DUES DEDUCTION/AGENCY FEE. The Committee agrees to deduct monthly from the salaries of its employees dues for the Massachusetts Laborers District Council Local 1116 as said employees individually and voluntarily authorize the Committee to deduct, and to transmit monies promptly to the Laborers Local Union 1116. Employee authorization will be in writing in the form which follows: Name: Address: I hereby request and authorize the Northborough School Committee to deduct from my earnings and transmit to the Union checked below an amount sufficient to provide for regular payment of membership dues as certified by the Union in equal monthly payments for the year and succeeding school years. I understand the Committee will discontinue such deductions for any school year only if I notify the Committee in writing to do so not later than thirty (30) days prior to the commencement of the school year. I hereby waive all rights and claims for said monies so deducted and transmitted in accordance with this authorization and relieve the School Committee and all its officers from any liability thereto. DUES DEDUCTION/AGENCY FEE. The Committee hereby accepts the provisions of Section 170 of Chapter 180 of the General Laws of Massachusetts and in accordance therewith shall certify to the Treasurer of Southborough all payroll deductions for payment of dues to the Association duly authorized by employees covered by this Contract. Employees may authorize the School Committee to deduct from their salary a contribution to Voice of Teachers for Education of an amount, which the employee shall specify in writing. The Committee will certify on the payroll the amount to be deducted by the Treasurer. Such amounts shall be transmitted to the Massachusetts Teachers Association within thirty days.
DUES DEDUCTION/AGENCY FEE. PEA members may have their membership dues deducted from their paychecks for the Association and its state and national affiliates but for no other teacher organizations. Members may change method of payment from deduction to cash between September 1 and September 15. Members must initiate these deductions in writing by October 15. Non-member teachers will have the agency fee deducted from the paychecks. The Penfield Education Association agrees to hold the employer harmless from any and all liabilities which may arise and be attributable to the implementation of this agency fee deduction procedure.
DUES DEDUCTION/AGENCY FEE. Upon receiving written authorization from CCCUE, the District shall deduct from the employee’s pay, without charge, the dues for those employees who are members of the CCCUE bargaining unit.
DUES DEDUCTION/AGENCY FEE. The District shall deduct and make appropriate remittance to the Council all dues and/or agency fees as required by the dues structure of the Council within thirty (30) days of the deduction, in accordance with the following:
DUES DEDUCTION/AGENCY FEE. This section shall be subject to automatic amendment based upon any applicable decisions by the Ohio and U.S. Supreme Court.
DUES DEDUCTION/AGENCY FEE.
A. The Town hereby accepts the provisions of Section 17C of Chapter 180 of the General Laws of Massachusetts and, in accordance herewith, shall certify to the Treasurer of West Springfield all payroll deductions for the payment of dues to the Union duly authorized by employees covered by this contract.
B. In accordance with Chapter 1078 of the Acts of 1973 (M.G.L. 150E, Sec. 2), effective thirty (30) days after the effective date of this Agreement, it shall be a condition of employment that all employees in the bargaining unit, who are not members of the Union, and who have been employed for thirty (30) or more days, shall pay to the Union an Agency Service Fee. Such fees shall be paid weekly commensurate with the periodic charged by the Union to its members. The Union will indemnify, defend and hold West Springfield harmless against any and all claims made, and against any suit instituted against West Springfield on account of any check off of Union dues or agency fee provision. The Union agrees to refund to West Springfield an amount paid to it in error on account of the check off and agency fee provision upon presentation of proper evidence thereof. The Union certifies that this collective bargaining agreement is formally executed pursuant to a vote of a majority of all employees in the bargaining unit present and voting.
DUES DEDUCTION/AGENCY FEE and Seniority Section A – Dues Deduction
1. The Board shall deduct an amount certified by the Union as the Union dues from each paycheck of each teacher who has provided the Board with written authorization therefor.
2. Such authorization for deduction of dues shall continue in force and effect until the teacher submits a written revocation of such authorization to the Board and the Union within the required window period, but not less than thirty (30) calendar days prior to the effective date of such written revocation.
3. Changes in the dues amounts to be deducted shall be certified to the College by the Union treasurer at least thirty (30) calendar days before the start of the pay period the new deduction schedule is to be effective.
4. The amounts so deducted shall be promptly remitted directly to the Union. The Union agrees to pay any costs associated with a Union requested wire or electronic transfer of the amounts so deducted.
5. The Union agrees that it will indemnify and save harmless the College, the Board, each Board member, and all administrative personnel against any and all claims, demands, costs of defense, suits or other forms of liability, and all court or administrative costs that may arise out of or by any action taken for the purpose of complying with this Article provided that the defense of any such claims, demands, suits or other forms of liability shall be under the control of the Union and its attorneys. However, nothing in this section shall be interpreted to preclude the College, at its own cost, from participating in any legal proceedings challenging the application or interpretation of this Article through representatives of its own choosi ng.
DUES DEDUCTION/AGENCY FEE. The Town shall deduct from Employees’ wages and remit to the Civil Service Employees Association, Inc., 000 Xxxxxxxxxx Xxxxxx, Xxxxxx, XX 00000 on a payroll basis regular membership dues for those Employees who sign dues deduction authorization cards. The Town extends to the Association the rights of agency shop and agrees to remit to the Association that sum designated by the Association to the Town as agency fee. The agency fee shall be designated by the Association once per annum on or before the first of the year and the Association agrees that its agency fee shall be in accordance with legal standards and shall not violate the rights of the employees under the applicable statutes and case law defining agency fee. Upon request, the Association shall provide the Town a copy of its Agency Fee Refund Procedure. The Association shall indemnify and save and hold the town and any of its employees, representatives, officers and/or members of the Town Board (collectively “employees”) harmless against any and all claims, demands, suits or other forms of liability that may arise by virtue of the Town’s payment to the Association of the agency fee, regular membership dues and other deductions and its deduction of same from an employee’s paycheck.
DUES DEDUCTION/AGENCY FEE. Section 1. Pursuant to the provisions of Section 17A of Chapter 180 of the Massachusetts General Laws, the Town shall deduct Union dues or initiation fees (as certified in writing by the Union to the Town) for unit employees covered by this Agreement, upon employee-signed authorization (Appendix A). The Town shall transmit total withholdings to the Secretary-Treasurer of the Union or an authorized agent. Dues shall be deducted once per month in a pay period other than the pay period when health insurance deductions are made (this clause shall not apply when deductions are made on a weekly basis).
Section 2. By the tenth (l0th) day of the succeeding month, the Town shall remit such deductions to the Treasurer of the Union, together with a list of employees who have authorized dues deductions. The employee may revoke the authorization for deductions at any time upon written request to the Town and by filing a copy of such withdrawal with the Treasurer of the Union.
Section 3. The Town shall incur no liability for loss of dues monies after deposit and forwarded to the Union in the United States mail.
Section 4. Although membership in the Union in not mandatory for any Lancaster Police Officer, benefits gained by the Union are accorded to all employees represented, therefore, an agency service fee equal to an amount which is proportionately commensurate with the cost of collective bargaining and contract and administration shall be paid to the Union by all non-union employees covered by this Agreement. At the election and upon signed authorization by the employee, said agency service fee shall be deducted from wages by the Town in accordance with Section 17G of Chapter 180 of the General Laws of the Commonwealth. Said authorization may be cancelled by sixty (60) days written notice to the Town. An employee who does not authorize the Town to make weekly payroll deductions as provided herein, shall make the agency service fee payment directly to the Union Treasurer.
