INVOLUNTARY TRANSFERS AND ASSIGNMENTS. Employees who are to receive a permanent change of assignment or transfer within their classification will be informed, in writing, at least sixteen (16) calendar days before the effective date of the change in assignment or transfer, by the Superintendent or the Superintendent's designee, stating the reason(s) for the change of assignment or transfer. It is desirable that such assignments and transfers be mutually agreeable to the employee and the Superintendent or the Superintendent's designee. If the employee objects to the reason(s) stated as being arbitrary or capricious, the employee may utilize the grievance procedures, beginning at Step 2 of this Agreement. If a grievance is filed, the Superintendent or designee may make the change of assignment or transfer pending the outcome of the grievance.

INVOLUNTARY TRANSFERS AND ASSIGNMENTS. 1. Elementary bargaining unit members (K-8) being transferred from one building to another or reassigned from one grade level to another, and secondary bargaining unit members (9- 12) being transferred from one building to another, shall be informed of such transfer or reassignment and the reason(s) therefore in a personal conference with the member's immediate supervisor as soon as possible after the decision to transfer or reassign has been made. During this conference, the bargaining unit member shall be made aware of all current and reasonably anticipated openings in the district. Written notice of the transfer or reassignment, with the reason(s) therefore, shall be sent to the bargaining unit member within fifteen (15) working days of the conference. 2. A bargaining unit member being transferred from one building to another may, upon request, meet with the principal of the building to which he or she is being transferred to discuss the transfer and any vacancies in that building. The bargaining unit member shall also have the opportunity to request a transfer to other positions for which he or she may be qualified in other buildings. 3. At least ten (10) days before reassigning a bargaining unit member from a grade level (K-8) or department (9-12) because of decreased or increased enrollment in particular grades or classes, the building principal shall discuss the anticipated reassignment with the affected bargaining unit member.
INVOLUNTARY TRANSFERS AND ASSIGNMENTS. A. In the event of an involuntary transfer or reassignment, the member shall have the right to a conference with the Superintendent. The member may, at his/her option, have an Association representative present at the meeting. B. The parties recognize that changes in grade assignment in elementary schools, changes in subject assignments in the high school or middle school and transfers between schools may be necessary. While the right of determination to assign or transfer a member is vested in the Board, the Superintendent or designee, on behalf of the Board, will not assign or transfer a member without prior discussion with the member before the transfer is placed on the Board agenda. If such member is not readily available, he shall be notified by registered mail of such assignment or transfer. C. Involuntary transfer shall not be used as a disciplinary action against a member.
INVOLUNTARY TRANSFERS AND ASSIGNMENTS. Each employee of the Board of Education shall be assigned to a specific position at the direction of the superintendent of schools and may be transferred to any other position as the superintendent may direct. Transfers may be at the initiative of the superintendent or other administrative officers for any purpose, which, in the judgment of the superintendent, is for the welfare of the employee or the schools. An administrative transfer or reassignment shall be made only after a conference between the teacher involved, the superintendent, and the teacher's immediate supervisor, at which time the teacher will be notified of the reason therefore.
INVOLUNTARY TRANSFERS AND ASSIGNMENTS. The Committee and the Association recognize that some involuntary transfers of teachers from one school to another or reassignments within a school are unavoidable. They also recognize that under normal circumstances transfer or reassignment of teachers should be held to a minimum. Therefore, they agree as follows: A. Notice of an involuntary transfer or reassignment shall be given to teachers as soon as practicable and, under normal circumstances, not later than June 15th. B. A teacher's area of competence, major and/or minor field of study, quality of teaching performance, and length of service in the Burrillville School System will be considered in determining which teacher is to be transferred or reassigned. All things being equal, the least senior teacher shall be involuntarily transferred. C. An involuntary transfer or reassignment will be made only after a meeting between the teacher involved and the Superintendent at which time the teacher will be notified in writing of the reasons therefore. In the event that a teacher objects to the transfer or reassignment at this meeting, upon the request of the teacher, the Association will be notified and the Superintendent will meet with the Association's representative to discuss the matter. D. Openings in the school system will be discussed with the teachers being involuntarily transferred or reassigned. Such teachers may request the positions to which they desire to be transferred. Teachers being involuntarily transferred or reassigned shall have preference over those seeking voluntary transfer or reassignment under Article X. In consideration of involuntary transfers, those best qualified for a particular position shall receive priority, and all qualifications being equal, the least senior teacher will be involuntarily transferred. E. The Superintendent or building principal shall make available to the Association requested information pertaining to individual reassignments and/or transfers, if this information does not violate a teacher's rights or personal wishes. F. New reassignments as a result of the elimination of positions covered under this Article shall not be made without giving reasonable notice to the President and affected teachers.

Shift transfers may be made at the initiative of the Chief or other administrative officers for any purpose which, in the judgment of the Chief, is for the welfare of the employee or the City. An administrative transfer or reassignment shall be made only after a conference between the employee involved and the Chief or other appropriate supervisor or administrator at which the employee will be notified of the reason for the shift transfer. Nothing in this Article shall be construed to limit the right of the City, if it deems it to be in the best interests of the City to assign fire Department employees duties in other departments.

The Committee and NEA Chariho recognize that some involuntary transfer of educators from one (1) school to another or reassignment within a school is unavoidable, and that this practice should be based upon the educational needs of the school system. B. Written notice of involuntary transfer or reassignment shall be given to educators as soon as practicable. C. When an involuntary transfer or reassignment is necessary, the educator with the lowest Performance-Seniority- Experience (PSE) Score (see Article 14, Section D), certified in the affected area, will be transferred or reassigned. (Regarding the PSE Matrix and its application to involuntary transfer and reassignment, Relevant Experience pertains to relevant experience in current position.) Where two or more members have identical PSE Scores, the least senior will be transferred or reassigned. The following will be used to determine the educator to be involuntarily transferred or reassigned, with due regard for the preference of the individual educator: 1. Reassignment and Reductions in Faculty. a. Elementary K-6 – The educator with the lowest PSE Score in the affected grade, in the affected building, will be displaced. Where two or more members have identical PSE Scores, the least senior will be displaced. The displaced educator may: i. Take any opening available in any building for which the educator is certified. ii. Displace the educator with the lowest PSE Score in that affected building, only if said educator has a lower or equivalent PSE Score than the displaced educator. iii. Displace the educator with the lowest PSE Score in the district, only if said educator has a lower or equivalent PSE Score than the displaced educator. iv. When no position or opportunity exists, the displaced educator shall be considered non-renewed and placed on the recall list. An educator displaced as a result of steps i-iii above may: a) Take any opening available in any building for which the educator is certified. b) Displace the educator with the lowest PSE Score in the district, only if said educator has a lower or equivalent PSE Score than the displaced educator. c) When no position or opportunity exists, the displaced educator shall be considered non-renewed and placed on the recall list. b. They also recognize that under normal circumstances transfers or reassignments of unit members should be held to a minimum. Therefore, it is agreed as follows: (a) Notice of an involuntary transfer or reassignment shall be given to unit members as soon as practicable. (b) When involuntary transfer or reassignment is deemed necessary, a unit member's area of competence, major and/or minor field of study, quality of teaching performance, and length of service in the Akron Central School District will be given a high priority, together with instructional requirements and staff availability, in determining which unit member is to be transferred or reassigned. (c) An involuntary transfer or reassignment will be made only after a meeting between the unit member involved and the Superintendent of Schools at which time the unit member will be notified in writing of the reasons therefore. (d) The Superintendent of Schools shall notify the Association of reassignments and/or transfers.
