illness, injury or emergency of a custodial employee. Benefits will be expended on an hour for hour basis. Sick leave benefits shall be paid on the basis of base hourly rate applicable to the employee's daily work shift. Employees who are ill or injured may be required to present to the employer a doctor's certificate. This will usually not be requested until after the third consecutive workday. Regular employees shall be allowed to use a maximum of five (5) days of sick leave per year for an emergency. An emergency is defined as an unforeseen and suddenly precipitated occurrence of a serious nature beyond the control of the employee which threatens the well-being or the property of the employee. The emergency must be of such a nature that preplanning is not possible or could not relieve the necessity for the employee’s absence. In all cases, the reason for the emergency absence shall be submitted on a time sheet along with the supervisor’s approval. As an added incentive for employees not to be off the job sick, the District will allow an additional day of vacation for every six (6) consecutive months that an employee does not use their sick leave. This provision may be reopened in the event that any state agency indicates in writing that this provision is out of compliance with state or federal laws. Sick leave may be donated by employees to other employees of the District to the extent consistent with state law and District policy. Within five (5) days after expiration of accumulated sick leave, if an employee is not medically fit to perform his/her regular assignment, he/she will terminate or apply for the appropriate leave as provided for in Article XI.

SICK LEAVE, EMERGENCY LEAVE. Section 1. Sick leave shall be accumulated at the rate of five point five three eight five (5.5385) hours bi-weekly for a total of one hundred forty-four (144) hours each fiscal year. Section 2. Accrued sick leave with pay may be carried over in the next fiscal year, not to exceed one thousand and forty (1,040) hours. Any portion of sick leave may be used when an employee is unable to work because of a bona fide illness. Section 3. In the event of death in the employee's immediate family, employees shall be granted a reasonable period of time off, up to one (1) shift with pay, for a single absence. This time off is not given automatically, but is based on the individual circumstances of each case as determined by the Fire Chief. Immediate family as applied to this section consists of the following: wife, husband, child, brother, sister, parents, father-in-law, mother-in-law, grandchild, grandparents, brother-in-law, sister-in-law, xxxxxx’s grandparents, or a relative living in the same household with the employee. Section 4. In the event of serious injury, or serious contagious illness in an employee’s immediate family, the employee may be granted emergency leave. This emergency leave shall be leave with pay, but shall be charged to sick leave. When an employee has used his sick leave, the time off may be charged to vacation and compensatory time accrued. As part of this, provisions of the Family Medical Leave Act of 1993 may also be applicable. Immediate family, as applied in this section shall consist of relatives residing in the same household with the employee and/or who are listed as insured under the City of Xxxxxx Health Insurance. Section 5. A physician's release may be required before an employee is allowed to return to work at the discretion of the Fire Chief or his designated representative. Section 6. Members of the Bargaining Unit who do not use more than two (2) shifts of sick leave annually shall receive on January 1, one (1) additional shift of vacation. Additionally, each year current sick leave accrual in excess of the one thousand and forty (1040) hours shall be redeemed in the form of additional bonus compensation. Employees shall receive the bonus compensation for eighty-five (85) percent of the excess sick leave accrued over the one thousand and forty (1040) hours, not to exceed 108 hours. SICK LEAVE, EMERGENCY LEAVE. Certificated employees under contract for the school year will receive twelve (12) days annual leave for illness, injury, and emergency leave, as well as to care for the employee’s ill family members (refer to RCW 49.46.210 for “Family Member” definition). Unused days shall accumulate to 180 days or to the extent allowed by law. Less than full-time (partial year or fractional FTE) employees shall be allowed illness, injury, and emergency leave on a prorated basis. Sick leave will be granted for an absence resulting from an employee's mental or physical illness, injury, or health condition; to accommodate the employee's need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or an employee's need for preventive medical care. Xxxx leave will also be granted for the employee to provide care for a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or care for a family member who needs preventive medical care. An emergency will be defined as "any unforeseen occurrence requiring the presence of the employee including emergencies of a personal or business nature." Permission for such emergency leave shall be given by the building principal or superintendent. In the event of the superintendent's absence, permission may be submitted to a review board consisting of the building principal, two NVEA members, and two Board members. The decision of the review board will be final. When emergency/sick leave is depleted, the pay is deducted at a rate of 1/the number of the employee's contracted days and full-time equivalency (FTE) status. Physician verification for illness of more than five days is required and; absences of more than 1/2 day shall be charged as one full day of leave. Absences on any day less than 1/2 shall be charged 1/2 day of leave. In all cases of sick/emergency leave, the District will be responsible for paying the substitute.

A doctor's certificate of disability is needed for illnesses lasting more than five (5) consecutive working days. Sick leave is available when employees are unable to work due to a health condition regardless of whether the condition relates to physical or mental health. Such leave is also available for medical appointments or treatment. 13.4.2 Regular employees shall be allowed to use a maximum of five (5) days of sick leave per year for an emergency. An emergency is defined as an unforeseen and suddenly precipitated occurrence of a serious nature beyond the control of the employee which 13.4.3 The District agrees to comply with the terms of all federal and state laws entitling certain employees to unpaid and/or paid family and medical leave including the federal Family and Medical Leave Act (FMLA), the Washington State Family Leave Act, and the Washington State Family Leave law. Consistent with state law, an employee may use their sick leave to care for: (a) their child with a health condition that requires treatment or supervision; or (b) their spouse, domestic partner, parent, parent-in-law, or grandparent who has a serious health condition or an emergency condition. In addition, employees may use their sick leave for a sibling, grandchild, son-in-law or daughter-in- law who has a serious health condition or an emergency condition. See District Policy 5404.

Should an employee leave the District's employ prior to the close of a school year having used sick leave beyond that accrued on the basis of one day per month, the District shall have the right to recapture the value of that excess sick leave at or before the time the final compensation is made. Emergency Leave shall be granted for not more than two (2) days in any one year and is defined as follows: A. The problem must have been suddenly precipitated and must be of such a naturethat preplanning is not possible or where preplanning could not have relieved the necessity for the employee's absence. B. The problem cannot be of minor importance or mere convenience, but must be of a serious nature. C. The problem is of such a personal nature that prior approval of the Superintendent or his designee will not be required, but the employee will sign a notarized document which will be comprised of paragraphs 1 and 2 above and will attest to the compliance and the provision of this section. Employees, upon finding it necessary to be absent from their assigned duties by reasons of illness or injury, shall notify their immediate supervisor at the earliest possible moment stating the reason and the anticipated duration. For planned surgeries or anticipated disablements which will necessitate illness or injury leave, the affected employee shall notify his or her immediate supervisor, usually 60 days in advance for planned or anticipated disablements, of the anticipated dates during which leave will be required.
