Acting Administrators i) The Board may assign to a Teacher the duties of an Administrator (Principal/Vice- Principal) for a temporary period of time not to exceed the balance of the school year in which the assignment is made.
ii) No Teacher shall be assigned without his/her consent.
iii) Acceptance by the Teacher of such duties on a temporary basis shall not interrupt the Teacher's accumulation of seniority rights or credit for experience under the provisions of this Collective Agreement or his/her membership in the Unit.
iv) All provisions of the Collective Agreement shall apply to the Teacher during the term of the assignment.
v) The assigned Teacher shall not participate in the evaluation or disciplining of Teachers including Occasional Teachers.
vi) An assigned Teacher shall be replaced by an Occasional Teacher for the duration of the assignment.
Acting Administrators. Acting administrators (teachers) are to receive their regular teacher's salary, a substitute if acting for the building administrator for one-half (l/2) day or more, plus up to five (5) compensatory days time for time served in this capacity.
Acting Administrators. Compensation
4.3.1. When, in the absence of the principal, the vice-principal acts in the principal’s place for a period of five (5) or more consecutive days, the vice-principal shall assume the position of acting principal and shall receive an allowance equivalent to that of the principal for the period from and including the sixth (6) day until the return of the regular principal.
4.3.2. In the absence of the principal from a school where there is no vice-principal or in the absence of both the principal and vice-principal(s) from a school, a teacher shall be designated by the School Division to be acting principal and shall be paid:
4.3.2.1. Twenty five per cent (25%) of one two hundredth (1/200) of the principal’s allowance on each of the first (1), second (2), and third
Acting Administrators. 27.01 No teacher shall be a teacher-in-charge or acting principal or vice-principal.
27.02 Notwithstanding Article 27.01, a teacher may serve as an acting principal or vice-principal (Acting Administrator) provided that the position has a term of not less than ten (10) consecutive working days and not exceeding 194 consecutive working days. Any teacher accepting such a position will be removed from the Bargaining Unit for the duration of the appointment and therefore no OSSTF fees will be deducted and remitted. There shall be no entitlements to any part of this Collective Agreement for the duration of the appointment.
27.03 The teacher shall be entitled to return to the Bargaining Unit to the teacher’s former position, subject to the provisions of Article 22, provided that the teacher’s term as acting principal or vice-principal does not exceed 194 consecutive working days. It is understood that should the appointment commence in second semester and continue into the first semester of the subsequent school year, that the summer break shall not constitute a break in the consecutive days, but only days worked during the summer break will be accrued against the maximum of 194 days.
27.04 A teacher returning to the Bargaining Unit under Article 27.03 shall have reinstated all accumulated seniority from the Bargaining Unit up to the date of commencement of the acting principal/vice-principal position.
27.05 The teaching position vacancy resulting from the appointment of an acting principal/vice-principal shall be filled by a teacher or an Occasional teacher in accordance with the Education Act and Regulations and the provisions of this Collective Agreement.
Acting Administrators a. A bargaining unit member appointed as an acting administrator shall serve in that capacity for a reasonable amount of time to permit the Board to exercise its selection process.
b. The superintendent shall make an effort to fill the position with a permanent appointment within a six (6) month time frame.
d. If no candidate is selected the Superintendent, after discussion with the BAA, will repost the position.
Acting Administrators. 1. The parties agree that the following options are available to the Board when filling a temporarily vacant Administrative position:
a. Reassigning present administrative personnel;
b. Appointing an Acting Administrator from within the bargaining unit.
2. When an Acting Administrator is appointed the following conditions will apply:
a. The Acting Administrator will remain within the bargaining unit and will be covered by all the terms and conditions of this contract;
b. The Acting Administrator shall assume all duties of the Administrative position except teacher evaluation and teacher discipline;
c. The term of the appointment will normally terminate at the end of a term or semester but may be extended through mutual agreement of the Superintendent, the Acting Administrator and the Union;
d. Acting Administrators shall be paid 1/250 of the A.O.'s salary who is being replaced.
i. A replacement-teacher shall be provided for the Acting Administrator where appropriate.
Acting Administrators. All unit members who agree to work in a vacant administrative position may do so for one (1) school year. As on any unpaid leave of absence, he/she will not lose or accrue any seniority within the bargaining unit. The teacher in the acting position will not evaluate any unit members unless trained according to the Wilmington Performance Standards Document.
Acting Administrators. Teacher In‐Charge
35.01 The parties agree that a teacher who is a member of the Bargaining Unit may substitute for an absent Principal or Vice Principal for a period of not less than one (1) day on a temporary basis not to exceed forty (40) days in the school year. The Employer shall ensure that the Teacher In‐Charge is protected with adequate liability insurance while in the acting role. The Teacher In‐Charge shall be paid per day in addition to the teacher’s regular grid salary and allowances, the following:
35.02 The Teacher In‐Charge shall continue to be entitled to all the terms and conditions of the Collective Agreement.
35.03 When necessary, an Occasional Teacher shall be hired to replace a classroom teacher acting as the Teacher In‐Charge. Appointment of a Teacher In‐Charge shall not result in additional duties, including APA’s, for another Bargaining Unit member.
35.04 Nothing in this Article prevents a teacher from returning to the teacher’s duties within the Bargaining Unit subject to forty‐eight (48) hours written notice to the Employer.
35.05 A Teacher In‐Charge shall not perform duties that involve evaluation or discipline of another member. Temporary Principal/Vice‐Principal
35.06 When a Principal or Vice‐Principal will be absent from the school for a period of less than one school year, the Employer may appoint a member of the Bargaining Unit as a temporary Principal or Vice‐Principal to fulfill the duties of the absent administrator.
35.07 The temporary Principal/Vice‐Principal shall be paid at the starting grid rate for the position, prorated for the period of the acting assignment and shall be subject to the same working conditions as a Principal/Vice‐Principal in that school for the period of the acting assignment.
35.08 The Bargaining Unit member shall be entitled to return to the member’s former position if it still exists, or a comparable position if it does not, with full rights and privileges as though there had been no break in service within the Bargaining Unit provided that the term as temporary Principal or Vice‐Principal does not exceed 193 work days, within 3 school years.
35.08.01 When the Employer receives notification that the absence of an administrator for whom a teacher has been appointed as a Temporary Principal or Vice‐Principal will exceed "a period of less than one school year", the appointment of said teacher shall conclude no later than 25 days following the notification or the last day of the semester, whichever ...
Acting Administrators. 4.8.1 If a Principal is absent from school for a period of one or more school days, the following shall apply:
(a) An Assistant Principal, where one is available will be designated to act in place of the principal and will, after three (3) consecutive school days of such designation, receive 1/200 of the principal’s allowance on the fourth (4th) and further consecutive school days of the same consecutive period for such acting designation.
(b) Where no Assistant Principal is available, a teacher will be designated to act in place of the principal and will, after three (3) consecutive school days of such designation, receive 1/200 of the principal’s allowance on the fourth (4th) and further consecutive school days of the same consecutive period for such acting designation.
(c) Any of the above mentioned acting designations shall terminate upon the principal’s return, or at the date defined in the offer of designation.
