Layoff Definition and Notice. (a) A "layoff" shall include a reduction in an employee's hours of work and cancellation of all or part of an employee's scheduled shift. Cancellation of single or partial shifts will be on the basis of seniority.
(b) A "short-term layoff" shall mean a temporary layoff which is not anticipated to exceed three (3) months in length.
(c) A "long-term layoff" shall mean any layoff which is not a short-term layoff.
(d) The Employer shall provide the local Union with no less than thirty (30) days notice of a short term layoff. Notice shall not be required in the case of a cancellation of all or part of a single scheduled shift. In giving such notice, the Employer will indicate to the local Union the reasons causing the layoff and the anticipated duration of the layoff, and will identify the employees likely to be affected.
Layoff Definition and Notice a) A layoff shall not include a reassignment of an employee from her or his classification or area of assignment who would otherwise be entitled to notice of layoff provided:
i. reassignments will occur in reverse order of seniority;
ii. the reassignment of the employee is to an appropriate position with the employer having regard to the employee’s skills, abilities, qualifications and training or training requirements;
iii. the reassignment of the employee does not result in a reduction of the employee’s wage rate or hours of work;
iv. the job to which the employee is reassigned is located at the employee’s original work site;
v. the job to which the employee is reassigned is on the same or substantially similar shift or shift rotation; and
vi. where more than one employee is to be reassigned in accordance with this provision, the reassigned employees shall be entitled to select from the available appropriate vacancies to which they are being reassigned in order of seniority provided that no such selection causes or would cause a layoff or bumping. The Hospital bears the onus of demonstrating that the foregoing conditions have been met in the event of a dispute.
b) A "short-term layoff" shall mean:
i. a layoff resulting from a planned temporary closure of any part of the Employer's facilities during all or part of the months of July and August (a "summer shutdown") or during the period between December 15th and January 15th inclusive (a "Christmas shutdown"); or
ii. a layoff resulting from a planned temporary closure, not anticipated to exceed six months in length, of any part of the Employer's facilities for the purpose of construction or renovation; or
iii. any other temporary layoff which is not anticipated to exceed three months in length.
c) A "long-term layoff" shall mean:
i. any layoff which is not a “short-term layoff”; or,
ii. the permanent reduction in regular hours of a full-time employee.
d) Where an employee has her or his shift cancelled, this shall not constitute a layoff under this agreement. Cancellation of partial or single shifts will be on the basis of seniority of the RTs on the unit on that shift, except where the more senior employee does not possess the training for the duties required on that particular shift.

A layoff is defined as a permanent or prolonged reduction in the number of employees in a job classification within a nursing unit, i.e., medical/surgical, OB, CCU/Tele, Surgical Services, Short Stay, or a department, i.e., Diagnostic Imaging, Cardiac Services, Cancer Center infusion services.
Layoff Definition and Notice. Full –Time Nurses
(a) A layoff of Full-time nurses shall be made on the basis of seniority provided that the nurses who are entitled to remain on the basis of seniority are qualified to perform the available work. Subject to the foregoing, probationary nurses shall be first laid off. Full-time nurses shall be recalled in the order of seniority, unless otherwise agreed between the Employer and local Union, provided that the nurse is qualified to perform the available work.
(b) Where a vacancy occurs in a position following a layoff hereunder as a result of which a Full-time nurse had been transferred to another position, the affected Full-time nurse will be offered the opportunity to return to her former position providing such vacancy occurs within six (6) months of the date of layoff. Where the nurse returns to her former position, there shall be no obligation to consider the vacancy under Article 10.

If requested, the Hospital will meet with the Union to review the effect on employees in the bargaining unit.

A partial or single shift assignment of an employee from her or his area of assignment will not be considered a layoff. The parties agree that the manner in which such assignments are made will be determined by mutual agreement of the employees on the unit and the Supervisor. Where agreement can not be reached, the junior employee will be reassigned.
