Utilization for Illness or Injury. An employee may utilize allowance for accrued sick leave when unable to perform their work duties by reason of illness, bodily injury or disability due to pregnancy, reasonable medical or dental care, or exposure to contagious disease(s). In such event, the employee shall notify their immediate supervisor or the on-duty supervisor of absence of same. The employee shall also state the nature and expected length thereof, as soon as possible prior to the beginning of his/her regularly scheduled work shift, unless unable to do so because of the urgency of the circumstances. If a supervisor is unavailable, a message may be left with dispatch. In addition, sick leave may be used for necessary medical and dental care that cannot be scheduled during the employee's off-duty time. The employee shall give as much notice as possible to the supervisor of the need for the use of sick leave for the pre-scheduled appointment. The Employer may, at its option, reasonably require a physician's statement of the nature and the need for the employee's absence and an estimated duration of the absence for any circumstance which causes an employee absence in excess of three (3) days or at any time if the Employer believes the employee may be abusing the sick leave privilege. If the Employer requires a physician's statement, the cost of obtaining the statement shall be paid for in one of the following ways:

Utilization for Illness or Injury. Employees may utilize their allowance for sick leave when unable to perform their work duties by reason of illness or injury. In such event, the employee shall notify the department head or other supervisor of absence due to illness or injury, and the nature and expected length thereof, as soon as possible prior to the beginning of his/her scheduled regular work shift, unless unable to do so because of the serious nature of injury or illness. A physician's statement of the nature and identity of the illness, the need for the employee's absence and the estimated duration of the absence, may be required at the option of the City for absences of over two (2) days prior to payment of any sick leave benefits or prior to allowing the employee to return to work. A physician's statement may be required as a prerequisite to payment of sick leave for less than three (3) days if the employee has been advised in advance of such requirement.

A maximum of forty-eight (48) hours sick leave per calendar year may also be used when the employees absence is needed to care for an ill or injured immediate family member as defined by the Oregon Family Leave Act. If the Fire Chief has reason to believe sick leave is being abused, a physician’s statement may be required as a prerequisite to payment of sick leave for one shift (two work days for forty hour personnel), provided the employee has been advised in advance of this requirement. In the event of the latter requirement, the City shall bear the cost of sending the employee to a physician designated by the City or to a physician mutually agreed upon by the employee and the City. In emergency cases, employees may be granted sick leave for doctor or dental appointments, if approved by the Fire Chief.
Utilization for Illness or Injury. Sick leave may be utilized when a nurse is unable to perform their work duties by reason of illness or injury. The nurse shall notify the Public Health Director, Nursing Supervisor, or designated person, of an absence due to illness or injury the nature, and the expected length as soon as possible within at least one-half (1/2) hour before the beginning of that individual's scheduled work day, unless unable to do so because of serious injury or illness. A healthcare provider's statement of the nature and identity of the illness, the need for the nurse's absence, and the estimated duration of the absence, may be required at the option of the Public Health Director or County Human Resources Department for absences of three days. However, a health care provider's statement may be required after one day's absence, in the case of an injury or surgery.

Department supervisors may authorize the use of sick leave with less than 24 hours’ notice to accommodate a change in a previously approved appointment provided department needs are not affected.

In such event, the employee shall notify the Police Chief or other supervisor of absence due to illness or injury, the nature and expected length thereof, as soon as possible prior to the beginning of their scheduled regular work shift, unless unable to do so because of the nature of injury or illness. Employees are encouraged to schedule routine medical and dental appointments outside their regularly scheduled working hours, whenever possible. In the event such appointments must be scheduled during an employee’s scheduled shift, every effort must be made by that employee to give the Department at least twenty-four (24) hours advance notice. The City may require an employee to submit certification by a physician or health care professional or other acceptable verification of the reason for utilization of sick leave as a precondition to payment of sick leave whenever the employee’s absence exceeds three (3) consecutive workdays or whenever the City can articulate a good faith concern (e.g. questionable patterns of usage, etc.) regarding the employee’s eligibility to receive sick leave. For the purpose of this section and the following sections of this Article, pregnancy shall be treated as any other illness or disability. An employee may be granted up to twelve (12) weeks, per calendar year, paid sick leave for the employee to care for an ill or injured family member and for other OFLA qualifying purposes in accordance with OFLA. For the purpose of this Section family member includes: spouse, children (including step-children and xxxxxx children), parent, parent-in-law, grandchildren, grandparents, “domestic partner” as defined in Section 16.1 and the children, grandchildren and grandparents of such domestic partners.
