Jury and Crown Witness Duty. An employee who is summoned and reports to jury duty or as a Crown witness as prescribed by applicable law shall be paid by the Company an amount equal to the difference between the daily jury duty or Crown witness duty paid by the Court (not including travel allowance or reimbursement of expenses) for each day which they report for or perform jury duty or Crown witness duty and on which they otherwise would have been scheduled to work for the Company and basic wages which the employee would have earned from the Company excluding premiums or add-ons by working the straight time hours for the Company on such day. The Company's obligation to pay an employee for jury duty or Crown witness duty is limited to a maximum of forty-five (45) days in any calendar year. In order to receive payment, an employee must give Management twenty-four (24) hours' prior notice that they have been summoned for jury duty or Crown witness duty and must furnish satisfactory evidence that they reported for or performed such duty on the days for which they claim such payment.

Where a nurse is required to be absent by reason of receipt of a summons to attend as a juror or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law or a coroner's inquest in connection with a case arising from the nurse's duties at the Centre, they shall be paid the difference between their normal pay and the amount paid for such service less expenses, computed at their normal hourly rate for all hours lost from work up to thirty-five (35) hours in a week, subject to the following conditions:
Jury and Crown Witness Duty. 17.01 An employee who is required to be a witness or to serve as a juror by any body in Canada with powers of subpoena, shall be paid the difference between her/his normal earnings and the payment he/she receives for such service. If an employee is required to report for jury duty or subpoenaed as a witness by the Crown in any court of law, on his regularly scheduled work day, the Company will make up the difference between his regular hourly pay for that day and the jury duty pay or witness pay received by him for that day. Should employees be summoned and subsequently report for either Jury or Crown Witness Duty (including a Coroner's Inquest under Crown subpoena) on a regularly scheduled working day, they shall be paid per day for each day served. Employees shall be paid only if they are available for work on the days for which this benefit is claimed, When employees are in court all day, they will not be expected to report for work on their regular shift on nights. Employees shall not be available for work if they are: On and have not been advised by their Doctor to return to work and thus do not return to work on or before the last day of Jury or Crown Witness service. Absent because of sickness or non-occupational accident. On authorized leave of absence (other than leave for Jury or Crown Witness Duty). On scheduled Paid Holidays. On lay-off. Should Jury or Crown Witness Duty be served while employees are on their regularly scheduled vacation, they shall be paid per day for each day served and their vacation shall be extended by the number of days so served.

Jury and Crown Witness Duty. 21:01 If an employee is called upon to act on a panel of jurists or as a crown witness, the Company agrees to pay to the employee the difference between his/her pay at their regular hourly rate for the regular work schedule and the pay received for the said Jury or Witness Duty.

An employee who is selected for service as a juror or crown witness will be compensated for loss of pay from his regularly scheduled shift due to such jury service or crown witness duty. Such compensation will be based on his regularly scheduled hours at his regular straight time hourly rate less the fee received for his services as a juror or crown witness. However, should the employee present himself for selection as a juror and not be selected then he is required to return to the job to complete his remaining normally scheduled work day. In order for an employee to qualify for payment under this Article, he must: a inform his immediate supervisor within twenty-four hours of his selection for service as a juror or after he has received a subpoena to be a crown witness; if released from service as a juror or as a crown witness and four hours or more remain in the employee's regular scheduled hours, he must return to the job to complete his remaining normally scheduled work day; C provide a written statement to the Employer indicating the date of service as a juror or crown witness, the time so spent and the fee received for his service as a juror or crown witness; and have completed his probationary period. An employee who serves at least six hours as a juror or crown witness on a day on which he is scheduled to work the afternoon shift shall be excused from working for the afternoon shift of that day and shall be compensated in accordance with the formula established in Article ARTICLE
