Compensation of Overtime. A. Fire suppression Employees working a twenty-four (24) hour shift schedule shall be compensated in accordance with the requirements for overtime as established by the 207(k) provisions of the FLSA as amended and in accordance with Section 10.2 (A) and (B) above. Compensation for overtime hours worked shall be calculated on a half-time basis in accordance with 29 C.F.R. Sec 778.114, except as provided in Section 10.8 of this Article.

Compensation of Overtime. Overtime will be paid out at a rate of one and a half (1-1/2) times the employee’s regular hourly rate. Overtime will be reported and paid in fifteen (15) minute intervals.

If adjustment periods are not in use, overtime is compensated, regardless of whether the overtime arises as a result of exceeding the maximum daily or weekly working time, such that the first 6 overtime hours are compensated with the hourly wage plus 50% and the subsequent overtime hours are compensated with the hourly wage plus 100%. If adjustment periods are in use, overtime is compensated, regardless of whether the overtime arises as a result of exceeding the maximum daily, weekly or adjustment period working time, by adjustment period based on the length of the adjustment period as follows. length of adjustment period wages plus 50% wages plus 100% 2 weeks for the first 12 overtime hours for the subsequent overtime hours 3 weeks for the first 18 overtime hours for the subsequent overtime hours 4 weeks for the first 24 overtime hours for the subsequent overtime hours 5 weeks for the first 30 overtime hours for the subsequent overtime hours 6 weeks for the first 36 overtime hours for the subsequent overtime hours 7 weeks for the first 42 overtime hours for the subsequent overtime hours 8 weeks for the first 48 overtime hours for the subsequent overtime hours Table 2. Compensation of Overtime. 1. Actual work for the purpose of computing overtime does not include hours paid in non-work status, such as PTO and paid leaves of absence pursuant to Section 13 - Leaves of Absence.

B. The rate used for computing overtime compensation for twenty-four (24) hour shift Employees shall be based on Appendix A of this Agreement. The half time method is computed as follows:
1. Work Period Salary = Annual Salary / Number of Work Periods
2. Regular Rate = Work Period Salary / Number of Hours Worked
3. Half-Time Premium = Regular Rate X 1/2
4. Half-Time Pay = Half-Time Premium X number of hours worked between 204 and 212 hours inclusive.
C. Administrative, specialized and other exempt salaried non-fire suppression Employees shall be compensated at a premium rate of time and one-half the Employee’s straight time pay or by the accrual of compensatory time off at the rate of one and one-half (1 ½) hours of compensatory time for each one (1) hour of overtime worked. The hourly rate for computing overtime compensation for these employees shall be based on Appendix A of this Agreement.
Compensation of Overtime. Regular overtime will be compensated at the rate of time and one half (1.5) the employee’s regular rate of pay. All hours worked in excess of twelve hours (12), consecutively in a workday, will be compensated at double the regular rate of pay (effective 30 days after ratification). Overtime will be rounded to the nearest quarter hour. Rounding means an employee must work eight (8) minutes beyond the hour before an employee is eligible for overtime.
