ASSOCIATION AND MANAGEMENT RIGHTS. A. For Association business, the Association and its members shall have the right to make use of school buildings and facilities at all reasonable hours. However, unit members shall have access to assigned classrooms and equipment at all reasonable hours for activities which relate to their teachingassignments. B. For Association business, the Association and its members shall have the right to post notices of activities and matters of Association concern on bulletin boards, at least one of which shall be provided in each school building in areas frequented by certificated employees. The Association and its members may use the District mail service and certificated employee mail boxes (including e-mail) for communications with certificatedemployees. C. Authorized representatives of the Association shall be permitted to transact official Association business on school property prior to work hours, during lunch periods, and after work hours in areas designated by the principal. For Association business, authorized representatives of the Association will have the right to use all equipment at all reasonable hours. D. The Association and the superintendent shall determine which commercial vendors, if any, shall be permitted access to district personnel during the school day. Any commercial presentation to a staff shall be on a voluntary basis and not as a part of a regular staff meeting. Lunch rooms shall not be used by vendors during any regularly scheduled lunch period. E. The District will inform the Association annually of any school which is being classified as underperforming as per federal, state, or local legislation. The Association may demand to consult on those items pertaining to a school that is designated as underperforming. The District’s duty to consult is defined in Article VII. F. The Association shall reimburse the District for the cost of a substitute teacher per day for the Association President and Lead Negotiator up to twenty (20) total days per school year. Any days beyond (20) total days will be paid pursuant to Education Code 44987. This does not include release days for negotiations, mediations or arbitrations. G. The District retains and reserves to itself, whether exercised or not, all lawful powers, rights, authorities, duties, and responsibilities which have not been specifically abridged, delegated, or modified by this Agreement. ASSOCIATION AND MANAGEMENT RIGHTS. CHI/CTA/NEA shall have the following rights, in addition to any rights set forth elsewhere in the Agreement. 2.1 CHI/CTA/NEA shall have the right to represent its members in all matters relating to his/her employment with the District. Authorized representatives of CHI/CTA/NEA shall be granted reasonable access to District properties in order to meet with unit members, but such contacts are not to interfere with or interrupt performance of scheduled duties. CHI/CTA/NEA shall also be permitted to schedule meetings on campus, at times and in available locations which are subject to the normal scheduling and reservations systems.
ASSOCIATION AND MANAGEMENT RIGHTS. Section 1: The CITY and the HPSA agree that the CITY possesses the sole right to operate the Department and that all Management rights remain with those officials. These rights include, but are not limited to: (a) Hire, direct, classify, assign, or transfer HPSA Members; except when such assignment or transfer is done as a part of the disciplinary process. (b) Reduce in force, demote, or lay off any HPSA Member because of lack of work or lack of money. (c) Determine appropriate staffing levels and work performance standards, and the means and methods by which operations are conducted, except for HPSA Member safety considerations. (d) Determine work schedules, tours of duty, daily assignments, standards of performance, and/or the services to be rendered. (e) Determine quality and quantity of services to be offered to the public and the means and methods of offering those services. (f) Determine the content of the workday, including without limitation workload factors, except for HPSA Member safety considerations. (g) Take whatever action may be necessary to carry on its responsibilities in situations of emergency such as a riot, military action, natural disaster or civil disorder. (h) Manage its operation in the most efficient manner consistent with the best interests of all its citizens, its taxpayers, and HPSA Members. (i) Promote HPSA Members and determine promotional procedures, as provided in Title 6 of the Henderson Municipal Code (City of Xxxxxxxxx Civil Service Rules) and this Agreement. (j) Educate and train HPSA Members and determine corresponding criteria and procedures. (k) The CITY shall have such other exclusive rights as may be determined by N.R.S. 288.150 and this Agreement. (l) The CITY’S failure to exercise any prerogative or function hereby reserved to it, or the CITY’S exercise of any such prerogative or function in a particular manner shall not be considered a waiver of the CITY’S rights reserved herein or preclude it from exercising the same in some other manner not in conflict with the provisions of this Agreement. Notice requirements set forth in this Agreement shall not be deemed as a limitation on the CITY’S right to exercise the prerogatives provided by this Article or the Nevada Revised Statutes. Section 2: The CITY and the HPSA agree that the HPSA possesses those rights afforded to its members pursuant to NRS 288, NRS 289, State and Federal law, Departmental Policy, and the terms and conditions of this Agreement.

ASSOCIATION AND MANAGEMENT RIGHTS. The Association and its representatives may use District buildings for meetings and to transact Association business. Those meetings, to be held after school hours, shall be approved upon request of the school principal provided such request is made twenty-four (24) hours prior to the use of the building and will not interfere with normal operations or other scheduled events. The Association shall have the right to post notices of activities and matters of Association concern on bulletin boards to be provided in each faculty lounge of each building in the District. The Association may use the District and teacher mailboxes for communication purposes to its members. Representatives of the Association who are mutually scheduled by the Association and the District to participate during working hours in grievance proceedings, conferences, or meetings shall suffer no loss of pay. The Board reserves all the powers, rights, authority, duties, and responsibilities conferred upon it by law and all other rights of management except those limited by the specific and express terms of this Agreement.

  • Association Activities The parties agree employees shall have the right to form, join, and participate in the lawful activities of the Association for the purpose of representation in matters of employment relations. No employee shall be interfered with, restrained, coerced, or discriminated against because of the exercise of such rights.

  • ASSOCIATION RIGHTS 1. The Association and its members shall have the right to make use of school equipment, buildings, and facilities in accordance with the “Civic Center Act”. 2. The Association shall have the right to post notices of activities and matters of Association concern on existing bulletin boards in the schools, at least one of which shall be provided in each school building, in areas frequented by unit members; and a copy provided to the building principal upon request. The Association may use the District mail services, including e-mail, and unit members’ mailboxes for communications to unit members. 3. It is recognized that a valid program change occurs through a deliberate process. This includes the exchange of ideas between the administration and staff. This process recognizes the benefits of utilizing strategies such as consensus building, polling, meet and confer, as well as voluntary meetings. 4. Authorized representatives of the Association shall be permitted to transact official Association business on school property at reasonable times, providing that such transactions shall not interfere with the regular duties of employees involved. The Association representative shall notify the school office of his/her presence on school property. 5. Names, addresses, and telephone numbers of all District unit members who have not requested that this information be withheld, shall be provided to the Association, within six weeks of the commencement of the school year. 6. The Association shall be provided a copy of the Board of Trustees’ Agenda, complete with supportive materials, for each Board meeting, at the same time the Board members receive the agenda. The supportive materials shall be the same as those provided members of the Board of Trustees, except for materials related to items scheduled for consideration by the Board of Trustees in the Closed Session. 7. The representative of the Association shall be recognized by the Board of Trustees, upon request, in order to address the Board of Trustees on any matter which is being discussed, or to be acted upon by the Board of Trustees at the Board meeting. This recognition shall occur after the Board has finished discussion of the item on which the representative of the Association wishes to address the Board, but before a vote is taken upon said item. 8. The Association shall be granted reasonable amount of release time to conduct Association business or attend meetings concerned with the welfare of teachers and/or the improvement of the educational program. The proposed release time shall be approved in advance by a District administrator.
