Organ Donation Leave. (a) Employees who have been employed for at least thirty (30) days shall receive Organ Donation Leave without pay for up to thirteen
Organ Donation Leave. Bargaining Unit Members may take a leave of absence of not more than 30 days in a calendar year to serve as an organ donor, without loss of or reduction in pay, without loss of leave to which he/she is otherwise entitled and without loss of credit for time or service. All leaves granted under this Section shall be done in accordance with Chapter 149, Section 33E of the Massachusetts General Laws.
Organ Donation Leave. (a) Employees who have been employed for at least thirty (30) days shall receive Organ Donation Leave without pay for up to thirteen (13) weeks to donate an organ or tissue to another individual.
(b) Employees must provide a certificate from a Doctor stating the start and end dates for the period of time necessary to donate the organ and recover from the procedure.
(c) Where possible, the employee shall provide two (2) weeks’ notice before the leave
(d) Employees are entitled to extend their leave by up to an additional thirteen (13) weeks, without pay, if a Doctor provides another certificate stating the time period needed to finish recovering.
(e) Employees may end the leave earlier by giving the Employer two (2) weeks’ notice in writing before the day they intend to return to work. Employers and employees may agree to a different schedule for returning to work.
(f) At the end of an employee’s leave under this Article, the Employer shall reinstate the employee to the position the employee occupied when the leave began or to a comparable position, with not less than the wages and any other benefits earned by the employee immediately before the leave began, unless the Employer lays off the employee or terminates their employment or fails to reinstate for reasons unrelated to the leave.

Organ Donation Leave. 1. Employees with more than thirty (30) days ‘ employment are entitled to leave without pay of up to thirteen (13) weeks for the purpose of donating an organ. Such leaves shall be in accordance with The Employment Standards Code which terms include but are not limited to the following provisions.
2. An employee donates an organ when he or she undergoes a surgical procedure that involves the removal of an organ or tissue from the employee for the purpose of it being transplanted into another individual.
3. An employee who wishes to take a leave under this article must give the employer
(a) in writing, as much notice as is reasonable and practicable in the circumstances; and
(b) a medical certificate stating the start date and end date of the period necessary for the employee to donate the organ and recover from the procedure.
4. The employee is entitled to take leave for the period set out in the medical certificate. The employee is entitled to extend his or her leave if the employee gives the employer a medical certificate stating that the employee requires an additional specified period to recover from donating an organ.
5. A leave may be extended more than once, but the total extension period must not exceed thirteen (13) weeks.
6. An employee who wishes to extend a leave must give the employer written notice at least one pay period before extending the leave, if reasonable and practicable in the circumstances. An extended leave ends on the day specified in the most recent medical certificate given to the employer. The employee may end the leave earlier by giving the employer written notice at least one pay period before the day he or she wishes to end the leave.
Organ Donation Leave. A. Leave Available for Organ Donation in Any Twelve Month Period
1. Length of time available. In any twelve (12)-month period, an employee may use up to seven (7) days of organ donation leave to serve as a bone marrow donor and thirty (30) days of organ donation leave to serve as an organ donor.
2. When leave available. Organ Donation Leave may be used only for the actual donation procedure, the preparation for the actual donation procedure and recovery from the actual donation procedure. It may be used in increments in one (1) hour or more.
