PROMOTIONS, VACANCIES AND JOB POSTINGS. 12.01 Whenever a vacancy arises, or a new position is created, a notice of the vacancy or new position shall be posted for twenty-one (21) working days, and employees may apply in writing to fill the vacancy. If the vacancy is for a full-time job, then full-time employees within the seniority group shall be given preference when the applications are being considered. If the vacancy is for a part-time job, then the Employer shall give preference to applications submitted by part-time employees. The awarding of the position(s) shall be done in accordance with the seniority provisions of this Agreement. A job posting shall include the duties of the job, any qualifications necessary, the classification, the wage rate applicable and the intended shift the position will be working, as well as the closing date for applications. The job shall be awarded within five (5) working days following the end of the posting period.
12.02 The Employer shall give first consideration to the bargaining unit employees in filling the vacancy, provided that the Employer shall be free to fill the vacancy at its discretion should there be no suitable applications from the bargaining unit pursuant to the provisions of this section.
12.03 In the event that an employee is not able to perform the normal functions of the job following the familiarization period or in the event that the employee does not wish to continue working in that position, he/she shall be returned to his or her former position, and rate of pay without loss of seniority. It is understood that employees who wish to return to their former positions must do so within sixty (60) days.
12.04 The Employer agrees that when posting a job, it will notify employees who are on layoff or vacation at the time of the posting where said posting carries a greater or equal hourly rate of such employees. Accessibility of the posting remotely via computer or phone would constitute notification.
12.05 The Employer agrees to provide the Union with a copy of all job postings. The Employer shall notify the Union Representative in writing of the name of the successful applicant who fills the posted job, and whether or not the successful applicant is the senior applicant.

If the vacancy is for a full-time job, then full-time employees within the seniority group shall be given preference when the applications are being considered. If the vacancy is for a part-time job, then the Company shall give preference to applications submitted by part-time employees. The awarding of the position(s) shall be done in accordance with the seniority provisions of this Agreement provided the employee has the qualifications, skills and abilities necessary to perform the position. A job posting shall include the duties of the job, any qualifications necessary, the classification, the wage rate applicable and the intended shift the position will be working, as well as the closing date for applications. The job shall be awarded within one (1) calendar month following the end of the posting period.

12.1 Selection Criteria
(a) All vacancies which are to be filled will be posted and filled within 30 days of becoming vacant in the case of entry level positions and 45 days in the case of other positions. Entry level positions are Inspector, Technician Trainee and Clerk I.
(b) Entry level positions will be filled by the senior qualified applicant. When a vacancy for a full-time position in any other classification occurs and is required to be filled, the Employer will prefer the senior employee, provided that merit, skills and ability are relatively equal.
(c) Where there are no qualified internal applicants, the Employer may select outside applicants.

Senior Qualified Applicant within the Seniority Block When a vacancy for a regular position or new position occurs and is required to be filled pursuant to Article 12.7, the Employer shall offer the position to employees in the following sequence: senior qualified regular within the series within the Block; senior qualified regular within the series all Blocks; senior qualified regular outside the series all Blocks; senior qualified auxiliary within the Block; senior qualified auxiliary all Blocks. PROMOTIONS, VACANCIES AND JOB POSTINGS. 12.1 Senior Qualified Applicant within the Seniority Block
(a) senior qualified regular employee in the classification series;
(b) senior qualified regular employee in another classification series. For the purpose of the Article 12, qualified means that an employee is fully qualified and capable of satisfactorily performing all required aspects of the vacant position. Employees who fill vacancies under this Article 12 will not be eligible for relocation expenses should the filling of such a vacancy result in the employee relocating.

12.1 Vacancy Filled by a Regular Employee in a Seniority Block When a vacancy for a regular position occurs and is required to be filled pursuant to Article 12.8, the Employer shall offer the position to employees within the seniority block in the following sequence:
(a) In the classification series, qualified regular employees starting with the most senior and then in descending order of seniority.
(b) In another classification series, qualified regular employees starting with the most senior and then in descending order of seniority.
PROMOTIONS, VACANCIES AND JOB POSTINGS. Union Observer The President of the Union or their designate may sit as an observer on a selection panel for posted positions in the bargaining unit. The observer shall be a disinterested party. This clause shall not apply to excluded positions. The observer must provide notice that they intend to be present at the interview. Notification Unsuccessful in-service applicants to posted positions will be notified, in writing, within fourteen (14) days of the decision of the name and classification of the successful applicant. A copy of the appointment letter shall be forwarded to the local union area office.
