Grant Funded Employees. From time to time, the Employer is provided with short-term funds through a grant for a specific purpose. When such an occasion arises, the Employer will provide notice to the Association and provide information to identify the term and purpose of the grant. The terms and conditions listed below shall govern the rights of grant-funded employees. These terms and conditions shall not apply to the permanently certified employee who is assigned to a grant-funded position and who does not experience an interruption as defined in Section 7.03, Subd. 1 of this Agreement.
a. Be employed on a permanent basis for the duration of the grant only;
b. Enjoy all other rights, benefits and privileges afforded permanent employees under this Agreement;
c. Be granted City and Classification seniority retroactive to their initial date of hire in the event the position becomes permanent;
d. Not be entitled to layoff/bumping rights as defined by this Agreement;
e. Not be eligible to participate in the Job Bank Program; and
f. Be subject to the provisions of Section 1.02 and bear any other duties and obligations of full-time permanent employees under this Agreement. If a grant-funded employee is employed continuously for more than three (3) years, except due to a time extension of the original grant, the employee shall then become a permanently certified employee, and shall be granted all the privileges of that status, including the layoff, job bank and bumping provisions of the Agreement. Such an employee shall also be granted City and classification seniority retroactive to their initial date of hire. Provisions of this section shall also be applicable whenever the grant-funded position becomes permanent through the usual position allocation process. Nothing in this Section shall be interpreted to abridge the Employer’s right to ensure adequate and appropriate staffing or staffing levels.

Grant Funded Employees. The Board and the Union recognize that as a condition of employment, employees who are being paid out of the restricted funds are hired only for the duration of the grant for which they work. Therefore, it is agreed that these employees shall enjoy all the rights and benefits of this Agreement except Section 2.10 – Seniority, during the duration of the grant for which they currently work. Any salary increase above and beyond the conditions of the grant will only apply to the percentage of salary funded by the College through unrestricted funds.
Grant Funded Employees. 1. The Union recognizes that the Employer can enhance its operations by obtaining grant funding from external sources. The Union encourages such endeavors, including the hiring of grant-funded employees to perform duties that would not otherwise be provided by the Employer. All provisions of this Agreement shall apply to employees hired within the Union's bargaining unit subject to grant funding, with the following modifications: Grant employees shall accrue departmental seniority within the project funded by the grant and successor grants for the same or substantially similar projects. Grant employees shall be notified at the time of hire of the duration of grant funding. Grant employees shall accrue departmental seniority within the project funded by the grant. Grant employees shall not receive severance pay if terminated due to expiration and non-renewal of grant funding. Seniority-based rights to bump other employees in a layoff only apply to grant employees within the project funded by the grant. However, any grant employee who transfers to a job that is not grant-funded shall be credited with seniority from the date of initial hire, including service for all grant-funded employment. Any permanent employee transferring from a non- grant position to a grant-funded position retains and accrues seniority from the date of first hire, and retains all seniority-based unit-wide promotion, transfer and layoff rights. Grant employees on leave of absence shall have the right to return to a position in the grant- funded project.
2. Grant applications shall include the cost of wages, and benefits payable under this Agreement. Payments to benefit funds for grant-funded employees shall be made in a timely manner. Grant applications shall include the cost of severance payable under the Agreement and WED employees shall be granted severance benefits in the same manner and amount as other bargaining unit employees, subject to grant funding.
3. Grant employees not otherwise eligible for retirement benefits shall be eligible for participation in a 401(k) plan. In lieu of pension contributions, the California Works Foundation shall contribute up to $7,000 annually to each grant employee’s account, as allowed by the grant funding, the accrual beginning at date of employment but not initially payable until after the employee has completed a 90 day probationary period and thereafter at t...
Grant Funded Employees. Any employee hired after June 1, 2016 in a position that is 100% funded pursuant to Federal, State or foundation grants of limited duration shall be exempt from Article 18, “Bumping,” of this Collective Bargaining Agreement for the duration of their employment in the grant-funded position. Such employees hired before June 1, 2016 shall be exempt from Article 18 for only the first three years of their employment in the grant-funded position. Employees in such grant funded positions must be informed in writing prior to hire of the name of the funding source, the limited duration of their grant-funded position and the reduction in rights under this agreement. The Association President shall be provided a copy of such notice.
Grant Funded Employees. The terms and conditions of this Agreement shall not apply to persons who may be employed under grants or subsidies arranged by the Employer with outside agencies with the consent of the Union. The Union agrees that such consent will not be unreasonably withheld. The Employer agrees that at no time shall people working under grants or subsidies arranged by the Employer cause a loss of wages, layoffs, or a delay of recall to a regular employee.
Grant Funded Employees. If the reduction in force is in a program funded wholly or in part by a grant(s), the College can in its discretion, limit those considered for a reduction in force to those assigned to the grant and/or those who are being paid in whole or in part by the affected grant funds.

Those employees who have been employed prior to July 1, 2011, under the conditions of a grant shall enjoy all rights and benefits of this Agreement, including Section 2.9 – Seniority.
