Position Openings. Public Acts 100-103 of 2011 may make certain portions of this Article null and void. In the event it is judged that any portion(s) of this Article is in conflict with Public Acts 100-103 of 2011, the conflicting portion(s) will be subject to the law. A. Vacancy shall be defined as a newly created position or a position within the school district presently unfilled and for which there is not an association member with a contractual right to return. B. As vacancies in the teaching and/or administrative staff of Perry Public Schools occur, notices of the openings will be posted in the teacher lounges and other suitable places and a copy will be given to the association president. 1. Positions as described in Section A shall be posted at least ten (10) working days prior to being filled on a permanent basis. Teachers may apply for such positions by submitting a written letter to the superintendent or his/her designee. 2. Said position will be filled on the basis of experience, certification, seniority and qualifications. 3. When experience and qualifications are substantially equal, preference will be given to employees currently employed by the Board and in line with their seniority. C. If a currently employed staff member applies for a vacancy but is not selected he/she may within seven (7) days request in writing the reasons he/she was not selected. The request will be answered in writing within ten (10) school days after the receipt of the request by the administration. D. If any teaching or administrative position becomes available during the time that school is not is session, the following policy shall be followed: 1. Teachers with specific interests in possible vacancies will notify the superintendent or his/her designee of their interest, in writing, during the last regular week of school and shall include a summer address. 2. Should a vacancy occur, the teachers who have expressed an interest in said position or a similar position, shall be contacted by the superintendent or his/her designee and notified of the vacancy. 3. Teachers on voluntary part-time assignment who wish to return to full-time assignment shall be assigned to an available vacant full-time position for which they are certified and qualified based on seniority. E. Changes in assignments shall be designated as transfers. Adjunct faculty members are encouraged to review such postings as appropriate for tenure-track positions and administrative positions. Members of the unit will be considered internal candidates for the purposes of applying for USNH positions and for the purpose of qualifying for USNH policy USY- V-E-6.1 without regard to the definitions in USY-V-E-6.1.
