MEMBERSHIP AND DUES CHECKOFF. 4.1 All employees covered by this Agreement shall have the right to join and/or financially support the union or to refrain from doing so. In accordance with the terms of the Form of Authorization of Checkoff of Dues hereinafter set forth, and in accordance with applicable law, the Employer agrees to deduct Union Membership dues or service fees levied in accordance with the Constitution and By- Laws of the Union from the pay of each employee who voluntarily chooses to execute the dues checkoff form provided by the Union.
MEMBERSHIP AND DUES CHECKOFF. 2.01 All full-time fire fighters who are now members of Local 3139 shall remain so and any new full-time fire fighter of the department shall become a member of Local 3139 within thirty (30) days of completion of the probationary period.

The University shall obtain from each new member of the bargaining unit authorization to deduct from the member's salary cheque membership fees and assessments as directed by the Association. If such authorization is not obtained the University shall not be held liable for Association dues. The University shall forward promptly to the Treasurer of Faculty Association a cheque representing the amounts so deducted together with a listing of the names of those from whom deductions have been made, their ranks, and the amount of such deductions.

MEMBERS OF THE ACADEMIC STAFF EXCLUDED FROM THE BARGAINING UNIT An academic staff member who is appointed to a position excluded from the Association shall cease membership and discontinue paying dues for the duration of the appointment, provided the appointment is for more than thirty-one calendar days. At the termination of the appointment to an excluded position, the academic staff member will automatically become eligible for Association membership, will commence paying dues, and will have all rights and privileges if membership had been continuously held throughout the period of appointment to the excluded position. Members of the academic staff excluded from the bargaining unit solely by virtue of their membership on the Board of Governors shall not be treated differently from members of the bargaining unit with respect to terms and conditions of employment by reason of their membership on the Board of Governors.

Notwithstanding the foregoing, Employees currently employed by the Board, who have previously opted out of membership in the Union, shall not be compelled to join.

You agree that any disciplinary measure, whether interim or final, whether imposed before or after the date of this Agreement, whether expired or in effect, may be posted on our website or otherwise publicly published and may include information identifying you and describing the misconduct alleged. You authorize USA Gymnastics and its members to disclose, in good faith, any information or honestly held opinions about you, including without limitation any membership records, USA Gymnastics SafeSport or Center information, or other disciplinary information, with any current or potential employer of yours. You further agree that USA Gymnastics may disclose any information provided by, or about, you as USA Gymnastics determines is reasonably necessary to comply with any law, regulation, legal process, or any request by any governmental body or agency, the Center, or the United States Olympic and Paralympic Committee (“USOPC”). TO THE MAXIMUM EXTENT ALLOWED BY LAW, YOU FOREVER RELEASE AND DISCHARGE USA GYMNASTICS AND/OR ITS MEMBERS FROM ANY AND ALL LOSS, LIABILITY, DAMAGE OR CLAIM OF ANY KIND OR NATURE, WHETHER KNOWN OR UNKNOWN, WHETHER IN LAW OR IN EQUITY, WHETHER NOW EXISTING OR ACCRUING IN THE FUTURE, ARISING OUT OF OR IN CONNECTION WITH ANY INFORMATION OR OPINIONS DISCLOSED IN ACCORDANCE WITH THIS SECTION.
