Recognition and Exclusions. 2.01 The Employer recognizes the Union as the exclusive bargaining agent of all persons employed as Postdoctoral Fellows by Queen’s University at Kingston, in the Province of Ontario, save and except the following:
(a) persons who secure their own transferable funding from external grant- funding agencies and for whom this is the sole source of funding;
(b) supervisors and persons above the rank of supervisor;
(c) persons who hold appointments to the Academic Staff of the University as defined by the University’s Statement on Adjunct Academic Staff and Academic Assistants, unless such persons come within the Bargaining Unit independently of this status;
(d) persons who hold appointments to the General Support Staff of the University;
(e) persons employed as research assistants, research associates, research fellows, clinical fellows, clinical scholars, visiting scholars, visiting researchers and visiting faculty;
(f) voting members of the Board of Trustees;
(g) Employees for whom a trade union held bargaining rights on November 9, 2010;
(h) persons who exercise managerial functions or are employed in a confidential capacity in matters relating to labour relations within the
(i) members of the legal or medical profession employed in their professional capacity.

The Employer recognizes the Union as the sole collective bargaining representative for all meat cutters, apprentices, wrappers, butcher block sales persons and delicatessen employees, clean-up personnel, including part-time workers who work regularly one (1) day or more a week, employed by the Employer in the meat market or markets owned or operated by the Employer in the metropolitan area of Denver, Colorado (as such area as is shown on the map attached hereto and by this reference made a part hereof) but excluding all store managers, courtesy clerks, office and clerical employees, janitors, parking lot attendants, food clerks, warehouse employees, watchmen, guards and professional employees and supervisors as defined in the National Labor Relations Act, as amended, and all other employees. Within the geographical jurisdiction of this Agreement, any new stores opened by the Employer shall be accreted and shall be covered by the terms of this Agreement. Store Managers and Assistant Store Managers can perform all duties in the store. THIS AGREEMENT has been made and entered into by and between KING SOOPERS, INC., a Division of Xxxxxx Companies, Inc., hereinafter referred to as the "Employer," and UNITED FOOD AND COMMERCIAL WORKERS, LOCAL 7, chartered by the United Food and Commercial Workers International Union, AFL-CIO, hereinafter referred to as the "Union".

The bargaining unit includes: (a) all persons registered as students at Queen’s University, in the City of Kingston, in the Juris Doctor (JD) program or the Doctor of Medicine (MD) program, who are employed as Teaching Assistants at Queen’s University; and (b) as described in the certificate issued by the Ontario Labour Relations Board dated April 13, 2010, all persons registered as graduate students at and who are employed by Queen’s University, in the City of Kingston, as Teaching Assistants or Teaching Fellows, and (c) as described in the certificate issued by the Ontario Labour Relations Board dated February 16, 2017, all registered graduate students who are employed by Queen’s University, in the City of Kingston, as Research Assistants, save and except:
(a) supervisors and persons above the rank of supervisor;
(b) employees for whom another trade union held bargaining rights on the following dates;
(i) March 16, 2010 (Teaching Assistants and Teaching Fellows, including all persons registered in the JD or MD programs); and
(ii) April 23, 2014 (Research Assistants).
(c) persons who hold appointments to the Academic Staff of the University as defined by the University’s Statement on Adjunct Academic Staff and Academic Assistants;
(d) persons who hold appointments to the General Support Staff of the University;
(e) persons employed under Research, Xxxxx and Contract appointments (for certainty, this does not include registered graduate students employed by Queen’s University as Research Assistants);
(f) full voting members of the Board of Trustees; and
(g) members of the legal or medical profession employed in their professional capacity.
2.02 For clarity, a graduate student is performing bargaining unit work when they are assigned research duties and/or research tasks that are not directly related to the completion of their degree or program requirements.
2.03 Any policy, individual agreement or letter between the Employer and any particular individual(s), creating working conditions contrary to the provisions in this Collective Agreement, whether more favourable or less favourable, shall be null and void insofar as it affects such individual(s) who are in the Bargaining Unit, or if temporarily removed, once they return to the Bargaining Unit.

To this end, the Union shall provide the Employer, in writing, with the names and position titles of its Officers and the names and jurisdiction of its Stewards, including the person designated Chief Xxxxxxx, and the names of its Regional Representative and its Negotiator. Similarly, the Employer shall provide the Union, in writing, with the names and position titles of those responsible for liaison with the Union and with the names and position titles of departmental personnel responsible for coordination of TA or TF employment within a department.

Calendar Day - One sequential 24 hour period as denoted on a calendar, regardless of the day of the week.

Recognition and Exclusions. 1:01 The Company recognizes the Union as sole bargaining agent of all employees of Xxxxxxxx Spring-Kingsville Plant, at Kingsville, Ontario, save and except Foremen, persons above the rank of Foremen, office and sales staff.
1:02 The Company will negotiate at all times necessary in the manner provided herein with the chosen accredited representatives of the Union, for the purpose of determining any disputes which may now exist or which may arise as to wages, hours, working conditions or any other questions affecting the employees.

The Employer recognizes the Union as the sole collective bargaining representative for all employees actively engaged in the handling and selling of merchandise, including part-time workers who work regularly one (1) day or more a week, employed by the Employer in the grocery store or stores owned or operated by the Employer within the metropolitan area of Pueblo, Colorado (such jurisdiction to apply to current stores represented by this Union and future stores only of the Employer), but excluding all store managers, first assistant managers, associate managers, office and clerical employees, meat department employees, delicatessen department employees, demonstrators, watchmen, guards, professional employees and supervisors as defined in the National Labor Relations Act as amended. Within the geographical jurisdiction of this Agreement, any new stores opened by the Employer shall be accreted and shall be covered by the terms of this Agreement.
