Order of RIF. Once the District President determines the number of faculty members to be RIFed in each unit, he/she shall consider making special and temporary faculty appointments available to qualified tenured or probationary faculty facing RIF. After considering these options the District President shall utilize the following order of reduction within each RIF unit: a. Full-time probationary employees in order of least seniority. b. Full-time tenured employees in order of least seniority. c. The order of implementation of a or b above may be interrupted in the event that: i. Strict adherence to it would result in no qualified faculty member being available to fully perform the remaining duties, and/or ii. Strict adherence to it would result in a conflict with state laws. The Parties mutually agree to use their best efforts to ensure that any RIF will not be in conflict with the District’s affirmative action plan.

Order of RIF. Within each affected RIF Unit, the President shall observe the following order 12.3.3.1 Prior to RIF of probationary or tenured faculty members, non-probationary and non-tenured faculty members will be dismissed, without the right to a hearing. 12.3.3.2 First order of RIF is full-time probationary faculty members in order of least seniority within the affected RIF Unit. 12.3.3.3 Second order of RIF is full-time tenured faculty members in order of least seniority within the affected RIF Unit.
Order of RIF. Recommended reductions in a teaching field will be made by selecting the lowest person on the seniority list for that area of certification who is currently assigned to a position in that teaching field. A teacher so affected may elect to displace a teacher who holds a lower position on a seniority list for another area of certification. F.1 With respect to OTES bargaining unit members, the Board shall not use seniority in determining contract suspensions except as specified herein, but shall proceed to suspend contracts for teachers based upon evaluations of those who have been evaluated in accordance with the Board-adopted, standards based evaluation policy and provisions of the collective bargaining agreement. F.3 When the position(s) to be eliminated or reduced in part to accomplish reductions in force has been determined, the following order shall be followed to determine the order of suspending contracts of bargaining unit employees: F.3.1 Limited contract teachers shall be reduced in the affected teaching fields (certification/licensure) utilizing the following order: F.3.1.1 Comparable evaluations as defined in accordance with provisions of this agreement. F.3.1.2 When evaluations are comparable, seniority in the District shall prevail, with the contract of the least senior limited contract teacher in the affected teaching field the first to be suspended. F.3.2 Should the necessary reduction of staff required exceed the number of limited contract teachers in the affected field, continuing contract teachers be reduced in the affected teaching fields (certification/licensure) utilizing the following order: F.3.2.1 Comparable evaluations as defined in accordance with provisions of this agreement. Order of RIF. (a) In the event the College determines a RIF is necessary as provided in this article, part-time faculty will be laid off before adjuncts in that same seated discipline. Adjunct faculty will be laid off in inverse order of their seniority as an adjunct in the seated discipline. Laid off adjunct and part- time faculty shall have no re-employment rights or property interest in re-employment. (b) In the event the College determines a RIF of a full-time faculty member is necessary, due to impending or immediate financial crisis, as provided in this article, temporary faculty will be laid off before probationary faculty, and probationary faculty will be laid off before tenured faculty in that same seated discipline. Temporary faculty, probationary faculty and tenured faculty will be laid off in reverse order of seniority in their seated discipline. In the event that the College eliminates a full-time probationary or tenured faculty position through RIF, loads equivalent to 45 load units will be reduced in that same seated discipline for the following two academic years (F- W-Sp terms) for each faculty member reduced. Loads equivalent to 45 load units will be restored for each probationary or tenure track position that is offered to the furloughed faculty members in the seated discipline in order of seniority and then to any other furloughed faculty in order of seniority at the college, who are qualified to provide this instruction in the judgment of the Vice President for Instruction as per 11.5(a). (c) In the event the College determines a RIF of a full-time faculty member is necessary due to a need to reduce or eliminate a significant set of courses in a seated discipline, the equivalent to 45 load units of credit instruction will be reduced in the seated discipline of the reduced faculty member for the three academic years (F-W-Sp terms) following the completion of the remediation process described in 11.6(a) for each faculty member reduced except as provided in 11.10. Loads equivalent to 45 loads units will be restored for each probationary or tenure track position that is offered to the furloughed faculty members in the seated discipline in order of seniority and then to any other furloughed faculty in order of seniority at the college, who are qualified to provide this instruction in the judgment of the Vice President for Instruction as per 11.5(a).
