MEMBERSHIP AND DUES CHECKOFF. 7.1 Membership in the Faculty Association shall not be a condition of employment. 7.2 All academic staff members of the bargaining unit shall remit to the Faculty Association all periodic dues required by the Faculty Association. In letters of appointment, the University shall inform each new academic staff member of the bargaining unit of these membership and dues provisions and advise them that union dues shall be deducted from their salary as a condition of employment. Academic staff members who move to a position out-of-scope of the bargaining unit will cease to pay dues and will no longer be represented by the Faculty Association except as it pertains to their in-scope position. These individuals shall resume paying dues upon return to their in-scope appointment. 7.3 Prior to appointment, the University shall provide each candidate who has been short-listed for an academic staff position information on how the Faculty Association can be contacted. 7.4 The University shall deduct from the salary of each academic staff member of the bargaining unit membership dues and assessments as directed by the Faculty Association, provided each member who wishes this method of payment has submitted a written authorization for such deduction to Human Resources. 7.5 The University shall transfer promptly to the Faculty Association the amounts so deducted together with a listing of the names of those from whom deductions have been made and the amount of such deductions.

MEMBERSHIP AND DUES CHECKOFF. 4.1 All employees covered by this Agreement shall have the right to join and/or financially support the union or to refrain from doing so. In accordance with the terms of the Form of Authorization of Checkoff of Dues hereinafter set forth, and in accordance with applicable law, the Employer agrees to deduct Union Membership dues or service fees levied in accordance with the Constitution and By-Laws of the Union from the pay of each employee who voluntarily chooses to execute the dues checkoff form provided by the Union. 4.2 Deductions for any calendar month shall be remitted to the designated financial officer of the Local Union within five (5) days of deduction with a list of those employees for whom dues have been deducted. (a) Checkoff deductions under all properly-executed Authorization for Checkoff of Dues forms shall become effective at the time application is signed by the employee and, unless revoked by the employee in writing by registered mail to the Union with a copy to the Employer, shall be deducted from the first pay of the month and each month thereafter. 4.3 The Union shall indemnify and save the Employer harmless against any and all claims, demands, lawsuits, attorney fees or other forms of liability that may arise out of, or by reason of action taken by the Employer under this Article or in making payroll deductions as hereinabove defined. In cases where a deduction is made which duplicates a payment already made to the Union by an employee, or where a deduction is not in conformity with the provisions of the Union Constitution and By- laws, refunds to the employee will be made by the Union. 4.4 There shall be no collection of dues or service fees by the Union during working hours on College premises. 4.5 Any employee whose employment is terminated, or any employee who is transferred to a classification not in the bargaining unit, or any employee whose seniority is broken by death, quit, discharge, layoff or any other grounds for loss of seniority provided for in this Agreement shall cease to be subject to the checkoff deductions beginning in the month immediately following the month in which such termination or transfer occurred or seniority was thus broken.

(An employee wishing to resign her membership or revoke her checkoff authorization is responsible for notifying the union). Any dispute over whether an employee has properly resigned her membership or properly revoked her checkoff authorization shall be between the employee and the Union, and the Employer shall not be liable for dues or fees withheld or not withheld. MEMBERSHIP AND DUES CHECKOFF. 2.01 All full-time fire fighters who are now members of Local 3139 shall remain so and any new full-time fire fighter of the department shall become a member of Local 3139 within thirty (30) days of completion of the probationary period. 2.02 The Corporation shall deduct from the wages of each employee of the Fire Department to whom this Agreement applies, an amount equivalent to the Association dues of a member of the Association and shall remit monthly to the Treasurer all amounts so deducted with a list of names of employees from whom such deductions have been made. Association dues will be deducted on the first regular deduction date of the month following the date of hire of an employee.

If an Employee voluntarily submits a dues/fees deduction form, the Employer agrees to deduct Union dues/fees to become effective the first payday of the month following the Employee’s completion and submission of the dues authorization form. 4.3: All dues authorization forms shall comply with respective State and Federal Laws and shall be filed with the Employer, who may return an incomplete or incorrectly completed form to the Employee for correction prior to any deductions until such deficiency is corrected. 4.4: If the Employees chooses to withdraw his/her dues authorization, the Employee shall notify the Employer and the Michigan Association of Police in writing on the form provided by the Union. No deduction shall be made commencing with the first full pay- period after the authorization was withdrawn.

If such authorization is not obtained the University shall not be held liable for Faculty Association dues. 7.6 The University shall transfer promptly to the Treasurer of the Faculty Association the amounts so deducted together with a listing of the names of those from whom deductions have been made, their ranks, and the amount of such deductions.

Each member who wishes this method of payment shall submit a written authorization for such deduction to Human Resources. 9.5 The University shall obtain from each new member of the bargaining unit authorization to deduct from the member's salary cheque membership fees and assessments as directed by the Faculty Association. If such authorization is not obtained the University shall not be held liable for Faculty Association dues. 9.6 The University shall forward by the 15th day of the following month, a cheque to the Faculty Association representing the amounts so deducted together with a listing of names of those from whom deductions have been made, their ranks, and the amount of such deductions.
