LEAVE OF ABSENCE RULES. 37.01 To qualify for leave of absence, as stipulated in Article 36.01 the employee must have completed six (6) months of employment with the Employer.
37.02 If the leave of absence is granted, the employee shall be advised in writing with a copy to the Union.
LEAVE OF ABSENCE RULES. 21.01 Employees who are on leave of absence will not engage in gainful employment on such leave, and if an Employee does engage in gainful employment while on such leave without prior written approval by the Employer, the Employee will forfeit all seniority rights and privileges contained in this Agreement unless otherwise agreed by the Union and the Employer.
21.02 An Employee who has been granted a leave of absence of any kind, and who overstays the Employee’s leave of absence without permission of the Employer and who cannot provide a justifiable explanation, will be considered to have terminated their employment.
21.03 Benefits will accrue from the date of return to employment following such leave of absence. No Employee will accumulate seniority, sick leave plan credits, or earned vacation nor will other benefits be paid or accrue while on leave of absence, other than those outlined below:
(a) periods of sick leave paid by the Employer
(b) leaves of absence with pay
(c) bereavement leave
(d) Employer paid jury/witness duty
(e) paid vacations
(f) while on approved Union leave of absence
(g) for the health-related portion of maternity leave.
21.04 Employees will not be entitled to named holidays with pay, which may fall during the period of leave of absence.
21.05 An Employee returning from a leave of absence will be reinstated within one month following written notice of desire to return to work. An Employee returning from Workers’ compensation will be reinstated within two (2) weeks following receipt of proof of fitness to return to work. Upon return to work the Employee will be placed on the job previously held providing the Employee can perform the required work satisfactorily. If the Employee would not otherwise have retained the Employee’s previous job the Employee will, subject to seniority, be placed in the job the Employee can satisfactorily perform.
LEAVE OF ABSENCE RULES. Where the Leave of Absence without pay exceeds sixty (60) days:
LEAVE OF ABSENCE RULES. Where any leave of absence without pay exceeds thirty (30) continuous calendar days, the following shall apply:
a) The Employer shall pay its share of the health and welfare benefits for the calendar month in which the leave commences;
b) Seniority, service, vacation pay or any other benefits under any provision of this Agreement or elsewhere, will not accumulate, but will remain fixed at the amount held at the commencement of the leave;
c) No Employee will accumulate seniority and service while on leave of absence unless otherwise stated, but seniority and service established at the point of leave will be reinstated upon return to work. While an Employee is on pregnancy or parental leave, seniority and service will be accumulated in accordance with Article 9.04;
d) The Employee’s anniversary date shall be adjusted by the length of the leave in excess of the thirty (30) continuous calendar days, and, the new anniversary date shall prevail thereafter;
e) Notwithstanding the above, the Employer shall continue to pay its share for the premium for the benefit plans for Employees who are on paid leave of absence, pregnancy/parental leave or receiving WSIB compensation for a maximum of one year while receiving WSIB Compensation, provided that the Employee provides the Employer with post dated cheques or other suitable payment accordingly.

LEAVE OF ABSENCE RULES. 19.01 Where the Leave of Absence without pay exceeds sixty (60) days:
(a) The Employer shall pay its share of any and all Health and Welfare benefits for the first sixty- (60) days.
(b) If the Leave of Absence exceeds sixty (60) days, except as provided in subsection 39.05, benefits coverage may be continued by the employee, provided the employee pays the total cost of the premiums to the Employer for each monthly period in excess of the sixty (60) days Leave of Absence.
19.02 If the Leave of Absence exceeds sixty (60) days, the employee shall not accumulate further vacation or sick leave credits but shall continue to accumulate seniority to a maximum of one (1) year.
LEAVE OF ABSENCE RULES. 21.01 If the employee has not completed two (2) years of employment, credits for seniority, salary increase, vacation and cumulative sick leave will be suspended during leaves of absence without pay.
21.02 An employee with more than two (2) years of service who is granted unpaid leave of absence, will continue to accumulate vacation and sick leave credits for a maximum of three (3) months.
21.03 If the unpaid leave of absence exceeds three (3) months, such employee shall accumulate no further vacation or sick leave credits, but shall continue to accumulate seniority to a maximum of six (6) months.

(c) An employee returning from any leave of absence will be reinstated on the date fixed for return on the granting of the leave subject only to the layoff provisions of the Agreement in the event that a layoff has occurred during the leave.

Where any leave of absence for personal reasons exceed four (4) or more consecutive weeks: Credits for seniority, salary increases, and vacation will be suspended during the leave. The Employer will make no payments towards health and welfare payments during the leave. The employee may, however, continue his coverage by con- tributing the cost of the premiums to the Employer and the Employer will make the payments to the appropriate agency. In case of sick leave, absence covered by Workplace Safety and Insurance Board or maternity leave in excess of four (4) weeks: Credits for vacation will be suspended. The Employer will make no payments towards health and welfare payments during the leave. The employee may, however, continue his Coverage by contributing the cost of the premiums to the Employer and the Employer will make the payments to the appropriate agency. Where an employee is on an approved Leave of Absence she will be paid for the first Statutory Holiday which occurs after the commencement of the Leave of Absence.
