Long Term Leave Without Pay. All employees who are approved for leave of absence will not jeopardize their consideration for reappointment under Article l3 of the TA and ELC Appendices, assuming the employees are eligible for reappointment and confirm their availability for reappointment within eight (8) weeks of the commencement of the term when they will return.
Long Term Leave Without Pay. Applications for long term leave of absence must be made in writing, including a proposed return to work date, normally by November 15th of each preceding calendar year, unless precipitated by bona fide medical reasons or family emergency. Subject to operational considerations, such applications will not be unreasonably denied.
Long Term Leave Without Pay. 7.21.1 Requests for a long-term leave of absence without pay or benefits shall be made in writing to the Human Resources department no later than April 15. The request shall include a general purpose or reason for the leave. Specific personal, confidential information shall not be required in the formal request. This leave may be granted at the discretion of the District.
7.21.2 If acceptable to the insurance carriers, the District shall allow Employees on such leave to continue any or all portions of their fringe benefit insurance programs via direct monthly payments to the District. Any Employee who fails to make a timely payment will be discontinued from participation. Employees on such leave must make written arrangements with the payroll office.
7.21.3 When granted, such leave shall be for a period of one (1) year.
7.21.4 At the conclusion of the leave, the Employee will be assigned to the next available equivalent position, within grade span or subject area, with equivalent compensation.
7.21.5 Employees granted leave under this section will be subject to the same Assignment and Transfer and Retention, Layoff and Recall provisions as other Employees during the duration of such leave.
7.21.6 Upon return, the Employee shall retain the same seniority they had at the time they began the leave.
Long Term Leave Without Pay. Teachers may be granted, upon written request to and approval of the Board, an unpaid leave of absence for up to one (1) school year for the purpose of personal illness, illness in the immediate family, or rearing of a child. Written requests for unpaid leave of absence for the ensuing year must be filed prior to March 1st of the current year, except when the situation for which the leave is requested could not have been known prior to March 1st. Written notification for reinstatement for the ensuing year following a leave of absence must be filed by March 1. If no such request is filed by that date, the teacher will be deemed to have resigned effective at the end of the current contract year. While on approved leave, a teacher shall not lose any accumulated leave, years of experience, or career status; however, no additional leave, years of experience, or career status shall accrue during the leave. Teachers on approved leave may continue to participate in the district’s health plan with the teacher paying the premiums. Upon returning from an unpaid leave of absence, the teacher will be assigned to a position for which the teacher is certified. (6-26-96)
Long Term Leave Without Pay. The Board of Supervisors has discretion to authorize special leaves of absence without pay for any period up to six (6) consecutive calendar months. Such leaves include, but are not limited to educational, Union, and public official leave. Such leaves may be renewed for additional periods of up to six (6) consecutive calendar months upon the request of the Employee, if agreed to by the Board of Supervisors. Employees returning from authorized leaves of absence without pay of more than ten (10) workdays shall return to their former job, if physically qualified and the position is vacant, or to another equivalent position in accordance with his/her qualifications and ability.
Long Term Leave Without Pay. (a) Employees who are registered in an academic degree program and who are approved for a leave of absence from employment for a period not to exceed one (1) year, will not jeopardize their consideration for reappointment under Article 13, assuming the employees are eligible for reappointment and confirm their availability for reappointment within eight (8) weeks of the commencement of the academic term when they will return.
(b) All other employees who are approved for leave of absence will not jeopardize their consideration for reappointment under Article l3, assuming the employees are eligible for reappointment and confirm their availability for reappointment within eight (8) weeks of the commencement of the term when they will return.
Long Term Leave Without Pay. An approved absence from service for a period of from twenty-one (21) workdays to one (1) calendar year. A long-term leave may be granted by the Board upon recommendation by the Superintendent.
Long Term Leave Without Pay. Subject to the approval of the RCJTC President or designate, an employee may be granted a part-time or full-time leave of absence from their position. The following shall apply if the leave is approved.
a) The duration of the leave shall be a minimum of six (6) months, which subject to the approval of the RCJTC President or designate, may be extended for another term. The posting requirement will apply for the vacancy.
b) At the expiration of the leave, the original employee resumes the duties of the original position and the leave of absence replacement returns to his/her previous position or is laid off.
c) The leave of absence replacement, if a current member of the Bargaining Unit, has full rights and privileges of an employee pursuant to this Collective Agreement.
Long Term Leave Without Pay. The Board of Supervisors has discretion to authorize special leaves of absence without pay for any period up to ninety (90) consecutive calendar days. This leave is renewable with department head recommendation and Board approval, unless an alternate schedule is approved by the Board.
Long Term Leave Without Pay a. Conditions of leave without pay:
1) Maximum length shall be one (1) year.
2) The employee must have worked for the District for a minimum of three (3) consecutive years immediately preceding the application. Exceptions to this requirement will be considered if the purpose of the leave will benefit the District, as well as the employee. However an employee requesting a personal leave of absence must have worked for the District for a minimum of five (5) consecutive years immediately preceding the application. As a further exception, an employee receiving workers compensation replacement income shall upon request, be granted leave without pay for up to one (1) year inclusive of Family leave. This exception does not preclude the District from discharging the employee pursuant to Article X, or during his/her probationary period (Article II, Paragraph D.).
3) When an employee takes an unpaid leave of absence, no vacancy is created; the position may be filled by appointment (see acting assignment). While the employee is on an unpaid leave of absence over thirty days, seniority will be maintained but no credit will accrue while on leave of absence. Seniority will continue to accrue on the day after the unpaid leave ends.
4) The employee will return to his/her original position if it exists in the budget, but if not then the employee will be subject to the layoff provisions of this Agreement.
5) The employee must notify the District in writing, of intent to return within thirty days (30) days of the expiration of the leave. Failure to make such notification will release the District from the obligation of providing a position.
6) Failure to return to duty following a leave shall forfeit all rights and benefits.
7) An employee on leave may elect to pay premiums for insurance during the leave.
8) Utilization of leave time for purposes other than which the leave was granted shall be a cause for dismissal.
b. Categories of leave without pay include:
1) Educational A leave of absence may be granted for professional study which is a direct benefit to the District. Leave application for professional study shall be accompanied by written documentation establishing at least 12 semester hours of coursework per semester from the accredited college, university, or vocational school. The documentation must be provided to the District by September 30th of the following year. Application for professional study must be received by January 1st of the academic year prior to the ...
