TEACHER PERSONNEL FILES. 14-1 There are two (2) personnel files maintained on each teacher: one is kept at the central office and one is kept at the school location. These files shall not include the principal's "log." This "log" shall be maintained solely for the principal's own personal use and shall not be used as a personnel file. A copy of each written report, comment, reprimand, or any other document concerning a teacher which the School District places in either of the two (2) personnel files shall be provided to that teacher. The teacher shall sign the file copy of the written report, comment, reprimand, or any other document as acknowledgment of receipt of a copy of the document. Such signature shall not be construed as agreement to the contents of the document. 14-2 Any written response by the employee to any written report, comment, reprimand, or other document as provided for in Article 14-1 above shall also become a part of that employee's personnel file and shall remain a part of said file as long as the written report, comment, reprimand, or other document responded to remains a part of the file. All copies of the employee's response will be countersigned by the receiving administrator or designee, and a copy of the response shall be attached to the supervisor's document. When an employee makes a written response to any written report, comment, reprimand, or any other document, the employee's response shall be made within thirty (30) school days, except in cases where a document is the subject of a grievance or is a suspension, and shall be attached to the supervisor's document. The thirty- day (30-day) timeline to respond to documents that are the subject of a grievance and/or suspension shall begin upon the completion of the grievance and/or suspension appeal process. Upon written request of the teacher, a waiver of the time limits by the supervisor, not to exceed ten (10) days, shall not be unreasonably withheld. When a copy of the supervisor's written document is forwarded to any other location, a copy of the employee's written response shall be attached. 14-3 Written reports, written comments, written reprimands, or other documents of School District origin, in the possession of the District, or to which the District has access, which have not been called to the teacher's attention in writing shall not be used to adversely affect the continued employment, transfer, salary, or assignment to extra pay for extra duty assignments. 14-3-1 Any observation, incident, ...

TEACHER PERSONNEL FILES. A. 1 A teacher shall receive copies of any material which will have an effect on the teacher’s evaluation placed in his or her file and the teacher shall sign a document indicating that he or she has had an opportunity to review the material. Such a signature shall only indicate that the teacher has seen the material and does not indicate agreement with the contents of such material being filed. A teacher shall have the right to write a written response to such material and request that it be attached. A. 2 Any material removed from a teacher’s file, except as provided in Article Fifteen.B.2 and B.3, shall be replaced by a written dated notice stating what material was removed. A. 3 Access to a teacher’s personnel file shall be limited to the teacher, the administration (defined as the Superintendent of Schools, the Assistant Superintendent of Schools, the building principal and/or the appropriate director for the teacher) and the members of the school board or the teacher’s designated representatives. Upon reasonable notice, a teacher shall be able to review and make copies of documents contained therein, provided that pre-employment confidential references shall be excluded.
TEACHER PERSONNEL FILES. A. Teacher personnel files shall be housed and maintained in strict compliance with all appropriate California law. B. All personnel files shall be housed in the District Office. They shall be available for inspection, during working hours, by the teacher and/or the teacher’s representative, with signed authorization from the teacher. (See Appendix K Personnel File Authorization Form) C. All personnel files shall be regarded as confidential, and access shall be limited to such officials as are mandated or permitted by law on a need-to-know basis. A log shall be maintained in each primary file for the purpose of controlling and documenting access. D. Derogatory information shall not be introduced into a teacher’s personnel file until the teacher has been given a copy of the material and a reasonable opportunity to sign and date an acknowledgment that it is going into the file. In the event a teacher shall refuse to sign such an acknowledgment, a third person shall sign and date his/her witnessing of said refusal. A reasonable opportunity shall be given to the teacher to prepare a written response. E. Teachers shall have the right to petition the superintendent to have negative and/or derogatory materials in their personnel files permanently sealed after such materials have been on file for four (4) or more years. No materials which can be demonstrated to be erroneous or inaccurate shall be placed in an employee’s personnel file. F. In the case of written parental complaints, no District action, including placement of the written parental complaint in the personnel file, shall be taken against the teacher unless the teacher involved has the opportunity to rebut the charges. G. Confidentiality of medical records: All information obtained by the District in its administration of its partially self-funded insurance program is to be kept in strictest confidence and cannot be utilized as the basis for any job-related decisions made by the District without the knowledge and consent of the teacher.

Each teacher's personnel file shall contain the following minimum items of information: Required medical information as supplied by the teacher, all teacher evaluation reports as supplied by the building principal, a copy of the current annual contract and pay record as supplied by the Board, a copy of the teacher's certificate as supplied by the teacher, a transcript of academic records as supplied by the teacher, and tenure recommendations as supplied by the principal. B. Letters from parents, newspaper clippings, and records of phone calls shall not be placed in the teacher's file without the teacher's knowledge and opportunity to respond thereto. For purposes of this paragraph, materials will be removed from the personnel file after a period of one (1) year, provided that the teacher so involved requests the removal. C. Documents with the exception of confidential credentials and recommendations submitted for the purpose of employment shall not be placed in the teacher's file without the teacher's knowledge and opportunity to respond thereto. X. Xxxxx-hired teachers or teachers who have a change in their certificate must file their valid certificate and their official transcript of credits with the Human Resources Department by September 15th. Failure to file the certificate or official transcript shall result in withholding of pay until such filing has been completed. Further, all newly employed secondary teachers shall provide the building principal with an official copy of their transcript.
