Professional Standards Program. A. Effective July 1, 2010 or the first day of the month following the ratification of the Agreement, clerical employees covered by this Agreement may participate in the Professional Standards Program of the National Association of Educational Professionals that program is constituted.
B. Eligibility for participation in the Program is subject to conditions established by the National Association of Educational Professionals. The Union, for itself and the clerical employees within the negotiating unit, agree to hold the District harmless from any and all liability or responsibility, which may arise or result from denial of participation or inequitable treatment during participation.
C. The District will not be responsible for any payment for materials, books, or other items in connection with the Program.
D. Payment for successful completion of approved certificate programs shall require the employee to provide to the Chief of HCI satisfactory written and authorized written verification of successful completion of the respective certificate program(s) set forth below: Basic $300 Associate Professional $400 Advanced $500 Advanced II $600 Advanced III $700 Bachelors/Associates $800 Masters $900 C.E.O.E. $1,000 Payments set forth above shall be annual and shall be paid in the last paycheck in June of each year. Only regular, full-time clerical employees regularly scheduled to work 35 hours or more per week shall be eligible for the above payments.
E. Submission of written verification from the National Association of Educational Professionals to the Chief of HCI will determine the amount to be paid for the first eligibility. If written verification is received during the month of July of any fiscal year, the eligible employee will receive full payment. Any submission beyond July will be prorated for the first year of eligibility.
F. Payments set forth above shall be noncumulative.
G. If a clerical employee is hired into the District and the negotiating unit, who at the time of employment possesses a certificate, as set forth above, that employee shall comply with the procedures set forth in this Section. Such employee shall receive payments upon compliance with this Section only after receiving a permanent appointment to the District.

Professional Standards Program. Section 1. The Parties at the National level agree to develop the framework for a Professional Standards Program (PSP) using the principles outlined in this Article.The purpose of the Professional Standards Program is to provide an opportunity for bargaining unit employees to address performance and/or conduct of their peers before such issues rise to a level requiring corrective action(s) on the part of the Agency.
Section 2. Within one hundred and twenty (120) days of the signing of this Agreement, the Parties agree to form a joint workgroup to assist field facilities in the implementation of a Professional Standards Program. The workgroup will consist of three (3) bargaining unit employees, selected by the Union at the National level, and three (3) members selected by the Agency.The Parties at the National level shall mutually identify appropriate experts to assist in the development of the PSP. Other resources may be utilized by mutual agreement to facilitate the process. Bargaining unit employees will be on duty time, if otherwise in a duty status, and will be entitled to travel and per diem in accordance with FAATP and this Collective Bargaining Agreement.
Section 3. The National workgroup will solicit volunteer field facilities to participate in a pilot Professional Standards Program. Each volunteer facility must submit a statement from the Principal Facility Representative and the Air Traffic Manager, jointly signed, stating they wish to be considered for the pilot program. The number of facilities selected to participate will be determined by the National workgroup. Participation will initially last for twelve (12) months unless either Party, at the local level, determines it is not mutually beneficial and withdraws their participation from the program. Prior to entering into this pilot Professional Standards Program, the Manager and Principal Facility Representative must agree to use the committee/ program as outlined in this Article.
Section 4. The Professional Standards Committee (PSC) will be comprised of bargaining unit employees only, appointed by the Principal Facility Representative or his/her designee.There shall be a chairman of the PSC, appointed by the Principal Facility Representative.The National workgroup, in consultation with the volunteer facility, will determine the numbers of BUEs on the facility PSC.The Agency agrees that PSC meetings are to be conducted on duty time, generally not to exceed two (2) hours per pay period. Eligibility for participation in the Program is subject to conditions established by the National Association of Office Professionals. The Association, for itself, and the employees with this Unit agree to hold the District harmless from any and all liability and responsibility which may result or arise from denial of participation or inequitable treatment during participation. There shall be no release time, paid or unpaid, for participation in the Professional Standards Program. The District will not be responsible for any payment for materials, books, or other items in connection with the Program. Only regular, full-time twelve-month employees shall be eligible to participate and receive payments. All admission fees to the Professional Standards Program shall be borne by the employee. Payment for successful completion of the approved certificated levels described below shall require the employee to provide the Superintendent satisfactory written and authorized written verification of completion of the respective certificated level. Salary adjustments shall be effective upon receipt of verification and approval by the Superintendent of successful completion as set forth below: The salary figures written above are incremental and not cumulative. For example, a unit member having attained "associated professional" status would receive a total of $385.00. The unit member would not receive $385.00 plus $245.00
