Sick Leave and Business Leave. A. Sick Leave 1. Each teacher is allowed twelve (12) days per year at full pay for absence for personal illness of the teacher or any other approved reason by the Negaunee Board of Education or designee. Any past actions or future actions of the Board due to approved reasons for extenuating circumstances has not or will not establish a precedent. 2. These days shall be accumulative. The twelve (12) days per school year shall be prorated for less than full-time teachers. While sick leave days will accrue at the rate of one day for every 15 days paid (not to exceed twelve (12) days per year), teachers may draw against expected accrual for the school year. Should the teacher's active employment with the District cease at any time during the school year the teacher will reimburse the District for any sick days used in excess of those accrued. The teacher, by use of such sick leave prior to accrual, authorizes (without limitation upon other collection remedies available to the District) payroll deduction for recovery of such amount should other mutually satisfactory arrangements not be made. 3. When total accumulated days are used, teachers will receive an additional total of 30 days at one-half (1/2) their daily pay rate. This provision may be used only one (1) time as an employee of the Negaunee School District. Full seniority will accrue during this period. 4. If an employee is not sick but a serious emergency exists in the employee's immediate family (husband, wife, children* and mother or father or if there is a member of the household for which the teacher bears the direct and continuing responsibility and if there is no one else available to take charge), the following may apply: Up to five (5) days with full pay charged to the employee's sick leave will be granted with the approval of the Superintendent. Sick Leave and Business Leave. A. All employees covered by this Agreement shall receive a minimum of ten (10) sick days per year, at the rate of one (1) day per month. B. An employee who is unable to work because of personal illness, and who has exhausted all sick leave available, shall be granted an unpaid leave equal to the weeks worked in the school year. 1. On the termination of the above leave, the employee shall be returned to the job which he/she held prior to such leave, or if the position has been eliminated, to a position of equal status for which they have seniority. C. Any employee who is absent from duty because of an injury or illness compensable under the Michigan Workers' Compensation Act shall receive from the District the difference between the allowance under the Workers' Compensation Law and his regular salary until his/her accumulated sick leave is exhausted. The employee will only be charged for sick days on a prorated basis. D. Paid sick leave is provided to employees to alleviate financial stress while the employee suffers from illness which is beyond his control. The Board may withhold payment whenever they have evidence of abuse in sick leave. E. Each year, Bargaining Unit Members shall be allowed up to two (2) days for personal business leave. These days shall be used to transact business, or to attend to affairs which cannot be conducted outside the regular school day, or on the weekend or during vacation and summer months. These days may also be used for “inclement weather” days that do not count toward the state required instructional days. Personal business requests shall be made in writing at least two (2) school days in advance, except in case of emergencies. Personal business leave shall not be granted for vacation or recreational activities, hunting, fishing or moonlighting. Unused personal business days shall be added to accumulated sick leave at the end of each year. F. Employees who have exhausted their paid leave time in the appropriate category (sick, personal, etc.) and take an unpaid day will have that week’s check docked. The employer shall deduct from the employee’s current pay the cost of one day’s benefit for each day missed. G. Excessive unpaid absences are not acceptable, even for reason such as illness, except days as defined by FMLA.   • Vacations and Sick Leave The Executive shall be entitled to paid annual vacation leave in accordance with the policies as established from time to time by the Board of Directors, which shall in no event be less than four weeks per annum. The Executive shall also be entitled to an annual sick leave benefit as established by the Board for senior management employees of the Bank.   • Industrial Accident and Illness Leave For accidents or illnesses that are job- incurred, unit members shall be provided leave benefits under the following provisions: 12.6.1 Allowable leave shall be sixty (60) days during which the colleges of the District are required to be in session or when the unit member would otherwise have been performing work for the District in any one fiscal year for the same accident. 12.6.2 Allowable leave shall not be accumulated from year to year. 12.6.3 Industrial accident or illness leave shall commence on the first (1st) day of absence. 12.6.4 When a faculty member is absent from his/her duties on account of an industrial accident or illness, he/she shall be paid such portion of the salary due him/her for any month in which the absence occurs as, when added to his/her temporary disability indemnity under Division 4 or Division 4.5 (commencing with Section 6100) of the Labor Code, will result in a payment to him/her of not more than his/her full salary. The phrase, "full salary," as utilized in this section, shall be computed so that it shall not be less than the unit member's "average weekly earnings" as that phrase is utilized in Section 4453 of the Labor Code. For purposes of this section, however, the maximum and minimum average weekly earnings set forth in Section 4453 of the Labor Code shall otherwise not be deemed applicable. 12.6.5 Industrial accident or illness leave shall be reduced by one (1) day for each day of authorized absence regardless of a temporary disability indemnity award. 12.6.6 When an industrial accident or illness leave overlaps into the next fiscal year, the unit member shall be entitled to only the amount of unused industrial accident or illness leave due him/her for the same illness or injury. 12.6.7 Upon termination of the industrial accident or illness leave, the unit member shall be entitled to the benefits provided in Education Code Sections 87780, 87781 and 87786, and for the purposes of each of these sections his/her absence shall be deemed to have commenced on the date of termination for the industrial accident or illness leave, provided that if the unit member continues to receive temporary dis- ability indemnity, he/she may elect to take as much of his/her accumulated sick leave which, when added to his/her temporary disability indemnity, will result in a payment to him/her of not more than his/her full salary. 12.6.8 During any paid leave of absence, the unit member may endorse to the District the temporary disability indemnity checks received on account of his/her industrial accident or illness. The District, in turn, shall issue the unit member appropriate salary warrants for payment of the unit member's salary, and shall deduct normal retirement, other authorized contributions, and the temporary disability indemnity, if any, actually paid to, and retained by, the employee for periods covered by such salary warrants. 12.6.9 Any unit member receiving benefits as a result of this section shall, during periods of injury or illness, remain within the State of California, unless the Governing Board authorizes travel outside the state. 12.6.10 When all available leaves of absence have been exhausted and the unit member is not medically able to return to all the duties of his/her prior assignment, the District shall provide first (1st) priority in assigning such a person into classes where his/her disability, in the discretion of the District, does not hinder the performance of the duties required of him/her if he/she is otherwise qualified. With mutual agreement with the unit member, the District may also assign an employee into a position that can reasonably accommodate his/her performance of duties required by the position, despite his/her disability, prior to the exhaustion of leave of absence.

  • Sick Leave Use An employee shall be granted sick leave with pay to the extent of the employee's accumulation for absences necessitated by the following conditions:

  • Vacation; Sick Leave During the Employment Term, the Executive shall be entitled to not less than four (4) weeks of vacation during each calendar year and sick leave in accordance with the Company’s policies and practices with respect to its executives.

In order to receive this allowance, the employee must provide to the Employer proof of application and eligibility to receive employment insurance benefits pursuant to the Employment Insurance Act. An employee disentitled or disqualified from receiving employment insurance benefits is not eligible for parental leave allowance. (b) Pursuant to the Supplemental Employment Benefit (SEB) Plan and subject to leave apportionment pursuant to Article 35.03(b), the parental leave allowance will consist of a maximum of ten (10) weekly payments, equivalent to the difference between the employment insurance gross benefits and any other earnings received by the employee, and seventy-five (75) percent of the employee’s basic pay.

  • Sick Leave 1. Employees will be granted one (1) day for each month of their contract year. The days granted will be available as of the first official day of the school year or the contract, whichever is applicable. 2. Sick leave may be accrued to the amount earned which shall be shown on each salary check. 3. The Board may require proof of illness whenever there is reasonable cause to believe that an absence is not due to a bona fide illness. 4. Days of accrued sick leave may be used to assist in the health care of persons who live in the employee's household, or to care for a parent, spouse, or a child regardless of their residence or for other relatives requested in writing and approved by the Superintendent/Designee prior to the leave. The Board may require proof of illness under the same requirements as the employee’s illness. 5. The absences in excess of available sick leave, deductions from salary shall be at the rate of 1/182 for Food Services Employees and 1/189 for Food Services Managers in excess of the number provided. 6. Employees hired prior to July 1, 1997: Employee will be paid for unused sick days in the following manner: a. Payment for unused sick days will be made to the employee upon that employee’s early or full service retirement or, upon the employee’s death, to the employee’s estate. Employees eligible for early or full service retirement who resign from employment and do not receive a retirement benefit, shall forfeit all rights to payment for unused sick days. b. Employees, who have a balance of less than 250 unused sick days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to a maximum of 250 unused days at their average daily rate*. c. Employees who have a balance of unused sick days greater then 250 days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to their June 30, 2002, unused sick leave balance, at their average daily rate*. d. Payments for unused sick days in amounts greater than $5,000 will be paid in equal amounts over five consecutive years beginning with the year of retirement. e. Payments for unused sick days in the amount at $5,000 or less or for the death of an employee will be paid in a lump sum to the employee or the employee’s estate in the year of retirement or death.
