Compensation of Overtime. In accordance with the following paragraphs, overtime shall be compensated at the appropriate rate either by pay or compensatory time off. a. Unless the employee and the University agree otherwise, overtime will be paid. An employee may, upon hire and thereafter during the month of June, file a written indication of preference for either compensatory time off or pay with her/his immediate supervisor. The University shall grant the preference indicated. If no preference is indicated to the department in the annual June period for changes, the employee’s previous election shall continue. b. Compensatory time shall be paid or scheduled by the University in accordance with departmental needs. Accumulation of compensatory time is limited to a maximum of two-hundred forty (240) hours. An employee shall be paid for hours of overtime which exceed this limit. An employee may request to schedule the use of banked compensatory time. An employee's request for the scheduling of banked compensatory time shall be granted subject to the needs of the University and shall not be unreasonably denied. c. Overtime shall be reported and paid on the basis of the nearest quarter (1/4) hour. 1) Designated hospital-based eight (8) hour employees who are assigned to a fourteen (14) consecutive day work period, a) shall be compensated at one and one-half times (1 1/2x) the regular-straight time rate for hours worked which exceed eight (8) hours of actual work in any work day within the fourteen (14) day work period, and b) shall receive the time and one-half (1 1/2x) overtime rate after eighty (80) hours of actual work in the fourteen (14) day period. 2) Any payment at the time and one-half (1 1/2x) rate for daily overtime hours worked within the fourteen (14) day work period shall be credited toward any time and one-half (1 1/2x) compensation due for hours worked in excess of eighty

Fire suppression Employees working a twenty-four (24) hour shift schedule shall be compensated in accordance with the requirements for overtime as established by the 207(k) provisions of the FLSA as amended and in accordance with Section 10.2 (A) and (B) above. Compensation for overtime hours worked shall be calculated on a half-time basis in accordance with 29 C.F.R. Sec 778.114, except as provided in Section 10.8 of this Article. B. The rate used for computing overtime compensation for twenty-four (24) hour shift Employees shall be based on Appendix A of this Agreement. The half time method is computed as follows: 1. Work Period Salary = Annual Salary / Number of Work Periods 2. Regular Rate = Work Period Salary / Number of Hours Worked 3. Half-Time Premium = Regular Rate X 1/2 4. Half-Time Pay = Half-Time Premium X number of hours worked between 204 and 212 hours inclusive. C. Administrative, specialized and other exempt salaried non-fire suppression Employees shall be compensated at a premium rate of time and one-half the Employee’s straight time pay or by the accrual of compensatory time off at the rate of one and one-half (1 ½) hours of compensatory time for each one (1) hour of overtime worked. The hourly rate for computing overtime compensation for these employees shall be based on Appendix A of this Agreement.

Compensation of Overtime. 1. Actual work for the purpose of computing overtime does not include hours paid in non-work status, such as PTO and paid leaves of absence pursuant to Section 13 - Leaves of Absence. 2. Except as provided in Section §C. below, employees shall be compensated for overtime worked at one and one-half (1 ½) times the straight-time rate when any one the following conditions apply: a. Time worked which exceeds forty (40) hours in a workweek; b. Time worked in excess of the employee’s shift. For the purposes of this paragraph only, a shift is defined as a minimum of eight (8) hours. c. For example, employees assigned a shift of 10 (ten) hours in a work day are not subject to daily overtime until the hours worked in the day exceed 10 (ten) hours of work. 3. Employees shall be compensated for overtime worked at double (2X) the straight time rate for all consecutive hours worked in excess of twelve (12) hours.

Compensation of Overtime. A. Up to the first 15 minutes an employee is required to work overtime at the beginning or at the conclusion of his/her work shift, he/she shall be paid at the time and one- half (11/2 x) his/her regularly hourly rate for a minimum of fifteen (15) minutes. B. A second consecutive fifteen (15) minute period shall be compensated for in a like manner. C. After the initial thirty (30) minutes of overtime is completed, all additional overtime shall be payable in a minimum of thirty (30) minute increments. D. Officers may accumulate one hundred and twenty (120) hours of compensatory time. Compensatory time will not be granted if it creates overtime; provided however on the night shift (2300 - 0700 hours) only one employee may use a Compensatory Day even if it creates overtime. Pay or compensatory time shall be at the employee’s option. No compensation will be made for any unused compensatory time upon the member’s separation from employment.
