Jury/Court Duty. Temporary duty with pay will be granted to an employee who is summoned to serve on a jury, subpoenaed to appear at a legal proceeding as a witness, if he/she is required by law to attend, or to make appearance in any court proceeding resulting from activities relating to the employee’s employment with the school district. Such leave must be requested and approved in advance. An employee who is excused from service, prior to the end of the working day will be expected to return, when practical, to duty for the balance of the working day. In no case shall temporary duty with pay be granted for court attendance when an employee is engaged in his/her personal litigation. However, employees may utilize accrued vacation leave for such purposes with approval of the responsible supervisor.
Jury/Court Duty. 1. The Employee shall be excused from her/his regularly assigned duties for jury duty or for attendance at court pursuant to subpoena to give testimony before any judicial tribunal for any crime, provided she/he has followed the procedures established for applying for absence due to personal affairs.
2. The employee shall turn in a copy of her/his Court summons to the Head Bookkeeper in the Business office. This summons shall include the week and/or weeks being served. For this absence the employee shall also contact the absence tape to report the days of absence. When the employee receives the check from the court clerk, this check must be turned into Xxxxxxxxxx Public Schools Business office. Any mileage fees included in this check, will then be reimbursed to the employee serving court time or jury duty.
3. For such absence, there shall be no deduction from the employee’s absence day accumulation, provided that the employee has met all the condition in seeking approval for such absence as stated above.
Jury/Court Duty. If a nurse is required to serve as a juror in any court of law, arbitration hearing or coroner's inquest proceeding or required by subpoena or summons to attend a court of law, or coroner's inquest proceeding, or is required to attend a hearing of the College of Nurses, she shall not lose her regular pay because of such attendance provided that she:
a) notifies the Employer immediately upon her notification that she will be required to attend court or a coroner's inquest;
b) presents proof of service requiring her attendance; and
c) promptly repays the Employer the amount (other than expenses) paid to her for such service or attendance.
Jury/Court Duty. The Board of Education shall pay a full-time employee, including hourly and per diem employees, the difference between such employee's regular compensation and remuneration received for serving as a juror. The Board will provide a substitute teacher(s) when a teacher is serving as a juror, witness, defendant, complainant, or as a witness in any proceeding for which a subpoena is issued as a result of their employment in the district. Said employee shall receive his/her normal per diem wage.
Jury/Court Duty. If a nurse is required to serve as a juror in any court of law or coroner's inquest proceeding or required by subpoena or summons to attend a court of law, arbitration hearing or coroner's inquest proceeding, or is required to attend a hearing of the College of Nurses, they shall not lose their regular pay because of such attendance provided that they:
i) notifies the Employer immediately upon their notification that they will be required to attend court or xxxxxxx's inquest;
ii) presents proof of service requiring their attendance; and
iii) promptly repays the amount (other than expenses) paid to them for such service or attendance, to the Employer.
iv) Such leave with pay shall be limited to their posted and scheduled hours of work on such days.
Jury/Court Duty. A teacher who serves as a juror shall be granted leave without loss of pay or other emoluments for days covered by the jury duty. The teacher shall not be required to remit jury duty pay to the Board. A teacher who is directed by the Board or its administrative agent(s) to appear in court on behalf of the Board, or in any other job-related capacity, shall receive his/her regular rate of pay as a bargaining unit member and will not forfeit his/her personal leave.
Jury/Court Duty. All employees shall be allowed necessary leave to serve as a member of a jury. During such leave, employees will be paid at their regular rate of pay. Any jury duty pay (exclusive of expenses) received for his service on a workday shall be reimbursed to the Employer. The Employer has the right to request for dismissal of an employee from serving on jury duty.
Jury/Court Duty. 20.01 Employees who are required to serve on jury duty or are subpoenaed as a crown witness shall suffer no loss in their regular wages.
20.02 Employees absent for the above reasons must present proof of such service and remit to the Company the amount of compensation they received exclusive of mileage, meals or parking allowances.
Jury/Court Duty. The Company shall pay an employee who is required for Jury Service and/or Subpoenaed Witness, for each day of service, the difference between their straight time hourly rate for the number of hours they normally work on their regular shift and the payment they receive from the court. The employee will present proof of service and the amount of pay provided.
Jury/Court Duty. A. Any regular full-time or part-time employee who is required to serve on a jury, or as a result of official Township duties is required to appear before a court, legislative committee or quasi- judicial body as a witness in response to a subpoena or other directive, shall be allowed authorized leave with pay less any amount received for such service. An employee during the orientation period called will have his/her orientation period extended to by the same amount of time as required for serving on jury duty. An employee who receives notice of jury duty or witness service must notify his/her supervisor immediately in order that arrangements may be made to cover the position. The Township reserves the right to request that an employee who is called for jury be excused if their absence would create a hardship on the operational effectiveness of the department to which they are assigned.
B. The employee is responsible to turn over jury or witness fees to the HR Coordinator, excluding mileage fees.
C. Time away will not affect vacation, sick leave or personal leave accruals.
D. Employees who appear in court as the plaintiff or defendant in any action not related to their official duties shall not be paid for time away from work unless that time is accrued vacation or personal leave. Court payments for travel expenses are to be retained by the employee.
E. The employee may keep any court payment for services performed on the days of his/her regularly scheduled weekend or performed while on vacation or personal leave.
F. Employees are to return to work after jury duty although no more than the regularly scheduled number of hours for both jury duty and work shall be required. If excused as a juror on any given day, the employee is expected to contact his/her supervisor and to report to work as instructed.
