HOLIDAY IN-LIEU PAY. 1. Safety employees working a 56-hour schedule shall receive holiday in-lieu pay at the rate of 6.22% of the base salary (percentage defined and subject to adjustment according to the survey formula in Appendix D), only for actual paid time worked in a 56-hour schedule and without regard for based on when holidays occur or whether the employee actually works the holiday. This payment will be issued on a separate check twice a year. The first holiday in-lieu check will be paid on the first payday after June 1st with the second being paid on the first payday after December 1st. For Classic Members and New Members as defined in PEPRA, Holiday Pay additional compensation shall be reported to CalPERS as Special Compensation, Holiday Pay, pursuant to and in accordance with CCR section 571(a)(5) (Statutory Items).

Persons newly employed or re-employed shall only be entitled to holiday in-lieu pay while employed by the Department and employees leaving the service of the Department shall be eligible for holiday in- lieu pay only for time worked which occurred prior to the date of separation. Effective December 1, 2017, employees working a 40-hour schedule shall not be entitled to receive holiday in-lieu pay as outlined in subsection 8.A.2. above. The value of a holiday for a 40- hour schedule employee is eight (8) hours and shall be compensated at straight time.
HOLIDAY IN-LIEU PAY. 1. Unit employees shall receive one hundred thirty (130) hours of holiday pay in lieu of thirteen (13) recognized holiday time off and no compensatory time off will be given when a City recognized holiday is worked.

The City shall pay Holiday In Lieu, holiday compensation at the rate of 4.154 hours per pay period. This Holiday In Lieu, holiday pay meets the definition of special compensation defined in Cal. Code Regs, Title 2, Section 571, and shall be incorporated into the unit members compensation reported to PERS for retirement purposes. In the event that PERS modifies its regulations, the parties agree to meet and negotiate changes to this language. Holiday In Lieu pay shall not be included in the regular rate of pay for calculating the overtime rate of pay. (Note: 4.154 hours per pay period is based on 12 holidays at 9 hours per holiday.)

HOLIDAY IN-LIEU PAY. Fire Communications Operators shall be paid eighty two (82) hours annually at straight time at the employee's regular rate of pay prorated per calendar month, in lieu of holiday time off.
HOLIDAY IN-LIEU PAY. In recognition of the requirements of managing a 24 hour a day, 7 day per week operation, Employee shall be entitled to the same holiday pay in-lieu of time off that is provided to all management employees in the Police Department under the terms of their MOU and as previously provided to Employee as the Chief of Police pursuant to Section 3.2 of the Exempt Management (Unit G) Compensation Plan. Employee understands and acknowledges that such Holiday in Lieu Pay may or may not be considered as income subject to credit pursuant to the Public Employee Retirement System (PERS), based upon PERS rules. City shall have no responsibility for determining or ensuring what PERS credit, if any, Employee may or may not be entitled to relating to said Holiday in Lieu Pay.
HOLIDAY IN-LIEU PAY. A. Battalion Chiefs assigned to a shift, Fire Captains, Fire Engineers, and Firefighters shall receive one-hundred and fifty-four (154) hours of pay at straight time in-lieu of any holiday time off. Two (2) payments will be made annually on pay period thirteen (13) and pay period twenty-six (26) of each year. Following the last payment made for the calendar year (pay period twenty-six), the holiday in-lieu time will be reset at zero (0). Pro-rated adjustments based on time in service will be made for employees entering or leaving fire shift work.
