Compensation for Unused Sick Leave. 1. Employees who enter County service after July 1, 1979, shall not be eligible for compensation for any of their unused sick leave credits.
2. An employee with ten (10) or more years of continuous service during that employee's present employment who retires, voluntarily terminates, dies, discontinues earning sick leave credits by reason of that employee changing from being paid at a biweekly rate, is elected to County Office, or is laid off, shall be paid twenty-five percent (25%) of that employee's accumulated sick leave credits. An employee who received such compensation shall have no right to restoration of any sick leave credit upon return to County service.
3. Employees who earned County service prior to July 1, 1979, and in accordance with the above provisions, shall be compensated for their unused sick leave credits as determined by the following payout ranges: $ 11,001 to $ 12,000 10,001 to 11,000 9,001 to 10,000 8,001 to 9,000 7,001 to 8,000 6,001 to 7,000 Cash payout for unused sick leave credits shall not exceed the upper limit of the range at which the employee's unused credits lie as of June 28, 1979.
Compensation for Unused Sick Leave. When resigning or leaving the district, a teacher shall be compensated for unused sick leave. To be eligible, the teacher must have accumulated seventy (70) days of sick leave and have a minimum of ten (10) years experience in the district. Payment will be $15.00 for each day of unused sick leave with a maximum payment of $1,200.00. Note: A teacher that is terminated from employment, excluding RIF, will not be eligible for compensation of unused sick leave.

B. C. The estate of a teacher who dies while under contract or on leave with the district will be paid for all district earned unused sick leave at the rate of 25% of daily rate of (base) pay. (1993, 2004)

4. All employees shall participate in the County’s Terminal Pay Plan (Plan). However, only the terminal paychecks (including unused sick leave, if applicable) of those employees who have reached the age of fifty-five (55) shall be placed into the Plan. These terminal paychecks shall be placed into the Plan on a pre-tax basis in accordance with the Plan, all applicable laws and all rules and regulations applicable to the Plan.

Compensation for Unused Sick Leave. When an employee hired before June 30, 2013 either retires from the service of the Town, or leaves the service of the Town with at least 12 years of full-time continuous service (as computed for Longevity Pay) as a permanent employee, s/he shall receive payment for 50% of his/her accumulated unused sick leave, but under no circumstances for more than 105 days, at the rate of his/her then current regular compensation as defined hereafter. When an employee hired after June 30, 2013 and before December 8, 2016 either retires from the service of the Town, or leaves the service of the Town with at least 12 years of full-time continuous service (as computed for Longevity Pay) as a permanent employee, s/he shall receive payment for 25% of his/her accumulated unused sick leave, but under no circumstances for more than 52.5 days, at the rate of his/her then current regular compensation as defined hereafter. When an employee hired after December 7, 2016 either retires from the service of the Town, or leaves the service of the Town with at least 12 years of full-time continuous service (as computed for Longevity Pay) as a permanent employee, s/he shall receive payment for 15% of his/her accumulated unused sick leave, but under no circumstances for more than 31.5 days, at the rate of his/her then current regular compensation as defined hereafter. For purposes of calculating the payment of compensation for unused sick leave, regular compensation shall include regular hourly wages paid for 8-hour day and longevity pay for 8- hour day being paid to such employees as of the last month of his/her employment by the Town. No other items of pay shall be included in the calculation. The amount of said pay for each unused sick leave day shall be eight times the regular straight time hourly rate of pay plus eight times the hourly rate of longevity for which the employee is eligible on his final day of employment by the Town.

For the 2018-2019 school year, teachers who retire under OTRS shall receive payment for unused sick leave days accumulated over one hundred twenty days (120 days) to a maximum of one hundred fifty days (150 days) which have not been utilized to obtain an additional year of service with the Oklahoma Teachers’ Retirement System and have not been transferred to another district. Teachers who qualify shall receive payment of $30.00 per day.
2. For the 2018-2019 school year, teachers who retire under OTRS from Newkirk Public Schools shall receive payment for unused sick leave days accumulated over ninety (90) days but less than one hundred twenty (120) days. Teachers who qualify shall receive payment of $30.00 per day.
3. At the beginning of each year each teacher will be notified of available leave balances. Upon request teachers will be notified of their available balances within five (5) working days.

27-10-1 When the teacher has met the requirements for retirement in the District, that teacher shall be eligible for compensation for accumulated sick leave. 27-10-2 A maximum payment of Fourteen Thousand Dollars ($14,000) will be made by the District for teachers who have accumulated one (1) year or more of unused sick leave upon retirement. 27-10-3 The payment of Fourteen Thousand Dollars ($14,000) shall be reduced by 1/184 for each day less than an accumulation of one hundred eighty-four (184) days.
