Recognition, Jurisdiction and Scope. A. For the purpose of collective bargaining with respect to wages, hours, terms and conditions of employment, the Board recognizes the Union as the sole and exclusive representative for all regularly employed full-time and regularly employed part-time regular education teacher assistants, special education teacher assistants, sign language interpreters, LPN Assistants, behavioral specialists’ assistants and vision and hearing technicians during the term of this Agreement.
B. If any portion of this Agreement is in violation of any law of the State of Illinois, that portion in disagreement shall be considered null and void. All other portions of this Agreement shall remain valid and in force.
Recognition, Jurisdiction and Scope. For the purposes of collective bargaining with respect to wages, hours, and terms and conditions of employment, the Board recognizes the Union as the sole and exclusive representative for:
a. all full-time certified personnel (except as excluded herein) including: teachers, social workers, speech/language pathologists, psychologists, school counselors, school nurses, librarians, interventionists, facilitators, instructional coaches, and sped coordinators (the “teachers bargaining unit”);
b. all full-time (32.5 hours per week or more) classified employees in the following categories: academic assistants, special education assistants, learning center assistants, bilingual assistants, pupil personnel assistants, parent educator, bilingual special education interpreters, sign language interpreters, speech language interpreters, parent liaisons, health assistants, preschool assistants, and hearing/vision technicians (the “support staff bargaining unit”); and
c. all full-time office staff in the following categories: Clerical, Secretary I, Secretary II, and Secretary III, bookkeeper, but excluding administrative assistants (Finance, HR, Associate Superintendent, and executive assistant to the Superintendent) and all other classified staff, certified staff, administrators, managerial, supervisory, and short-term employees as such employees are defined in Section 2 of the Illinois Educational Labor Relations Act (the “office staff bargaining unit”), In the General Provisions applicable to all employees covered by this agreement the units described in subsections a., b., and c. above may be referred to collectively for convenience as “the bargaining unit”.

For the purpose of collective bargaining with respect to wages, hours, and terms and conditions of employment, the Board recognizes the Association as the sole and exclusive representative for all full-time and regularly employed part-time certified/licensed employees and all full-time and regularly employed part-time non-certified employees of Bismarck-Henning Rossville-Xxxxx Cooperative High School, hereinafter referred to as “Employees”. The term “Teacher(s)” when used hereinafter will refer to all licensed teaching personnel in the bargaining unit; the term “Support Staff” when used hereinafter will refer to all non-licensed personnel in the bargaining unit. The Director/Principal, Principals, Director/Principal’s secretary, all supervisors, managerial, confidential and short-term employees as defined by the Illinois Educational Labor Relations Act shall not be included in this defined bargaining unit. It is understood that licensed and non-licensed employees providing services to this district but employed by other agencies, shall not be included in this bargaining unit. Regularly employed part-time employees will participate in and be entitled to receive fringe benefits on a pro rata basis or as otherwise outlined in this Agreement.

For the purpose of collective bargaining with respect to wages, hours and terms and conditions of employment, the Board recognizes the Association as the sole and exclusive representative for all full-time certified/licensed teachers of School District #203. Non full time certified/licensed staff would have set contract parameters to be bargained if their petition is granted by the State to be included in the contract.
2. Other than for the purpose of retirements the Board agrees not to negotiate with any other employees’ organization with regard to items contained in this Agreement unless otherwise provided for in this Agreement or unless mutually agreed to by the parties during the term of this Agreement. It is understood and agreed, however, that the Board, Administration, individual employees or group of employees in the District retain their right to discuss problems relating to educational matters which are beyond the scope of salaries and terms covered by this Agreement.

For the purpose of collective bargaining with respect to wages, hours, and terms and conditions of employment, the Board recognizes the Association as the sole and exclusive representative for all full-time and regularly employed part-time certified classroom teachers of Carbon Cliff-Barstow School District 36. Part-time teachers will only be eligible for fringe benefits on a pro rata basis unless stipulated otherwise in this Agreement.

For the purpose of collective bargaining with respect to wages, hours and working conditions, the Board recognized the Union as the sole and exclusive representative for all regular and one-half certified teaching personnel employed by the Board during the term of this agreement-
Section 2. Should any article, section or clause of this agreement be declared illegal by a court of competent jurisdiction or in the event the Congress or the Legislature enacts a law in conflict with any article, section or clause, of this agreement, said article, section or clause, as the case may be, shall be automatically deleted from this agreement to the extent that it violates the law, but the remaining articles, sections or clauses shall remain in full force and effect for the duration of the agreement, if not affected by the deleted article, section or clause.
Section 3. The Board agrees to implement its rules and policies as they pertain to teachers in a fair and impartial manner.

For the purposes of collective bargaining with respect to wages, hours, and terms and conditions of employment, the Board recognizes the Union as the sole and exclusive representative for all personnel as identified in the Preambles to Sections 2, 3, and 4 of this Agreement excluding such employees as identified in this Agreement and all other such employees as defined in Section 2 of the Illinois Educational Labor Relations Act.

Section 1 For the purpose of collective bargaining with respect to wages, hours and other terms of employment, the Board recognizes the Union as the sole and exclusive representative for all professional employees (as defined by the Illinois Educational Labor Relations Act) that hold a teaching position requiring a certificate under Article II of the Illinois School Code, excepting supervisory, confidential or managerial employees (as defined by the Illinois Educational Labor Relations Act).
Section 2 Should any article, section, or clause of this agreement be declared illegal by a court of competent jurisdiction, it shall be automatically deleted from this agreement to the extent that it violates the law, but the remaining articles, sections, or clauses shall remain in full effect for the duration of the agreement, if not affected by the deleted article, section, or clause.
Section 3 The Board agrees to implement this contract as it pertains to teachers in a fair, impartial, and consistent manner.

For purpose of collective bargaining with respect to wages, hours, terms and conditions of employment, the Board recognizes the Union as the sole and exclusive representative for all regularly employed full and part-time (meaning employed part of every school day for the full school year) certified teaching personnel -- excepting only the Superintendent, principals, assistant principals, full-time athletic director-xxxx and all other supervisory, managerial, confidential and short-term personnel.
Section 2. Should any article, section, or clause of this Agreement be declared illegal by a court of competent jurisdiction, said article, section or clause, as the case may be, shall be automatically deleted from this Agreement to the extent that it violates the law, but the remaining articles, sections or clauses shall remain in full force and effect for the duration of the Agreement, if not affected by the deleted article, section or clause.

For the purpose of collective bargaining with respect to wages, hours, and working conditions, the Board recognizes the PHEA as the sole and exclusive representative for all regular contracted certified employees of the Board during the term of this agreement excepting only the superintendent and principals.
Section II. Should any article, section or clause of this agreement be declared illegal by a court of competent jurisdiction or in the event the Congress or the Legislature enacts a law in conflict with any article, section or clause, of this agreement, said article, section or clause, as the case may be, shall be automatically deleted from this agreement to the extent that it violates the law, but the remaining articles, sections or clauses shall remain in full force and effect for the duration of the agreement, if not affected by the deleted article, section or clause. Should any article, section or clause of this agreement be changed, it shall be done by mutual agreement between the Board and the PHEA.
Section III. a) The Board agrees to implement its rules and policies as they pertain to teachers in a fair, impartial, and consistent manner.
