(2) If a Sioux Valley Dakota Nation Law made under (1) is inconsistent with any applicable federal or provincial law, then the federal or provincial law prevails to the extent of the inconsistency. 26.02 Laws about local public transportation systems (1) Sioux Valley Dakota Nation has Jurisdiction in relation to local public transportation systems operating entirely within Sioux Valley Dakota Nation Lands. Traffic and Transportation. 8.1 Consistent with the Event Plan and in consultation with the Authority, the City shall coordinate with members of the Intergovernmental Task Force and/or other Governmental Authorities having relevant jurisdiction to prepare a plan describing a safe, reliable and efficient traffic and transportation scheme to facilitate the movement of up to an estimated 200,000 visitors on any one day to and from the Event (the “People Plan”). The People Plan shall be submitted for approval by the Authority no later than March 31, 2011. Once so approved, no change shall be made to the approved People Plan except with the Authority’s and the City’s consent. The City shall implement the People Plan at no cost to the Authority, except with respect to those Venue areas which are under the Authority’s exclusive control and not accessible to members of the public. 8.2 The People Plan shall provide: (a) Guaranteed access to the Venues in accordance with the Space Plan before, during and after the Event for the Authority, the Authority Affiliates, Competitors, Event Sponsors, the media and others together with their equipment. In the event the People Plan includes traffic restrictions, driving permits permitting access to the restricted areas shall be issued as necessary upon the Authority’s request; (b) An effective public transportation service to the public areas including the on-shore Venue and the on-the-water Spectator Areas during the Event, such service to be commensurate with the expected numbers of visitors; (c) Parking spaces in and around the Venue as provided in the Space Plan for the Authority, the Authority Affiliates, Competitors, the media, the Event Sponsors and hospitality guests; (d) Public parking lots and facilities as provided in the Space Plan which may also include, if public transportation alternatives are deemed inadequate to transport spectators from the parking facilities to the on shore spectator areas, the additional operation of a shuttle service; and (e) An appropriate information and sign-posting system in and around the City and, in particular, on main accesses from highways, main entrance roads, airports and public transit stations, which shall be part of the mutually agreed upon Advertising Program under Section 10.2.

Traffic and Transportation. Xxxx & Peers will prepare the transportation impact analysis section of the EIR. Since the Project itself does not actually generate trips and therefore would not cause transportation impacts after it is built, the transportation analysis will assess only the effects of construction on the transportation network. Work will also involve developing detour routes for pedestrian and bicycle facilities that may be temporarily obstructed during construction, such as the Bay Trail, which sits upon the levee. One optional task is included under Data Collection below, to allow for adequate baseline data collection dependent on what data is currently available from the City. The proposed scope of work is summarized below: The City will provide Xxxx & Peers with information regarding the construction plan for the levee project. Data will include an estimate of the anticipated number of daily trucks, typical hours of construction activity, the general origins and destinations of the trucks, and the construction phasing plan. Existing conditions will be described in terms of Average Daily Traffic (ADT) volumes and previously conducted intersection level of service (LOS) analysis. We assume the City of Xxxxxx City will provide ADT counts on City arterials and collectors for use in describing the existing conditions in the study area. Xxxx & Peers will compile peak hour intersection operations analyses from recent studies conducted in the City. Xxxx & Peers will conduct a site visit to confirm that the collected ADT data and intersection operations analyses match conditions on the ground and identify congested locations not reflected in the ADT data or intersection analysis. Xxxx & Peers will also conduct detailed observations along the portions of the Bay Trail anticipated to be affected by the Project, examining Trail access, conditions on the Trail, and conditions on surrounding roads. Xxxx & Peers will identify the Bay Trail closures during each construction phase and recommend detours to maintain connectivity and safety for the trail users. Traffic and Transportation. The Tribe will install improvements to the intersections of State Route 128 at the Xxxxx Property entrance in conformance with Caltrans construction standards (“Intersection Improvement”), if the rights and approvals necessary to make such improvements are obtained. Improvements will include acceleration lanes, deceleration lanes, and a left-turn pocket to the BIA 93 and the Xxxxx Property. These improvements will be installed at the earliest feasible date, subject to Caltrans approval, and the Tribe will make good faith efforts to obtain all approvals, permits and easements necessary for the construction of such improvements. The cost of such improvements, which will be constructed at the Tribe’s sole expense. The Tribe will not be required to make the improvements where State Route 128 Intersects the Xxxxx Property entrance if the Tribe obtains another emergency access road to the existing Reservation. However, any emergency vehicle access point, if other than on the Xxxxx Property, will have an equivalent level of intersection improvements as agreed above.

Sunday Creek Road provides access from Highway 881 to Xxxxx Road, and Xxxxx Road provides access to the Project. In addition, Xxxxx Road provides access to Xxxxx Aerodrome, which will be used for transporting workers for Devon’s Pike 1 Project (the Project) and Jackfish operations, as well as third parties that operate in the area and use the aerodrome. Third-party usage agreements are in place between Devon and third parties such as Cenovus, Harvest, MEG and CNRL for Sunday Creek Road, Xxxxx Road and Xxxxx Aerodrome.
