Vacant or Newly Created Positions. (a) All vacant or newly created positions shall be posted for a period of five (5) working days, during which time employees may make application in writing to fill the position. The vacant or newly created position notice shall contain the following comments: (b) Upon receipt of these applications, the Employer will fill the position with the candidate who has the most seniority with the Employer, provided he can perform the normal requirements of the job. (c) The Employer has five (5) working days after the vacancy to fill the position. During this period, the position shall be filled at the Employer's discretion. (d) Once the position has been filled, the Employer shall post the name as well as the seniority of the person who has obtained the said position. It is understood that any employee who believes he has been wronged by the employer's decision may submit a grievance upon knowledge of the employer's choice.

Vacant or Newly Created Positions. (a) In all cases of vacant or new positions, the preference of employment will be awarded on the basis of operation seniority competency considered. (b) The Company will post the position for a period for seven (7) calendar days. An employee on an approved leave will have the opportunity to bid for the position within three (3) calendar days of their return to employment. The return must be within thirty (30) calendar days of the posting. (c) Once the position has been filled, the Company shall post the name as well as the seniority of the person who has obtained the said position. It is understood that any employee who believes they have been wronged by the Company's decision may submit a grievance upon knowledge of the Company's choice. The Company shall provide training opportunities for employee advancement based upon seniority.
Vacant or Newly Created Positions. Section 1: All shift and status changes, transfers, vacancies, and newly created positions in the bargaining unit shall be posted seven (7) consecutive days, excluding weekends and holidays. Notice shall be posted in a conspicuous place on the Employer intranet site and in each health center and a copy of the notice shall be delivered by U.S. mail, e- mail or fax to the President of the Association and all local Union officers. The notice shall state the location, description and qualifications of the position. Section 2: In the event any Nurse wishes to submit an application for said position, said Nurse shall give the application to his/her Manager. Section 3: If there are two (2) or more equally qualified applicants for a position, as determined by the Employer, preference shall be given (1) to an employee over a non-employee and (2) the most senior employee. Section 4: All applicants for a position shall be notified within five (5) working days after it has been filled. Section 5: In the event a registered nurse requests an increase or decrease in regularly scheduled hours, the following procedure will apply. If the supervisor feels that the request cannot be accommodated by that department at that specific location, no change will be made. If the supervisor feels that the request can be accommodated by that department at that specific location, the change will be posted for five (5) days prior to accommodating the registered nurse. The posting will include the specific details of the change and all registered nurses with the appropriate status in that department at that specific location may submit an application to the supervisor. The selection process will follow the same procedure as that of the vacant or newly created position.
Vacant or Newly Created Positions a) Except for a vacant position that is eliminated, when a position becomes vacant or is newly created, it shall be posted within a maximum period of six (6) months. A position becomes vacant when its incumbent leaves it definitely, no matter the reason. b) The position shall be posted electronically on the Employer’s job site for a minimum of fourteen (14) days and shall be accessible to Employees. The Employer shall send the text of the posting to the Union electronically no later than the day of posting. c) The Employer shall inform the Union that a position has been eliminated within the six (6)-month period mentioned in the first paragraph. Should the Employer be unable to meet this deadline, the Employer shall inform the Union and provide reasons. d) The Employer shall complete the selection process and fill the position no later than four (4) months following the closing date of the posting. This period shall be suspended during the periods from June 23 to Labour Day, and from December 15 to January 15. e) The Employer shall provide the Union with a list of vacant positions by department, pursuant to article 11.

Where two or more applicants are determined relatively equal under this criteria, seniority shall be the determining factor. 12.02 In filling a vacant or newly created position, the Employer shall advise employees of the competition by posting a notice containing the required qualifications, on the Employer's website for five (5) working days. A copy of the posted notice will be forwarded to the President of the Local. 12.03 Where a regular Employee has accepted a vacant or newly created position, the employee shall serve a trial period of sixty-five (65) days worked. If the employee is deemed to be unsuitable for the position, or is unable to perform the duties of the position, the Employer shall return the employee to the employee's former position or to a comparable position, without loss of seniority. 12.04 The Employer shall notify the Union of the name of the successful applicant appointed to a vacant or newly created position.

Vacant or Newly Created Positions. Definition (a) For the purpose of this Agreement, management shall have the exclusive right to determine if a vacancy exists and whether it will be filled or not.
