Grant Funded Positions. (a) If a faculty position is created by grant funding and there is a substantial reduction in that funding or the funding ceases, the position may be terminated by the College and the affected faculty member shall be placed on layoff status and considered as a candidate for any future job for which the faculty member is qualified. (b) A grant-funded position shall be defined as one which is: (i) Initially grant-funded in whole or in part; (ii) Advertised as grant-funded (and therefore not guaranteed). (iii) Specified to the current employee or applicant as grant funded, and therefore not guaranteed; (iv) Voluntarily applied for and accepted by the applicant or current employee Section 8.06 Seniority (a) Seniority of academic faculty members is based on the date of beginning continuous full-time employment. Conflicts of seniority among faculty members with the same beginning date of full-time employment shall be resolved by earlier dates of part-time employment, or date of application for employment, in that order. (b) A faculty member who resigns, retires, or whose employment contract is not renewed or terminated for cause shall forfeit all accrued seniority. (c) The faculty member on authorized leave shall continue to accrue seniority while on such leave.

Grant Funded Positions. Any employee whose employment is contingent on grant funding and grant outcomes shall be provided a copy of the grant to include all conditions of funding, obligations and performance measurables. This section does not apply to positions that will be retained regardless of grant income.
Grant Funded Positions. 1. Positions funded in whole by external grants are subject to immediate termination if the grant funding ceases. Those positions funded in part by external grants will be reviewed by the College for viability in the absence of grant funds. If the position remains viable, in whole or in part, despite the loss of grant funds, the College, in its discretion, may reduce the position to less than full time. The decision to terminate or reduce a position is not grievable. 2. The College retains the right to decide at its discretion whether or not to seek renewal of any grant. Such decision is not grievable. The President or designee shall make every good faith effort to provide the Union with notice of the College’s decision not to seek renewal of the grant within five (5) days of the decision, and at least forty-five (45) days before the grant application is due. At the Union’s request, the President or designee will meet with the Union President to discuss any impact from that decision. 3. Grant Funded Positions. 28.1 The Company may hire or transfer employees to fill grant- or community-funded positions. Employees transferred into these positions shall not receive a pay cut as a result. It is understood that existing, regular-status employees transferred into grant- or community-funded positions will remain covered by all terms of the CBA. At the expiration of funding, a regular-status employee who was transferred into a grant- or community-funded position shall return to a regular-status position at a rate of pay at least equal to what they earned prior to the transfer, or what they earned under the grant funding, whichever is higher. The Company may also hire full- or part-time temporary employees to fill grant- or community-funded positions in accordance with the CBA. Job purpose, compensation and length of assignment are determined by individual funding agreements. Such employees will be covered by all terms of the CBA, including, but not limited to, just cause protections, healthcare benefits, 401K, expense reimbursements, and parental leave (under the terms of the policy), with the exception of the following: 7.1 (Severance pay - short-term temporary employees, hired for less than six (6) months are ineligible for severance), and 14.3 (Guild Leave). It is understood that this exclusion of Guild Leave does not include unpaid time taken for contract negotiations. 28.2 Upon creation of a grant-funded staff position, the Guild shall be notified of the duration of the funding for said position(s) and shall receive a copy of the funding agreement that includes, but is not limited to, the source of the funding, terms and conditions of the funding and the beat or coverage area for this position. Upon hiring, the new employee shall also receive a copy of the funding agreement. 28.3 Sixty (60) days prior to the scheduled expiration of funding, the Company shall meet with the employee to discuss renewal of the funding. If the funding will not be renewed, the Company shall discuss with the employee any opportunities to move into another newsroom position with the Company for which the employee is qualified. If the employee is qualified for a vacant position that has been approved to fill, and has met performance standards, they shall be given the first opportunity to interview for the position before external candidates. Grant Funded Positions. For temporary grant-funded positions (such as, but not limited to, GEARUP), stipend amounts are determined by the administrator and/or grant writer. These positions will be posted and a supplemental contract will be issued.
Grant Funded Positions. Employees in bargaining unit positions funded by a federal, state, local or private grant shall be subject to the conditions listed below should said funds be reduced or terminated. 1. Employees hired after July 22, 1990, who have four (4) or more years of bargaining unit seniority shall have the right to bump into other bargaining unit positions in accordance with the provisions of Section 5 above. 2. Employees covered by this Section shall receive notice of layoff in accordance with the provisions of Section 1 above when possible. In no case shall notice of layoff occur less than thirty (30) calendar days prior to the effective date of the layoff.
Grant Funded Positions. Grant-Funded Employees are defined as persons employed by the College in positions that have been created specifically per the terms of a grant and with at least fifty percent (50%) of the position’s compensation package being paid by grant funds. The Board and the Union recognize that, as a condition of employment, grant-funded employees are hired only for the duration of the grant for which they work. Any and all current grant-funded employees whose employment is specifically related to a current grant as defined above shall become bargaining unit members regardless of the terms and/or monetary amount of the current grant under which they are employed, except when the employment of such an employee meets and/or exceeds the terms identified below for permanent employment. However, after the effective date of this Supplemental Agreement, a grant-funded employee shall become a bargaining unit member upon his/her three-hundred sixty- sixth (366th) day of employment, and all provisions of the CBA shall then apply to him/her. (For example, if this Supplemental Agreement becomes effective on May 29, 2010, the soonest a current grant-funded employee could become a bargaining unit member is May 30, 2011). For purposes of calculating the three-hundred sixty-five (365) consecutive days required to become a bargaining unit member, all time that an employee is out on unpaid leave or workers’ compensation shall be excluded from the calculation. Seniority for grant-funded employees that become bargaining-unit members shall be the first date that the grant-funded employee becomes a bargaining-unit member. If a former grant-funded employee is re-employed in a grant-funded position within ninety (90) days of termination of employment, the returning grant-funded employee shall be considered a continuous employee and will not be subject to re-starting the requirements to meet the three-hundred sixty-five (365) consecutive days of employment to become a bargaining unit member. They will be credited with all days worked as a grant-funded employee. If a former grant-funded employee is re-employed more than ninety (90) days after termination of employment, the returning grant-funded employee will need to meet the three-hundred sixty-five (365) consecutive days of employment to become a bargaining unit member upon his/her three-hundred sixty-sixth (366) day of employment. There shall be no bridge of service.

Grant Funded Positions. X. XXXXX agrees to use all reasonable effort to pay externally funded program employees the same pay as regular employees in the same title position with the same seniority in title as long as such salary will be paid fully from funds outside the general XXXXX’ budget which shall include the salary increase of Section 1 of this Article. B. All personnel hired, pursuant to externally funded grants or funds provided by other than the BOCES’ general fund budget to fill positions within this bargaining unit, shall hold such positions only for the length of the externally funded program. The employee's employment shall cease when the funding is terminated. While employed, the employee shall be covered by all provisions of this Agreement except for the items enumerated in Article 11, Leaves and Article 16, Vacation.
Grant Funded Positions. Any agreed upon settlement pertaining to working conditions, salary, benefits and employment status of Job Coach staff is wholly dependent upon funding received by the School District from the grants currently in effect. Any reduction in the grants will equate to a reduction in staff and/or benefits, salary and working conditions employees unless the Board decides to continue to fund it. Any programs, stipends, or positions , including Job Coach administrative assistant, Job coach, or Job developer, can be removed by the Board of Education at any time at their sole discretion.
