Inclement Weather/Emergency Days. 1. It is recognized that during the course of the work year, scheduled work days may be canceled at the discretion of the District due to severe weather and/or emergency conditions. For the days allowed by state law for inclement weather in which the District is closed, no secretary shall be required to report to work. Such persons shall suffer no loss of wages or benefits for such days. Any such days which were scheduled days of pupil instruction may be made up during the work year in which they were missed without additional compensation to the bargaining unit members. a. Bargaining unit members may be requested by the District to not report on certain inclement weather/emergency days in addition to those described in Section F., 1, above. Such persons shall suffer no loss of wages or benefits for such days. b. If the District needs to cover an assignment: 1) The District will initially contact the bargaining unit member who normally performs the bargaining unit duties, then the offer to perform bargaining unit duties will be offered to the most senior bargaining unit member within the department. 2) If none are available, the District will offer the assignment to the most senior bargaining unit member within the building. c. The bargaining unit member working the above assignment will be paid at a rate of double time, which means the person will be paid his/her base rate as though she/he were not at the work place, plus the person will be paid the regular hourly rate for the time she/he works. 2. Close-down during the duty day which requires early dismissal: a. No deductions by the District. Regular pay and benefits would be maintained. b. Release of bargaining unit members in school buildings will be at the direction of the immediate supervisor no later than fifteen (15) minutes after the last grade level has been dismissed. c. In case of a District-wide close down which requires early dismissal, all secretaries assigned to work places other than school buildings will be released fifteen (15) minutes after the last grade levels have been dismissed. d. If the administrator requires overtime, the most senior secretary with a classification equal to or greater than the assignment in that department or building will first be offered the overtime. Inclement Weather/Emergency Days. In the event that all classes are cancelled due to extreme weather conditions at Superintendent’s discretion, all secretarial and clerical personnel shall report for duty as designated by Superintendent/designee consistent with teacher reporting. In the event the Superintendent determines that employees not report to work, all secretarial and clerical personnel shall be paid his/her regular daily rate of pay for the day. The District shall also have the right to have non bargaining unit employees perform the work of the bargaining unit employees on an Inclement Weather/Emergency day. However, if the District is required by law, or State regulation, to make up any or all of the Inclement Weather/Emergency day(s), the less than fifty-two (52) week employee(s) shall be scheduled for duty on the additional make up days and will not be entitled to additional compensation or time off for working the make-up days. Furthermore, fifty-two (52) week employee(s) shall be expected to report to work for duty on any day designated as an Inclement Weather/Emergency day that is required by law, or State regulation, to be made up and shall not be entitled to any compensatory time.

For NON-ESSENTIAL CHILD NUTRITION SEIU EMPLOYEES ONLYIn the event school is cancelled after Child Nutrition employees have arrived at their work site and commenced work they shall receive a minimum of two (2) hours show-up pay. 3. Employees who come in early on inclement weather days have the option to work their normal work hours eight (8) hours and go home earlier. If the employee stays to the end of their normal shift, they will earn additional time resulting in Overtime pay for the week if they have more than forty (40) hours worked. 4. If the Superintendent declares an all-district emergency closure in conjunction with a city-wide closure for safety purposes, essential employees who are not on the emergency response team will not report until this designation is lifted. 5. When schools are closed for inclement weather conditions or other emergencies all essential employees shall not be considered tardy within the first two (2) hour window of expected arrival. Employees who arrive late due to weather will still work the total scheduled hours. 6. The district will create an emergency response team and essential employees designated for this team will adhere to the following: Each November operations staff will have the opportunity to sign up to be a part of the emergency response team. The emergency response team is a voluntary assignment. Staff signing up to be a member of the emergency response team will be expected to participate in all emergency events for the remainder of the school year. Inclement Weather/Emergency Days. When an employee’s primary work site is closed/designated due to inclement weather or closed in total or in part due to emergency conditions, no pay shall be lost by any employee and no deduction shall be made from any leave provisions of this Agreement for time lost due to such closure by Aspire. When a Residential employee’s primary work site is designated as an “Inclement Weather Site” due to inclement weather, for all hours worked for the duration of such designation, employees will receive straight time plus one-half (½) time premium in pay.

  • Inclement Weather 16.1 The parties are committed to working together to minimize the impact of inclement weather. The employer will ensure reasonable allowance is included in contracts taking into account historic weather conditions and forecast rainfall. 16.2 Inclement weather means the existence of rain or abnormal climatic conditions (whether hail, extreme cold, high wind, severe dust storm, extreme heat (as defined in clause 14), poor air quality (as defined in clause 15), or the like or any combination of these conditions) where it is not reasonable or it is unsafe for employees to continue working in those conditions. 16.3 The employer or its representative, when requested by the employees or their representative, must confer within a reasonable time (which does not exceed 60 minutes) for the purpose of determining whether or not the conditions referred to in clause 16.2 apply. 16.4 The time work stops due to inclement weather and the resumption of work after a period of inclement weather has ended will be recorded by the employer. 16.5 When inclement weather conditions exist, an affected employee is not required to start or continue to work where it is unreasonable or unsafe to do so. In cases where emergency work is required or it is necessary to complete a concrete pour already commenced to a practical stage, work may occur or continue provided that such work does not give rise to a reasonable concern on the part of an employee undertaking the work of an imminent risk to their health or safety. 16.6 Where emergency work or a concrete pour is completed in accordance with clause 16.5, work will be paid at the rate of 200% of the ordinary hourly rate calculated to the next hour, and in the case of wet weather, the employee will be provided with adequate wet weather gear. If an employee’s clothes become wet as a result of working in the rain the employee will be allowed to go home for the remainder of the day without loss of pay. 16.7 Where an employee is not able to perform any work at any location because of inclement weather, the employee will receive payment at the ordinary hourly rate for ordinary hours. Payment for time lost due to inclement weather is subject to a maximum of 32 hours pay in any 4-week period for each employee. Payment is subject to adherence to the terms of clause 16. 16.8 An employee working on a Job Share arrangement pursuant to clause 30—Job Share, that is affected by inclement weather, will be entitled to payment from the 32-hour inclement weather bank on a pro rata basis. 16.9 Employees accumulated inclement weather bank shall not be deducted whilst they remain on site. 16.10 Inclement weather occurring during overtime will not be taken into account for the purposes of clause 16 and employees will not be entitled to any payment for stoppages because of inclement weather that occurs outside of ordinary hours. 16.11 Employees on a portion of a site not affected by inclement weather must continue to work even though employees working on other areas of the site may have stopped work because of inclement weather. 16.12 Subject to the availability of alternative work in an employee’s classification, an employer may require employees to transfer: (a) from a location on a site where it is unreasonable and/or unsafe to work because of inclement weather, to another area on the same site, where it is reasonable and safe to work; and/or (b) from a site where it is unreasonable and/or unsafe to work because of inclement weather, to another site, where it is reasonable and safe to work, and where the employer, where necessary, provides transport. 16.13 Remaining on site where, because of inclement weather, the employees are prevented from working: (a) for more than an accumulated total of 4 hours of ordinary time in any one day; or (b) after the main meal break, for more than half of the ordinary work time; or (c) during the final 2 hours of the normal workday for more than an accumulated total of one hour; the employer will not be entitled to require the employees to remain on site beyond the expiration of any of the above circumstances. However, where genuine training has been agreed in writing between the parties, then the course maybe completed in extraordinary circumstances. 16.14 Where the employees are in the sheds, because they have been rained off, or because it is at starting time, morning tea, or lunch time, and it is raining, they will not be required to go to work in a dry area or to be transferred to another site unless: (a) the rain stops; or (b) a covered walkway has been provided; or (c) the sheds are under cover and the employees can get to the dry area without going through the rain; or (d) adequate protection is provided. 16.15 Protection must, where necessary, be provided for the employees’ tools.

  • Interconnection Customer Compensation for Actions During Emergency Condition The CAISO shall compensate the Interconnection Customer in accordance with the CAISO Tariff for its provision of real and reactive power and other Emergency Condition services that the Interconnection Customer provides to support the CAISO Controlled Grid during an Emergency Condition in accordance with Article 11.6.

  • Weather User understands and agrees that during the term of this agreement, User will strictly adhere to the Weather Protocols set forth in the Grand Park Emergency Management Plan. The Grand Park Emergency Management Plan is made available on the Grand Park website or by request a copy may be provided by the Commission. In the event of inclement weather, the Commission will retain final determination as to the ability of the facility to support the Event. a. If the facility is unable to support the event due to an "Act of God" the Commission will not provide a refund or credit to the User. User may obtain event insurance through a vendor of their choosing to cover the "Act of God" scenario. b. If the facility is deemed unable to support the event by the Commission, the Commission will work with the User to reschedule such activity as was affected by the facility closure. In such case that the activity may not be rescheduled, Commission will credit the User for such activity as was affected by the closure and allow the credit to be utilized toward a future event. c. If the facility is deemed unable to support the event by the User, the Commission will work with the User to reschedule such activity as was affected within the general time constraints of the User's Event. In such case that the activity may not be rescheduled, Commission will not credit the User.

  • Emergency Calls IP Phones need an additional power supply to operate. In the event of a power failure it is your responsibility to ensure you have the means to make emergency calls. In accordance with paragraph 13.2, we will not be liable for any loss or damage (financial or otherwise) where you fail to do so.

  • CLEC OUTAGE For a problem limited to one CLEC (or a building with multiple CLECs), BellSouth has several options available for restoring service quickly. For those CLECs that have agreements with other CLECs, BellSouth can immediately start directing traffic to a provisional CLEC for completion. This alternative is dependent upon BellSouth having concurrence from the affected CLECs. Whether or not the affected CLECs have requested a traffic transfer to another CLEC will not impact BellSouth's resolve to re-establish traffic to the original destination as quickly as possible.

  • Wet Weather In the event of wet weather, work in the open will continue until the particular work in hand can no longer be done safely and efficiently. Whilst it is raining, employees will be required to: Continue to work under cover or relocate to alternative work under cover, on site. Obtain materials and services for employees working under cover where there is only minimal exposure to inclement weather. When required, perform emergency and safety work. In addition, work on unexpected breakdowns, which can be corrected in limited time duration. Should a portion of the project be affected by wet weather, all other employees not so affected shall continue working in accordance with award conditions, regardless that some employees may be entitled to cease work due to wet weather. If a halt to productive work occurs due to inclement weather, the parties agree that employees may be relocated to other unaffected sites. Where the above steps are not possible, affected employees may be required to attend tool box meetings, work planning sessions or skills development activities, all of which will count as productive time for payment purposes.

  • Emergency Work Employees who are required to report for emergency work on non- workdays, or outside of their regular hours of work on a scheduled workday or on holidays which they are entitled to have off, shall be paid overtime compensation for the actual work time and for travel time in connection therewith, but such travel time shall not exceed one-half (1/2) hour.

  • Emergency Duty (1) This clause applies if: (a) an employee is directed to attend for duty to meet an emergency; and (b) the employee would not ordinarily have been on duty at that time; and (c) the employee was not given notice of the direction before ceasing ordinary duty; and (d) the employee is not at a classification above the salary barrier or an AGS fee earner. (2) However, the Secretary may decide that this clause applies to an employee at a classification above the salary barrier (unless they are an AGS fee earner). (3) For the time on duty, the employee is to be paid: (a) at the rate of double time; and (b) for at least 2 hours. (4) The time on duty is taken to include time necessarily spent in travelling to and from duty. (5) This clause does not apply if the employee is subject to a restriction direction. (6) Clause 3.23 (rest relief after overtime) does not apply to overtime worked in circumstances covered by this clause unless the actual time worked is at least 3 hours for each attendance.

  • CONDITIONS FOR EMERGENCY/HURRICANE OR DISASTER - TERM CONTRACTS It is hereby made a part of this Invitation for Bids that before, during and after a public emergency, disaster, hurricane, flood, or other acts of God that Orange County shall require a “first priority” basis for goods and services. It is vital and imperative that the majority of citizens are protected from any emergency situation which threatens public health and safety, as determined by the County. Contractor agrees to rent/sell/lease all goods and services to the County or other governmental entities as opposed to a private citizen, on a first priority basis. The County expects to pay contractual prices for all goods or services required during an emergency situation. Contractor shall furnish a twenty-four (24) hour phone number in the event of such an emergency.

  • Emergency Overtime In the event of an emergency as defined in Section 13.15 notwithstanding the terms of this Article, the Agency Head or designee may assign someone to temporarily meet the emergency requirements, regardless of the overtime distribution.
