Leaves in General. Employees covered by this Agreement are entitled to all the leave provisions provided to public employees by Montana statute. In addition, the Employer acknowledges that bargaining unit employees are entitled to leave under the federal Family and Medical Leave Act pursuant to policy found in MOM. Subsection 1. Leave time must be requested and approved by the immediate Supervisor. If Supervisor is unavailable, the request needs to be approved by another Supervisor designated by the immediate Supervisor.

Leaves in General. 1. Upon return to work after the conclusion of approved leave, an effort will be made to place the teacher in the same grade level or position that he/she left. Insurance benefits may be continued at the employee's expense during the leave in accordance with the terms of the insurance policies. 2. The superintendent may send a letter by registered mail to all teachers on approved leaves on or after April 1 of the year on leave. This letter will ask each teacher for his or her intent to return to teaching after his/her approved leave. The teacher has ten (10) working days to respond from the date receiving the letter. A copy of each superintendent's letter must be sent to the president of the Association for the Association's records. A teacher who submits an intent not to return to teaching after the leave shall be considered to have resigned from the school corporation effective the date the superintendent receives the teacher's reply.
Leaves in General a. The Employer may exercise its discretion in granting unit member requests for leaves of absence consistent with requirements of this Article. Unit members shall notify the Employer of their need to be absent as soon as such need is known. This notification shall include an estimate of the expected duration of absence. b. A bargaining unit member’s failure to comply with the requirements of this Article may result in the denial of the bargaining unit member’s leave of absence request. The Employer shall determine whether the basis for a request for leave of absence satisfies the requirements of this Article. c. If the basis for the approved leave of absence becomes longer than estimated, the bargaining unit member shall again notify the Employer of his/her desire to extend a leave of absence. Extensions of leaves of absence must be requested in writing on the appropriate form provided by the Employer. The Employer retains the exclusive discretion to determine whether or not to grant requests for extensions of leaves of absence. d. If the basis for the requested leave of absence is shorter than estimated, the bargaining unit member shall notify the Employer of his/her desire to return, and the Employer shall make a reasonable effort to accommodate the request. e. If a bargaining unit member’s total leave period exceeds six months, including workers’ compensation disability leaves, he/she will have to reestablish eligibility for agency health plan benefits.
Leaves in General. An employee on a paid leave of absence as provided for by this Agreement, or any unpaid leave of up to 30 calendar days shall retain and continue to accumulate all City benefits including: insurance coverage, sick leave, vacation time, and any applicable pay increases. Unless otherwise required by law, an employee on any unpaid leave of absence of more than thirty (30) calendar days or more shall not earn or accrue any City benefits, including but not limited to vacation leave, sick leave, paid insurance benefits, any applicable pay increases, etc., for the period of the leave.
Leaves in General. The Administration can deny a leave requiring pre-approval if it is not in the best interest of student(s) or the leave is disruptive. An employee’s leave benefit will be prorated based on percentage of FTE worked by the employee. The District may fill, on temporary basis, a position held by an employee on leave.
Leaves in General. Medical, personal, and emergency leave will be earned and used in hourly increments (rounded to the nearest quarter hour) based on an 8 hour day. 8 hours (8:00 a.m. – 4:00 p.m.) will be considered the equivalent of one calendar day.
