Weekends and public holidays. 13.1 The Company may request that Employees work on a weekend or public holiday. Employees will not unreasonably refuse that request. 13.2 For the purposes of this clause public holidays are: • New Year’s Day; • Australia Day; • Good Friday; • Easter Saturday; • Easter Monday; • Easter Tuesday; • Anzac Day; • Queen’s Birthday; • Labour Day; • Christmas Day; • (Boxing Day; • Where another day is generally observed in a locality in substitute for any of the above days, that day shall be observed as the public holiday in lieu of the prescribed day, and any other day declared under a law of New South Wales as a public holiday that applies throughout New South Wales, other than a day declared by or under (or determined in accordance with a procedure under) a law of New South Wales to be observed as a public holiday in substitution for any of the days listed in this clause.

If planned work is necessary on these days, the Operations Co-ordinator will approve it in advance, notify the employees concerned and will verify the hours and work to be undertaken before any work is commenced or associated payments are made. All employees are expected when asked or where they have been rostered on, to make themselves available to work to meet the needs of the business on weekends and public holidays in respect of both planned and unplanned work. Where possible, volunteers will be called for weekends and public holidays. Where insufficient volunteers are available, the Team Leaders will roster Operators to undertake this work. All work on weekends, public holidays (other than Christmas Day and Good Friday) and additional overtime as per sub clause 9.3 of this agreement will be paid for at the overtime rate in Appendix 1. Shift loading is not paid on overtime. Work on Christmas Day and Good Friday will be paid at the rate of 3 times the hourly rate for the number of hours worked. The hourly rate is calculated by taking the equivalent annualised day shift salary payable to the employee concerned having regard to the level of classification of that employee divided by annualised hours. Shift loading does not apply for the purposes of overtime, weekends or public holidays. In the event that work planned for weekends or a public holiday cannot be undertaken for some reason, for example, inclement weather, the Operations Co-ordinator may plan alternate work for those affected. This will apply particularly to those working on ships and to those writing permits. For the purpose of this clause, a weekend is deemed to start at 23:00 hours Friday (that is, at the end of the afternoon shift) and will end at 06:20 hours Monday morning (that is, at the commencement of the day shift). Public holidays will be those days gazetted by the Queensland State Government as a public holiday for Brisbane.
