RIGHTS AND RESPONSIBILITIES OF THE BOARD. A. The Board retains all the rights, powers and authority exercised or had by it prior to the date hereof, except as specifically limited by express provisions of this Agreement.
B. This Agreement constitutes the sole and entire existing agreement between the parties and supersedes all prior practices, whether oral or written, and expresses all obligations of, and restrictions imposed on, the District and the Association except as provided by law.
C. Copies of this Agreement shall be prepared at the expense of the Board and presented to all food service employees now employed or hereafter employed by the Board during the term of this Agreement.
D. The Board agrees not to negotiate with any other food service employee organization other than the Association for the duration of this Agreement.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. A. There is reserved exclusively to the Board all responsibilities, powers, rights and authority vested in it by the laws and constitution of Michigan and the United States or which have been heretofore properly exercised by it, excepting where expressly and in specific terms limited by the provisions of this Agreement.
B. It is agreed that the Board retains the rights, among others, to establish and equitably enforce reasonable rules and personnel policies relating to the duties and responsibilities of teachers and their working conditions which are not inconsistent with the provisions of the Agreement or violation of law. Board policies shall be made available for review online and through the building administrator. The Board agrees, however, to negotiate any changes in personnel policies related to hours, wages and working conditions of teachers.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. Section 1. The Organization recognizes that the Board is the legally constituted body responsible for the management, direction and control of all of the public schools of the Indian Hill Exempted Village School District and of all personnel employed by the Board, and for the determination of all resolutions, policies, practices, procedures, guidelines, rules and regulations governing any and all aspects of the Board’s school district.
Section 2. The Organization recognizes, without limitation, that all rights, powers, functions, responsibilities and authority of the Board existing before the execution of this Agreement, including those set forth in Section 1 above, and the following enumerated rights, the exercise of which rights shall not be subject to the grievance and arbitration procedures of Article IV, are specifically retained by the Board as sole and exclusive rights, except as they may be expressly and specifically modified by an express term of this agreement; (a) to determine matters of inherent managerial policy, which include, but are not limited to, areas of discretion or policy such as the functions and programs of the District, standards of services, the Board’s overall budget, utilization of technology, and organizational structure; (b) to direct, supervise, evaluate or hire employees; (c) to maintain and improve the efficiency and effectiveness of the District; (d) to determine the overall methods, process, means, or personnel by which the operations of the District are to be conducted; (e) to suspend, discipline, demote, or discharge for just cause, or layoff, transfer, assign, schedule, promote, or retain employees; (f) to determine the adequacy of the work force; (g) to determine the overall mission of the District; (h) to effectively manage the work force; and (i) to take actions to carry out the mission of the District.
Section 3. It also is specifically acknowledged by the Organization that those rights, powers, functions, responsibilities and authorities of the Board contained in Sections 1 and 2 herein, and the use of judgment and discretion therewith, shall belong solely and exclusively to the Board during the term of this Agreement, except as may be expressly and specifically modified by an express term of this Agreement. The Organization recognizes the Board’s sole and exclusive
RIGHTS AND RESPONSIBILITIES OF THE BOARD. A. The Board has responsibility and authority for direction and management, on behalf of the public and the State of Montana, of all the operations, personnel, and activities of the District.
B. By its own decision, the Board agrees to the terms of this Agreement, but in entering into this Agreement the Board does not and cannot divest itself of its policy-making power to make the final decision in any situation, which falls beyond the terms of this Agreement.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. A. Except as modified by the specific terms of this Agreement, the Board retains all rights and powers to manage the Madison School District and to direct its employees. The Association recognizes such management rights and responsibilities, as conferred by the laws and Constitution of the State of Michigan, and inherent in these responsibilities to manage a public school system, include the right:
1. To the executive management and administrative control of the school system and its properties, facilities, financial resources and the activities of its employees during employee working hours;
2. To hire all employees and, subject to the provisions of law, to determine their qualifications and the conditions for their continued employment, or their dismissal or demotion, and to promote, and transfer all such employees;
3. To establish levels and courses of instruction, including special programs, and to provide for athletic, recreational and social events for students, all as deemed necessary or advisable by the Board;
4. To decide upon the basic means and reasonable methods of instruction, the selection of textbooks and other teaching materials, and the use of teaching aids of every kind and nature. The exercise of the foregoing powers, rights, authority, duties and responsibilities by the Board; the adoption of policies, rules regulations and practices in furtherance thereof; and the use of judgment and discretion in connection therewith; shall be limited only by the specific and express terms hereof that are in conformance with the Constitution and laws of the State of Michigan and the laws and Constitution of the United States.
B. Nothing in this Agreement shall be construed to limit the powers and responsibilities conferred upon the Board of Education or the Superintendent under the laws or Constitution of the State of Michigan. Specifically, the rights and responsibilities as conferred under the General School Laws and the Tenure Act, are preserved.
C. The Board will attempt to prevent children from involvement in Association/Board controversies.
D. If, in the event, a teacher is not continued in employment by the Board of Education, the Board will advise the teacher of the reason(s) in writing upon request.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. 2.1 Except as may be expressly limited by some express term of this Agreement, the Board retains full right and responsibility to make all decisions with regard to all aspects of its operations, employment and employees including, but not limited to, those matters set forth in Ohio Revised Code Section 4117.08 (C) (1) through (9).
2.2 Such right and responsibility of the Board shall include the retention or enactment of policies and procedures not contradicting any express term of this Agreement. The Union may, through the Superintendent, raise questions it may have with regard to such policies and procedures, but the same may not be made the subject of the grievance and arbitration provisions.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. The Board, on its own behalf and on the behalf of the electors of the District, hereby retains and reserves unto itself, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it by the laws and the Constitution of the State of Illinois and the United States, including, but not limited to, the rights of the School Boards as provided for in the Illinois School Code (Illinois Revised Statues). These rights shall include by way of example, but are not limited to the following:
A. To provide for the executive management and administrative control of the school system and its properties and facilities and the District activities of its employees;
B. To hire all employees, subject to the provisions of law, to determine their qualifications, and the condition for their continued employment, or their dismissal or demotion.
C. To establish grades and courses of instruction, including special programs, and to provide for athletic, recreational, and social events for students, all deemed necessary and advisable by the Board;
D. To determine upon the means and general methods of student instruction and the selection of textbooks and other district-wide instructional programs including any teaching aids incident to such instructional programs;
E. To determine class schedule, student starting and dismissal times, the hours of student instruction, and the duties, responsibilities, and assignments of teachers and the assignment of other District employees as relates to bargaining unit members, and the non-teaching activities of bargaining unit members within the scope of their employment for the District; and
F. The Board may adopt rules and regulations not in conflict with the terms of this AGREEMENT governing the conduct of teachers provided that any rules and regulations, which affect wages and hours, must be negotiated. Nothing contained herein shall be considered to deny or restrict the Board of its rights, responsibility, and authority under the Illinois General School Laws or any other national, state, county, district, or local laws or regulations as they pertain to education. No action, statement, agreement, settlement, or representation made by any member of the bargaining unit shall impose any monetary obligation or be considered to be authorized by or binding upon the Board unless and until the Board has agreed thereto in writing. RIGHTS AND RESPONSIBILITIES OF THE BOARD. 1. All rights that ordinarily are vested in the Board, except those relinquished by the Board in this agreement shall continue to be vested in and exercised by the Board in order to fulfill its responsibilities to the district.
2. Any portion of this negotiated agreement that is contrary to the law or any action pursuant thereof which is contrary to law shall be null and void, but the remainder of the contract shall remain in full force and effect. Illegal portions may be renegotiated by mutual agreement of both parties.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. The parties agree that all rights and responsibilities of the Board which have not been addressed by this Agreement are retained in the sole discretion of the Board.
RIGHTS AND RESPONSIBILITIES OF THE BOARD. 2.01: The Board retains and reserves unto itself without limitation, all powers, rights, authority, duties, and responsibilities conferred on and vested in it by the laws and Constitutions of Michigan and the United States, including but without limiting the generality of the foregoing the right to:
